just to pretend they are working when the boss walks by...

This company calls several times a day for past couple of months. Must use a predictive dialer system as nobody is usually on phone when we answer. Today I spoke to a man with a Jamaican type accent who was very rude and unprofessional when I questioned him about his company. Said he was with a company named American Debt Arbitration. When I asked him more about his company he said he was calling to help me and could tell I was an ungrateful person and must have gotten bit by a bug today. I told him he was behaving rudely for somebody who phoned my home asking for business. Then he told me to s*ck my mothers d*ck and hung up on me. I tried calling him back but recording said office hours are 10AM to 10PM EST.  It is now only 3:00PM EST.

They have been calling my house several times.  There is no answer when I pick up. I tried calling back the number but get a message : call back between normal business hours of 10am to 10pm. I called ten times after 1pm and got the same message. What is this garbage? At first I got scared thinking it was a collection agency. Good thing I found these posts.

I received a call from American Debt Arbitration today at around 2 pm.  When I answered, the woman on the line asked for my husband by name.  I replied, "He's not available right now.  May I take a message?"

ADA Rep:  "Is his wife available?"
Me:  "Yes, I am *my name*"
ADA:  I am calling with American Debt Arbitration.  We received information from one of the three credit reporting agencies that you have more than $5,000 in debt.  Is this correct?"
    Me:  "Yes."
ADA:  Goes into a spiel about how they can help with unsecured debt and minimize our payments.  "All I need from you is the names of your creditors and the amounts you owe."
Me:  "I am not comfortable doing this over the phone, but if you have some information you can send me via mail I would be happy to look over it and consider it."
ADA:  "You're not having to do anything over the phone..."
Me:  "I'd be happy to look at something if you would like to mail it to me.  Otherwise, I'd like to be removed from your calling list."
ADA: (getting a rude tone) "Do you know how to use the internet?"
Me:  "Please remove me from your..."
    (she interrupts me)
ADA:  "Don't you know how to use the internet?" (still using rude, snotty tone)
Me:  "I want to be removed from your calling list.  I do not like your attitude."
ADA:  (very snotty tone) "I don't like YOUR attitude."
Me:  "May I please speak with your supervisor?"

    ---Silence----

The ADA rep hung up.  I called back, using the number listed on my caller ID in hopes of confirming removal from the calling list.  I received the same message others have, "call back during normal business hours".

This is the first call I have received from ADA, to my knowledge, and I am hoping and assuming they will not continue to bother me.

I hopped online and did a little internet search and discovered complaints from customers who used ADA.  Apparently, ADA accepted money (presumably to pay the negotiated-down debts) but did not pay on anything, therefore the ADA customer continued to get calls from bill collectors (and was instructed by ADA not to answer them).

Our credit score is good and we are not behind on any credit payments.  I would be very interesting in knowing how ADA obtained our phone number/name.

    Just an update...

I called ADA at 1-800-310-9317 and after a long wait, I spoke to a very kind representative who confirmed my name and phone number.  She asked me if I had spoken to someone from ADA and I said, "Yes."  She asked if I got the name of the person I spoke with, and I told her the lady did not give me her name, but she was HORRIBLE.

The rep I spoke to this time was very apologetic for that and told me she would get me removed from the system.

    Time will tell!

Sorry, everyone, I'm on a mission here.  I located a Desist and Refrain order from the State of California Business, Transportation and Housing Agency, Department of Corporations directed at ADA (and other sham corps).

"American Debt Arbitration, a fictitious business name owned by FGL Clearwater, Inc., is located at 12653 Pineforest Way East, Largo, Florida, which uses an Internet Web site, adatoday.com and a toll free telephone number 1-(800) 310-9317 to solicit consumers in California.  It describes itself as a debt services marketing company that employs qualified debt consultants and markets a program, which is co-managed with Nationwide Asset Services, Inc. FGL Clearwater, Inc. dba American Debt Arbitration and Nationwide Asset Services, Inc. operate in connection with several affiliated companies described below."

    ...

