Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Keep calling from different numbers but always claiming to be Data Check- claiming I owe for a bad check from a checking account I had 20 years ago! Have old info and I haven't given them any info.

They have been calling, todai is the first time I answered.  They threatened me with court action for a $12 check that bounced in 1994, but I paid when I got the notice.

I received numerous calls a day to both my home and cell from numbers all across the country, here's a few, I will need to link more later. There are so many it's hard to keep track of them all. They claim I owe $25 from a account that was closed in a state I no longer lived in, written in another state on a day I wasnt even there for ( I was at my Mother's funeral the time they claim I wrote the check in another state) from over 16 years ago.  I don't owe a bad check, never wrote one at the place they claim it's from.

When you get a person on the line most of the time they won't give you info about who they are, tell you to give them your info, get mad if you ask them to mail you proof, and tell you you're going to jail if you don't, they call you names, and they threatened me.

They are a scam collecting on checks written 10 to 20 years ago, they don't follow FDCPA law, but they say the don't have to cause they are 1st party however this is not true cause the original debt owner is now a defunct company(they are collecting on good written checks saying they Was non sufficient funds on Check what my bank said)... I don't know how they are still in business shows how hard the ftc and fbi are working if they are letting these peoples scam money out of people

Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

If a voice on the telephone claims you owe a debt:

1.    Demand the person give you his or her name, company name, and address
2.     Demand a debt validation letter by US mail.  E-mail no good.
3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

If they are bothering you, report them:

If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.
