- Steve replies to MrsMIt's 1995. I've been working in IT for 15 years and literally worked myself out of a job, and unlike before, no "networking" found me a new job. So I hit the pavement. No degree. 15 years experience and outstanding references aren't good enough. "Go back to school and get your Associates degree, and then you'll qualify for a job." So I did. I got it in 6 months, having tested through most courses due to experience. "Sorry, Associate Degrees aren't good enough. Get a Bachelor's degree." So I did - 2 years and nearly $30,000 in loans. Graduated with High Honors. Job? No. "Bachelor's degrees aren't enough any more. Get a Masters!" "Sorry, you don't qualify for enough financial assistance."
This is back when student loans were not excluded from bankruptcy. I could have declared then, but I didn't. Over the next decade, I paid back everything I could, building my own income in payphones. Then they changed the law so I can't go bankrupt. "That's okay," I thought, because I was still paying... $30,000 and still counting, with an outstanding balance nearly $20,000.
Then Obama expanded "Lifeline" to cell phones, and through rampant fraud and abuse, Obamaphones have wiped out the struggling payphone industry.
Now I was forced into bankruptcy. No job, no income, and despite still looking for work, no one even cared that I had those d***ed degrees.
Congratulate me! I'm now earning almost $8 per hour - the same thing I earned in 1982. Now 50 years old with a family to pay for. After what the banks did to me by raising interest rates on my business credit cards despite never missing a payment, I couldn't care less about them ever receiving one more dime - even if I had a dime to send them...
BTW, with the new "rights" that the Feds have grabbed - you know, the right to tell me what I must buy by "taxing" me if I don't do it - the US is no longer the land of the free.
I left. And, I'm much happier now. I am truly free of all the s**t the US Federal Government is doing to Americans. I'm out of reach. And that $8/hr? That's good money here!

Your student loans are still with the government and that you pay them directly. These people are fishing to get control of your account so that they can attach their fees to them so you end up paying more.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

They would have to sue you in court first to be able to take your taxes or garnish your wages but they deffantly can and will sue you for unpaid loans.
