me toooo!!! replies to To DD
My state's attorney general's office told me that they will definately take care of this after they listened to the recording of the investigator that called me about my "case".  They were very happy that someone could finally provide a recording of the illegal tactics this company uses.  I have dealt with many collection agencies cuz I do have a ton of bad debt, yea so what?  I am doing my best to pay my oldest and biggest debts off first.  The weird thing is that most of the agencies I've dealt with eventually helped and updated everything on my credit.  The attorney general said that im not legally responsible for this old card that they are "investigating" cuz it is not withing the legal time limitations or something?!? The attorney general said that I should just keep letting them call and leaving the pre recorded messages.  Oh yea... the attorney general listened to my answering machine too and said that when that mean guy computer calls, it violates the FDCPA disclosure laws.  If you owe debt like me you HAVE TO PAY IT!!!!  But - you dont have to deal with this crap from people like this.  The attorney general is helping me with finding a lawyer because I was laid off and don't have a lot of money.

If you can contact me at reporttrifinancial@yahoo.com with your email address and just a basic outline of what happened, I will keep you in the loop regarding any information about Tri-Financial.  I am considering pursuing legal action against them, and I am a freelance journalist with contacts in the Philadelphia media.  One of the major stations, affiliated with a network, has a crack reporter who is also an attorney.  The consumer reporter works with her and they regularly expose these sorts of companies. In order to fight back, we need to work together.  Help me and I can try to help you.  Be sure to save any documentation you can, take notes or try to use a speaker phone so others can help you document the conversations, and get names and extensions when someone calls if possible.  Document the date and time of the calls and any threats made.  Don't panic--just collect as much information as possible and we can expose these folks.  Violations of the Fair Credit Act can result in severe legal consequences for the firm and the collectors.  I know of a woman who lost $90,000 in a lawsuit when she was a collector and she violated the Fair Credit Act.  We need information and documentation to pass on to the reporters.  So take good notes.

    Amused
These idiots have been calling me constantly for a couple weeks. I spoke with them at first and the lady told me i had 30 minutes to secure a payment or they would not be able to stop the client from sueing me for an amount 5 times what she wanted to settle for. It freaked me out and i secured a payment, stupidly. The next couple days i read about my rights and found websites like this and i immediately changed my bank account number and called them to tell them to cancel the payment and the guy told me i had only 3 days to dispute them... Which was the first of many [***] lines they gave me. And , of course, despite me telling them to cancel the payment i had set up, they tried to put it through, and i started getting very rude calls about them having an affidavit on their desk, and i needed to call them or they would have to take me to court and put this debt back on my credit report (they told me they had it removed when i secured the payment, which doesn't sound right) ... i ignored them until they started calling my family, and i know it is illegal for them to call a third party when they already know my phone number and i explicitly told that i had no other contact number. Then, i got the rudest message of them all from the 716-213-4370 number this week. The guy scoffed at me and told me he and the client didn't believe i had spoken to an attorney, which i did, and i had better call him back, blah blah... very hateful... he didn't leave his name or the company he worked for, but i knew his voice very well from the constant calls and messages from the past couple weeks. Then i got a call the same afternoon from the same number, only, this time it was a very polite woman who claimed to be an attorney representing Tri-Financial... i asked her why she was calling from the same phone number as the [***] that morning, and she insisted that i was mistaken, that the area code was the same, but not the number... (WHAT?!) anyway, she said that she would settle with me for even less money than before and she told me my credit score and that i could raise it 40 points by making this payment. I told them the only way they are getting a dime from me is by court order. She said, "well, if that's the way you feel about it..." and hung up. I haven't received a call since. By the way, this credit card debt defaulted in 2002. The prescription in my state is 3 years. The prescrition in the state i got the card is 5 years. They insist that the prescription is 10 years.... and the "attorney" i supposedly spoke with told me there was no prescription.

this number was on my 12 yr old daughters cell as a missed call during the day when she's at school.  She mentioned that she'd been getting weird vm when she turns her phone back on but no number shows up in missed calls.  I told her to leave her phone on but silent during the day so I could track the number.  This 7162134370 number was on there from today.  So I just called it at midnight CT.  Some old man answered half awake.  I told him I'd missed the call but was wondering how old he was and he told me it was too late to have a conversation, then hung up.  He's going to be hearing from me at a decent time of day again!!!  All our numbers our listed on the do not call registery.  I'll take this where ever I need to so I can stop these calls!!

i had an online cash advance that i defaulted on. less than two weeks after the initial due date, i got one phone call from Adrian at Tri. She called my work and told my boss i was going to be charged with fraud, called my family members and told them i was going to be thrown in jail, and scared my grandmother enough into making a payment for me without my knowledge. she is an old lady who doesn't know about the scams these pricks use, and now she's out all this money and i'm still getting the harassing phone calls. i have an appointment with local attorney may 20, i intend to have all my questions answered. they are not allowed to disclose any personal information to ANYONE, including your boss or family. i recommend you all file civil suits of your own.

    Linda
I have no idea who these people are until I googled the phone number and found this page. I've never heard of them, but apparently my sister got a loan with them months back. My sister said she never gave them my number, but somehow, they found my cell number and have been harassing me, leaving me voicemails, etc. They even called me at 3:14am this morning! And just again today right before I found this page. I've already told them that this is not her phone and to leave me alone because it's not my problem, but they still call. Darn these people to heck! I'm just venting. :) Thank you for reading.

    Seriously? replies to To DD
These types of "collection agencies" are scams. I have been getting calls on my cell phone from this number and others that can be traced back to them for my sister concerning a debt that her ex-husband owned which was resolved at the time of their divorce.  She has the legal documents to support the resolution.  Futhermore, I did not start receiving calls for this until the end of May, 2009.  That makes this RESOLVED debt 11 years old. We have recording on VM of threats to put liens against property, (which she doesn't have and never did) garnishment of wages, etc...  Thus the reason to contact the state AG's office. You're missing the point... The debt may have been owed at one time. It has since been resolved. These people are using illegitimate and illegal practices to scam money from people. BTW, I DIDN'T see any report on Dateline, I (and my sister) are living it.

    RU4real? replies to no one
Ummmm.....seriously?  Are you not reading the content of these messages?  If this were a legitimate attempt to collect a legitimate debt, they woudl disclose their identity and provide the documentation to back their claim.  The point behind "don't answer the phone" is if you don't recognize the number, don't answer, screen your calls be safe.  If it is indeed a debt or situation you are aware of, go ahead and respond.  The unfortunate fact is, there are shady, illegal "collection" companies that are finding peoples info. and trying to scare people into giving them money.  These scam operations are being investigated but they require victims reporting these types of calls.  So before getting all self-righteous and snarky, read.

Nope.... replies to No so happy
They are using scare tactics, plain and simple. IF they were legit, they would have sent a letter.  To REFUSE to do so is a direct violation of the Fair Debt Collection Act. They are REQUIRED to advise you that your call may be recorded. And lastly, if you are indeed working with a debt settlement company then advise them of these calls. I would also suggest repoting these calls to your state AG's office.  Above all, if they are behaving and talking to you in a way that is inappropriate, hang up.  Regardless of debts you may or may not owe, there is no good reason for anyone to talk you like that.
