- Tired replies to L22| 2 repliesI have had a Wells Farge credit card for 11 years never missed payments always over paid. My employer has suffered a slow down and I am commission only so my wallet took a hit. I answer the phone when they keep calling. I tell them are situation and they say they don't care just pay the money. Every time they call I would explain and every time they get meaner and meaner. The last call was that we need to pay our bill and stop being a deadbeat. The caller was very LOUD and rude about it. The rude call came the same day I called and asked for hardship assistance so that we could get caught up. I pay 207.00 a month and there version of assistance was they would raise the interest rate and lower my payment to 197.00 a month and it would be a 2 year agreement with the payment paying interest and fees and a small portion of the principal and after 2 years the payment will be adjusted up to start paying the principal. I asked how this was a help for our situation and he said "I have given you your option, call us back when you will accept it" He then hung up. 45 minutes later the phone rings my wife answers it and there is a gentleman on the line from Well Fargo he immediatly starts yelling at my wife that we need to make a payment NOW and give him the information so he can pull it from our account. SHE HUNG UP. Now as of this morning my home phone and cell phone (They have both numbers) is ringing every 40 minutes and caller ID shows their 800 number. So talking to them and explaining is not enough with these people so calling us idiots only shows your lack of intelligence when dealing with a money hungry giant. If you think you can negotiate with them I will gladly let your know it all self handle this for me.

I had my mortgage, visa, student loans, 401K, kids savings accounts, business checking, main checking, even my HSA account with them. I couldn't believe how unprofessional and rude they were in trying to collect on one of my accounts that wasn't even two weeks late. (And contrary to the other poster, I am working! sometimes 80 hrs a week and earning good money... but sometimes the best laid plans just don't pan out.) During this crazy economic downturn, my 401K has dropped in half and my mortgage went up.... could I have done better planning - absolutely! and am now doing everything I can to 'not be a slave to the lender', which is exactly what has happened to us. There is good news though! You can send them a letter, via certified USPS, and in the letter specifically instruct them to no longer call you. They need to send all communications to you via USPS. You recognize the amount due is your responsibility and are doing your best to meet the terms of the repayments. In the same letter, you should ask them (again in writing) to 1)lower your interest rate, 2)waive any late fees and/or penalities, and 3)extend the repayment over a longer period of time (lowering your payments). They very likely will not honor your request, but you now have it documented that you did everything you could to work with this creditor. I like to throw into the letter that creditors that are willing to assist us will be the first creditors that will receive any extra money available :-) (If you watched the news this morning, Citi is working with clients who have a documented history of requesting assistance (see full news story for more details) and they've encouraged other lenders to follow suit.) Then mail in the letter to both the address where you make your payment AND to the address identified for correspondence. The next time that they call, you can tell them that letter was sent/rec'vd and they are not to call you. If they continue, you will take action. Gotcha - you have to read your mail and be sure to follow-up with any communications they send to you via usps :-). Bless you "Tired". We'll all get through this tough time. Hang in there!!
- M replies to colette| 8 repliesNot true about the Fair Debt Collection Practices Act. It has not changed. It is still a violation to knowingly and repeatedly call any number more than one time per day for the purpose of collecting a debt. Wells Fargo has an auto dialer that will call, hang up when answered, and call back, then wait ten minutes and repeat. I have phone records showing they call my pre-paid cell phone up to 60 times a day beginning when my account is two days after the duedate. I get paid every other week and they bill me monthly. Two months a year, I pay about five days late, and their action is harassment and could be prosecuted if I wanted to pursue it. If someone ever starts a class action suit - include me in! The deep pockets should pay for their crimes.

Why do you think the FDCP was established? It is because even though people become past due on their bills, they still have rights and the right to not be harassed by creditors is one of them. Instead of telling people who have been laid off and can't pay because their unemployment check barely covers rent and electric to grow up and pay their bills, perhaps you could become educated about the laws. What goes around comes around... learning a little compassion toward others might help you in the future. Nobody is immune from financial distress. Sometimes people's problems are not caused themselves.

- KR replies to MI definetely would like to be included in any future law suit. I have two car payments with them. They call about 30 times a day!!! I am doing all that I can to pay my bills. I am now working 11 less hours per week at work!!! I call them every month to give them the date I will make my payment, but this is still not good enough. I was told my payment enters collection after the 3rd day. They will only allow you to make an online payment ten days out, which I still do. However, they still call you continually after you have done this asking for your confirmation number, date, and amount. Last month, I gave out the confirmation number 12 times. I gave up and just stopped answering the phone. If you are considering any loan for any reason, do not use Wells Fargo as your lender.

- RAB replies to L22Others have commented on this and you are WRONG! They will still call even if you do explain your situation. I have 2 accounts with them and have these accounts for 6 years - never been late, but with the economic downturn and Wells Fargo raising their interst rates to make up for the bad mortgages from other banks they've bought, it has caught up to me. I did ask them to work with me and take my interest rates back down to what they were and was told they could do nothing to help me. So - I elected to sign up in a debt management program and when they called the first 20 times I explained to them my situation as well as the conversation I had with them 3 months prior about lowering my interest rates back to what they were and I was told they will continue to call no matter what. So - I'm affraid even if you are attempting to do right by them, they will still call. Just don't answer and keep track of the calls. They are terrible and rude people - what they don't remember is that those are the people who HAD been making their payments on time until they decided to make a bad business decision. Those of us who were good customers are now paying for it.
