- Local GirlDidn't identify himself. Acted as if he was a friend and I mistook him as a family member. Then he said is this...of course I said yes and then he told me about an affidavit of fraud for an outstanding debt and told me the ridiculous amount owed. Nothing has ever been sent in writing advising of the outstanding debt. Just these phone calls and they never leave a message.

- Andi| 1 replyJust received a phone call from this number stating there is a case against me that is 4+ years old BUT included in a bankruptcy. They have called my family after I specifically told them to contact my attorney. Being in collections for 10+ years, bound by third party laws, they are breaking them by stating anything other than who they are AND a phone number and a reference # THAT is all they can say. Anything more e.g. civil suit, case action, etc is ILLEGAL and breaking the law. They are also breaking the law once I told them I had filed bankruptcy gave them my attorney's name and number and advised them to call him and they called me and my family again.

I wasn't sure this was right so I gave the info to my friend and let her deal with it, telling her all that I've read on this site about this number.

- unhappy| 2 repliesCalled looking for a person who does not live here- saying it was an emergency - they me terrified that something happened to the person they were looking for-but then they stated it was a lawsuit for a bad debt they were filing against him. The TRI financial rep was very aggressive, and I advised him I would pass the message along to the person they were looking for, but that was all I was willing to do. Received repetative messages on my voice mail asking me to call this number back. The person called back yesterday (10/8/08) and was EXTREMELY aggressive. Unfortunately, I'd had very little sleep the past two nights, caring for a sick 3 month old and an asthmatic 4 yo, and I was at my wits end when this nincompoop called and was threatening me about someone that didn't even live here. The rep stated he was going to call me every single morning and wake me up until the person he was looking for called him back. I told him that was completely inappropriate- he began yelling at me, so unfortunately, after two days of no sleep - I became very irate, said a few inappropriate things myself and hung up. I hope this jokester doesn't call me back, but I'm sure he will.

Margie - confused in florida replies to unhappy| 1 replyWe received calls from this company several times on a claim from 1992. I explained on numerous occasions that the statue of limitations had exhausted on this claim. The "paralegal" would not give the name of the company but told me the statue had not run because there was activity on the file as recent as April 2004. When I asked for proof of a payment she stated that she had spoken to my husband who informed her company not to speak to me whatsoever and give out no information because I was the reason he was in a financial mess. The "paralegal" then began to spout off things on my credit report and proceeded to say that she was aware we owned several automobiles that they may have picked up to cover the outstanding debt as well as a home and she was not familiar with the area where we lived but once they took our house she just may enjoy living in MY house in this area. She also stated that she had spoken to my husband who had agreed to pay the bill that was originally $1500 but now that it was with her had gone to $13,114! But because she felt like being nice she would accept $2300. Is there anything legally they can do? I know in the state of Florida the statue of limitations is 5 years but obviously this company is pulling our credit reports causing inquiries which hurt your credit score as well. She has pulled our credit without our permission, isn't that illegal in itself??? HELP!!!!
- WorriedI had received a call a week ago advising me that due to an overdraft of my bank account I now owed $2765. I have not used the account in question since 2005. They guy would not tell me where the charges came from or provide me with any documentation to explain why I would owe this amount. He indicated that legal action had been filed and that I would be served with a summons to appear in court but that because these are federally insured funds backed by a Fortune 500 company I would not stand a chance in fighting it in court. I was definitely upset and it looked like I really didn't have any options and I no longer live in the county where this is supposed to be taking place so I asked what my options were and how I could contest the charges. He indicated that I could make a lump sum payment of $1605 to settle the account. I told him I needed to look into some things and would get back to them because I really had no idea what was going on at the time.
A week later after talking to a friend and looking up some collections rules on the internet I call back to obtain some information. I asked what company Kerri Smith (the case handler) represented and she said they are a law firm based out of New York and are not a collections agency and got angry at me when I asked if she would send me the name of the original creditor, the amount I supposedly owe and the date of the debt as outlined in the Oregon Fair Debt Collection Practices act which requires this information be sent within 5 days of contact. She said that the account was no longer with them and that it was with Lane County but they could get it back if I agreed to a make a settlement payment of $1873. SHe also stated that it was too late and that this the information I was requesting had been sent by others multiple times and she did not have to send it because it was too late. I asked "what do you mean by it is with Lane County" she indicated that legal action will be taken and a Sherriff will be providing me with a summons to appear in court at which time I will be asked the same questions she has been asking for which I have no answer (why I hadn't paid to which my answer was paid for what? Where did this debt come from?). I asked where this supposed correspondence had been sent and she said "look mam, you received it". She said that they do not have to provide me with it and that the debt is from 2000 (at which time I was 17 and had never had an overdraft in my life) and is an overdraft and not a credit debt so the Fair Debt Collection Practices don't apply. She also said that I had made a $73 payment which validated my debt which I never have. She stated that I had already received all of this information and that I have not responded so my time is up, I am going to have to pay one way or another either willfully or forcefully. I advised that although I had moved I had had my mail forwarded so I would have received any correspondence had there been any and I also I indicated I had not made a payment. She then asked me to hold and some angry guy got on the phone without indicating who he was or why I had been transferred. I advised him that I wanted to contest the charges and that I didn't feel they were correct. He told me that was not an option and started yelling at me and saying that I was arguing with everything and I just had to pay. He was getting really riled up so I hung up.
From what I am reading it looks like everyone has just ignored them, will ignoring them allow them to continue to negatively impact my credit? Has anyone actually had any legal action brought against them after being contacted by this company? I am worried about ignoring them but $2765 is a lot of money for a debt I never incurred.- Caller: TRI and Associates

