    Original creditors ARE bound by the Fair Debt Collection Practices Act (FDCPA).  Certain parts of the FDCPA might not make sense to apply to them because they are the original creditor, but they are still required to use collection practices that have been deemed as being fair to the consumer by this law.

    Sorry, but the FDCPA specifically does not include original creditors.  It covers 3rd party debt collectors and does not in any way, shape, or form regulate anything an original creditor does as far as collection activity.  That would be regulated on a state level and there are only 5 states that do that.  I would suggest that you actually read the law before trying to interpret it.  Here:

    When you get that PDF copy, you'd best study how "creditor" and "debt collector" are defined in §1692a(4) and (6). You can take a strong hint from §1692a(6)(A) that the OC is not a statutory "debt collector". The Act has existed for four decades and those definitions are the simplest part to comprehend. There is no excuse for goofy misreading.

    If you study the exceptions in each paragraph, you'll see the only two ways to bend the "creditor" definition. (Sorry, BigA) First is if a lender "receives an assignment or transfer" of defaulted debt to collect for some other company. Must be a rare event, since I've never seen discussion or complaints of such an arrangement. Otherwise, the OC collecting its own accounts can lose its FDCPA exemption if found using a false name. That too doesn't happen often, though I think American Express is now mixed into a class action for how it seems to collude with its favorite collection agencies and confuse people as to which company is running the show.

    One day I must discover the parallel universe where some of you scholars get your "wishful thinking" versions of our consumer laws. I'd like to relocate to that regulatory Eden when I've had my fill of busting frauds here.

    Called back as the bank name did sound familiar - they wanted my name and phone number so hung up and blocked number.

    It's Comenity Bank. Not a scam. They manage a lot of merchant credit cards like Lane Bryant, Ulta credit card, etc. If you call back they look up the account. I didn't want to give her my info and she was very nice and said to call the number on the back of my card then so I could be sure I was reaching the right company. I had a payment that went past due (my card was never sent so I couldn't register online payments)

    Keep in mind, just because a number MIGHT be legit, doesn't mean the caller is!

    Scammers spoof legitimate numbers to trick people into a false sense of security to answer their calls and attempt to get money or personal information from you.
    This is why no one will encourage others to report of legitimate numbers, as they only confuse people into believing it is a legit call when a scammer has called them and they come here to find out about the call.

    People who get legitimate calls would know its legitimate and have no reason to come looking up the number.
    800notes is about exposing scammers, shady businesses and harassing type calls from debt collections, surveys, political and telemarketers or anyone who scams, lies or cons people.
    People come to share those experiences to help each other understand who is bothering them and share what information they can to help point a finger at those criminals. The data is useful in knowing the frequency of the calls and even allow someone enough info to research towards getting a company's background history towards legal action.

    The idea is to stop criminal callers, but posting about legitimate calls will not help anyone stop them. Sure people want to know who called and it could have been a legitimate call, but it only takes one post with confirmation of who the legitimate owner is to establish if its a call you can decide was legitimate for you. The fact that scammers can spoof ANY number is enough to say that even legitimate numbers have scammers who call pretending to be legitimate, so you just don't really know who is calling.

    Shills will come here to post about the number being "legit" and try convincing people to answer the call so they can scam you.  So why help the criminals by posting about your call being legitimate? It has no impact on a legitimate business, only the shady ones and thats what we want to expose. Your legitimate post will only add confusion for others who read posts by those who shill about using the numbers they spoof.

    Comenity Capital bank is a legitimate issuer of several store credit cards, though the name didn't ring a bell for me until I checked my cards.  I do have 2 cards from this bank, so for me it was a legitimate call.  You might want to check your wallet before you decide it's a scam.  And in fact I had missed a payment!

    Scammers spoof legitimate numbers all the time. The smart thing to do when one gets a call such as this is to hang up and call a known number for them, such as on the back of one's card. Never give a random caller personal information.

    Like x100.  I have had legitimate calls from unfamiliar numbers related to companies I do business with where a dozen people post "SCAM!" because they're using the deductive reasoning of a field mouse.  I always post my general rule of thumb:  If it's legit, they are a company you deal with calling with your personal info already about an issue you're aware of or can easily confirm.  If not, then it's likely a scammer spoofing a number, legitimate or otherwise.  Use caution.

    In this case, I just got a voicemail from this number on my landline.  After reading through the posts here, I am now aware that whether or not my caller is calling from a *legitimate* company is moot since I don't have any store credit cards.  I can ignore their message with confidence.  Going even further, I was part of a class action lawsuit once because of receiving robocalls from a company regarding billing issues.  If you do have a card associated with this *bank* and have been receiving these robocalls about your statement (whether legit or in error), you may want to consult a legal professional in your area to find out if you have a case.
