- Nan replies to DanActually, it's also law that if one payment is made on an old and out of statute debt, the debt is reopened and becomes current debt again. So if they can scare people into making that initial payment on an old written-off debt, then they can legally continue to call the debtor and expect full repayment of that debt.

They would not keep calling with deceptive tactics to collect & they would not have thousands of phone numbers that they call from. It is trickery! Also the amount of debt can be made up, as they add thousands of dollars to a debt that you do not owe. As for monthly statements: forget about that! But the stupid people will pay them & so they get to stay in business & make $$$. Just ignore them! Block them & do not answer numbers you do not know! The computer robo calling does not have feelings so it will not give up. Educate yourself & know that you can get $1500.00 for each call from them. Simply get yourself a lawyer & go after them & let them see how it feels legally!

"If Portfolio Recovery Services was a REAL collection service, they would get an attorney to handle debts" Very few DC's get attorneys to actually handle debt. Attorneys are only hired when they intend to sue, it is to expensive otherwise. "They would not keep calling with deceptive tactics to collect & they would not have thousands of phone numbers that they call from. It is trickery! " They keep calling because people such as yourself do not assert your rights under the FDCPA. "Also the amount of debt can be made up, as they add thousands of dollars to a debt that you do not owe." Legally they cannot do that. Again if you asserted your rights under the FDCPA you would have known that. "Educate yourself & know that you can get $1500.00 for each call from them." You should take your own advice. You can only assert TCPA claims under certain circumstances, the TCPA base is $500 per call and you only get treble damages if a judge asys you do. the FDCPA does not specify a per violation amount but is a flat rate of $1000 with possible treble or actual damages. However a good lawyer should get an amount much higher than that.
For the sake of people coming here that don't know any better, please educate yourself before giving advice strewn with misinformation and myths.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
