Called my cell (using 716-748-8211) - shows up as a missed call - thank God, since it
seems a LOT of people got called by these "people", for apparently illegal purposes.

I get several calls a week by "unknowns", and they all fall under the same pattern.

If I do manage to answer, they usually answer in a foreign accent or a different language
than English, and I *(usually!) politely tell them they have the wrong person, and that they
do not have this number right. They usually say something else, and I politely remind them
not to call me again ... and then I get another call by a different number !

Persistant buggers, but there ought to be a law ...

They keep calling and harrassing.  They are asking for someone I dont know.  They called 18 times in 3 hours and filled up my voice mail.   I cleared out my messages and they called again left harassing messages my voice mail was full.  They said they are a local carrier but they are calling across the country and needed a current address.  Hello? I'm disable!

You should not represent yourself Pro Se on these cases.  The FDCPA provides for attorney fees if you win.  You should find an attorney that will take this on a contingent fee basis.  I would recommend going to www.naca.net and looking for an attorney in your state that specializes in going after collection agencies.  Do not hire one unless they agree to pursue it on a contingent basis.  Good luck.

I searched this phone number 716-748-6948 and this is the forum that came up.  I hope I can help someone else that has the misfortune of dealing with APEX HOLDINGS.  This is not a real company - they change their name to avoid being found.  I was threatened with criminal charges for defaulting on a payday loan.  First of all - I did default on this loan but did eventually pay it off.  2nd of all - Collection agencies in NY state are NOT allowed to collect on payday loans!!!!  Here is an alert that the BBB is issuing:
"BBB has seen a major increase in collection agencies starting business in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with federal and state law, we have asked for specific information from all collection agencies located in our service area, including proof of licensing, bonding, and or registration required by NY state or other governments where the business is located, as well as proof of licensing required by any state in which the business operates. This collection agency has not responded to our requests. BBB advises consumers to be aware of their rights in regard to collections. This includes New York States law prohibiting any collection agency from collecting on Payday loans in the State of New York. The Fair Debt Collection Practices Act (FDCPA) outlines prohibited behavior when attempting to collect a debt, and outlines specific rights for consumers. There are penalties for agencies found in violation of the Act. BBB advises consumers to become familiar with their rights under the Act, which can be found at the link below: http://upstateny.bbb.org/storage/75/documents/debtcollection.html"
Last but not least - Collection agencies that use threats and intimidation tactics are violating the FDCP - Turn them in!!

716-748-6948 APEX HOLDINGS.  This is not a real company - they change their name to avoid being found. They also change their phone numbers, and also Spoof numbers on your caller ID. Real Low Life. Here's the lay of the land as they say, I work in the court system so I will go thru this for you .

First they are calling because they say they can not find you. This is Crap as the sheriff, will NEVER, EVER call you to tell you they are coming. They live to work on the element of surprise. Plus if your township, county etc, wants you, they already know where you are, so sit tight.

Second, and most important, NEVER CALL these low life bottom feeders back.  Because truth be known they don't care who they talk to as long as they can get money from someone. It doesn't even have to be the right person. If you call them back then they know that they have a real tangible working phone number that they can call to harass you all the time of day and night.  Just ignore the call, or better yet, tag them as a spam call in your phone, and you'll never even see them ring it.

Third, these people function and live on the *Fear factor* they will say anything,  tell you anything to get you to give them the money thru your checking account, debit card or credit card.  Many people get scammed this way. I've heard : coming to your workplace to arrest you, serving you in the morning if you don't call by a certain time, attaching your salary, etc, etc, this is all nothing but crap.

Fourth, in most states payday loans are ILLEGAL as they charge obnoxious interest, and states are trying desperately to control that.  Since I'm not sure of what state anyone is in, I cannot site them all here, but if you go to your states attorney general page, you should be able to look up the laws.

Fifth, I know it sounds nice to send them a letter or report them, but this is a futile. They have got this to a science.  With all that is going on in court system they know they have time on their side.  Not enough of these low life bottom feeders get caught and prosecuted, if they did...they wouldn't still be in business, but they are, thousands of them.

Lastly, anyone who posts that you are scum or a deadbeat PAY YOUR BILLS , OR OMG  they came to my place of work and arrested me, are full of crap and are just trying to SCARE you, SEE MY THIRD NOTE Above, Fear factor.

Best thing to do in this case, especially with these people is TO IGNORE. Eventually when no one engages with them they will go away to torment someone else.

Hope this helps you all out.

    One who knows.

He called asking for my ex daughter in law.  When I told him she didn't live here and wasn't related to us, he started naming my family members (scarey!) and asking if he could talk to them, even my son in Texas.  I asked how he would know where she was, she left town, he called me a liar.  I violated my own foul language policy and told him what he could do and hung up.  Going to complain to the FTC if the government ever opens up again.

They keep calling asking for my ex daughter in law.  She is not here, has left town and we are not responsible for her debts.  The scary thing is they know all my family's names and this guy, James Simms, kept asking about them.  I told him my husband wasn't related to her either, then he asked after my son in Texas.  I asked how he would know where she was, Texas is a long ways away.  He said, "Well, Martha I think you are a liar!"  I said f*** you and hung up on him.  I owe no debt, yeah the ex dil probably does, but they are illegally harassing me and my family for her debt.  Never signed any of her loans, thank goodness-too smart for that!  As soon as the government opens up again I will be reporting them.

Caller called today stating that they were serving paperwork to me. I told them that I know it is a scam and I will call someone. They called back and assured me that it was a scam. I told them that I have a brother - in - law who is a magistrate and that I know this is a scam. They stated they were going to be at my house today between 2 - 3 because I was rude and insulted their intelligence. Nice huh! Merry Christmas to them too!

I had this company calling my sisters and mom telling them that they were at my house to serve me a warrant and that I was going to need bail money if they did help me out! I called and tried to send letters of cease and desist but were unclaimed certified mail! My attorney tried as well. I don't owe them any money they also called one of my sisters and claimed to be an FBI agent. I have filed reports with the FBI and State and County Attorney General! I did not hear from them for a year and a half and it started back up!

I got a call but did not answer my cell as I did not recognize the number.  They did not leave a VM.  I've read the comments here and the harrassment the posters have gone through is ridiculous.  You cannot go to jail for unpaid debt.  They prey on senior citizens, threaten them and scare them to death.  They are the nothing but low life scum!  NEVER give any information to people that you are unsure of, if they are legit they won't yell and curse and threaten you.

The number came in as 716 748 8700 but to call back at 866 315 2804 ext 309.-there is a case of check fraud tied to my name and ss# and myself or my legal council is to call her back. Funny thing is I haven't written a check since my husband was alive and that he has been deceased for many many years and there were never any bad checks. She gave the name of Kesha Morris. They keep calling my daughter's number also, I can just imagine who else they call. Funny thing is when my attorney calls them they call him a liar too. These people need to be stopped.Kesha did not give the name of her company.

Received a phone message on my cell phone from a lady named Angela leaving a message for a Theresa Butler, who stated that I needed to contact her within a timely manner or her client would assume that I did not want to cooperate and would release information to my employer.  She stated to reference file number 384260.  The call back number was 716-748-8062 which matched the number on my caller ID.  I called back and Angela stated she was with PRG.  I gave her the reference number and told her that I have never heard of Theresa Butler.  She stated that she would remove my number...we will see.