- Lady replies to confused in floridaHi, yes the 'gentleman' from Tri and Associates (another alias) did the exact same thing to me regarding telling me things that are on my credit report. It is illegal for anyone to run your credit without your permission. Make a note of everything said by him and prepare to contact the state attorney general. The credit agency is required to contact you in writing within 5 days of contacting you by phone.

I got a call saying he was with a legal office in New York and they had been trying to track me down for months. I asked who he had called as no one and I do mean no one has mentioned it. He named old buisness associates, relatives extended and by marriage, imeadiate family and friends. Half the people I didnt even know, others I talk to on the regular. I thought that odd but I was terrified as he explained that my debt was nearly $5000. I inquired how it got so much and what creditor it was with. According to him the debt was a credit card that had closed and the last payment recieved was in early 2004 through a previous collection company. I was a bit confused and asked what I could do or what could be done as I am a stay at home mom whose husband is a seasonal employee in Alaska and we live pay check to pay check. He put me on hold then transfered me to his supervisor who then explained that he would be again placing me on hold to negotiate with the company regarding a settlement. He came back with 2200...impossible as I had 1200 only. Again on hold he came back with a "1500 and that is it, no lower"! I being niave and dumb, agreed to the settlement. I gave him my bank info, I know stupid, and we agreed on a date for the settlement to be deducted. Would you know that money sat in my account untouched for nearly 3 weeks. I discussed it with my parents and told them how odd it was, and they had never recieved phone calls from this company! My parents adviced me to close my account and reopen a new one. I did just that! So today, after over 6 weeks later, I am in an appointment and recieve 4, yes 4, back to back calls. I fianlly answer and have some jerk on the other end telling me that I bounced my check for the settlement and they have been trying to call me for some time now. I informed him I was busy and could not talk, and also informed him that this is the first call from thier company in just as much time. I have never recieved a settlement letter nor any other corespondance and they have my address. I also let him know that I have not gotten a call inquiring as to my settlement! I was irate and not letting him talk so he transfered me to his supervison with no warning what so ever! I then informed the super that I would not be giving them any more banking info and requested that I get something in writting requesting any info from me. He asked for my email, which I gave along with the remark that anybody can send email I wanted something legit with the company letterhead and info. yeah! I got an email letting me know I have until close of buisness on the 31st to pay. I looked them up online...nothing, BBB...nothing, called AG of New York started a complaint against them and finally responded to the email. I formally requested a copy of my entire file, any court documents, past collection agencys, as well as payment history from begining to now. Told them I was out of town and would need to meet with my lawyer once I recieved documents via mail, as he is investigating the company, talking to BBB, and looking into the legitimacy of the debt and what statute of limations may apply. Hopefully I never hear from them again!

Scared me soo bad. It was for a loan I had taken out, but things have been hard right now financially and I haven't been able to pay it back.