"The Internet Web sites for FGL Clearwater, Inc. dba American Debt Arbitration and
Universal Nationwide, LLC dba Universal Debt Reduction, which are almost identical in appearance and content, represent to consumers that “[o]ur program is a hands-on solution that will help you:

    • Cut the time frame to repay your debts from 15-30 years
to an average of 30-36 months
    • Save up to 50% or more of your current debt total
    • Stop throwing money away on interest and fees
    • Protect your rights under the Fair Debt Collection Practices Act”

The above entities represent that their services include negotiating with a consumer’s creditors to settle debts for less than the total amount that consumer’s creditors claim is owed.
The above-named entities, individuals or others, acting in concert or in participation with them, receive sums of money from a consumer for the purpose of negotiating settlement or payment plans for consumers and/or paying a consumer's creditors. Specifically, these entities pay the bills of a consumer from the funds a consumer forwards to them for that purpose, by arranging for periodic electronic funds transferred through the Automated Clearing House (ACH), whereby they initiate withdrawals from a consumer's trust account(s) for payment to a consumer's creditors.
    11. To start the settlement process and in exchange for these services consumers are charged and required to pay to the above-named entities “set up fees,” “enrollment fees,” monthly administrative fees of $49, a “CFG Maintenance Fees” of $7.20 per month and “ACH/Electronic Check Fees” of $.45 per check. The consumer must also pay settlement fees of 29% of the amount consumers are “saved,” which gives them “an incentive to achieve the best settlements possible.”

Essentially, the desist and refrain order explains that ADA is operating illegally in CA by functioning as an unauthorized prorater, in open violation of the California Financial Code.

Definitely not a sign of an upstanding company.  I am not sure of the legality of ADA soliciting business in Texas, but intend to find out.

This is the url for the desist and refrain order pdf if anyone is interested in reading it:

    http://www.corp.ca.gov/ENF/pdf/2005/Nationwide.pdf

FWIW, I also came across some expired job listings for ADA.  The callers make $10 - $30, based entirely on commission.

American Debt Arbitration is a debt settlement company in Clearwater Fl.  They purchased your name and number long ago, and continue to call, because they spent money to get you name and number.  They want to enroll you in their debt settlement program.

On Oct. 15th, 08, they were bought up on charges of violation Floridas chapter 501 business codes and are facing up to 40 violations I think, at least one of which is violating telemarketing laws.

If you want to help the state of Fl. stop the spread of these probabley illegal tactics, and want to add your name to the list of complaints already lodged against this company contact the Attorney General of Florida bill McCullums office and add your complaint.  For more detailed information type American debt arbitration attorney general of Florida.

A most unfortunate time with all that is happening during these economic times, that potential predators, have your phone number, and will go the lengths of calling it ,,,,,,,,,,over and over to victimize you, potentially of course.  If this angers you, complain to Bill McCullum, Attorney General of Florida.  I'm sure he would love to hear from you.

the company that keep making these calls is a debt consolidation company. So they say ,they want you to give your social security# and 50$ to start your paper work. Then they promise to get your debt dropped by 40-70% instantly just stop paying right now ha ha.then make arrangements to pay $400 a month for just 3.5-4 years in which the first 3 payments goes directly to them.So basically by answering this call it could really cost you if you fall for this scamming company

first...this program isnt a scam. we have been around for 5yrs and currently have 40k or more in our program. I myself have worked there 5 yrs. the fees you are referring to, are all apart of the range payoff that was explained to you on the saving analysis that the person went over with you. with ALL the fees in that range, it is FAR less than you would pay the creditors in one year with interest. (this I know for a fact). If anyone is called by us and it is their job that we're calling or a wrong number if you call us and give us the number we dialed we will gladly take it out of the system..we're here to help.. not harrass. unfortunely,  unless they are on our screen when they tell us not to call or give us the number, we have no idea what the number is to take out- hope this helps you......

I know that your business is unethical by the way it conducts business. If anyone requests you to remove them fron your call list you are required to do so by state and federal law. Simply because you portray thiss company  as being helpful, does not make it so. The fact is if people wanted to use your service, they would, there would be no need for you to attempt to solicit business. This practice in itself is questionable. DO NOT give personal information to anyone who calls you on the phone. Make them verify who they are. Toll free number doesn't validate anything. Why not put your conmpanies name on the number if this business is to be of assistance?  It does appear that your company is facing a variety of state and federal violations.... It's all Public record. I do know if you call my office again,I personally will see the ceo in court.

If you are calling people on the do-not-call list (as you do) you are a scam, period. If you need to hide your company name on your caller ID (as you do) you are a scam. If you expect someone you call to give you ANY financial or identity information you are either a scam or totally ignorant of basic security practices and should in NO WAY be trusted with any such information. This is all BASIC stuff most people these days over 12 understand but obviously YOU do not. I think we are all quite tired of you people trying to convince us you only act like ID thieves but are really nice people if we would just give you a chance. Actions speak MUCH loader than words. Act like a company we can trust and maybe you will get some customers that are not mentally challenged. All your current activities are doing is upsetting the rest of us enough to start calling for capital punishment for telemarketers. If you and your kind do not get your act together you might just find you will have to move all your operations overseas till the laws change there as well. Don't believe me? We passed the do-not-call list laws because you would not act professionally. Keep by passing it and the outrage will force the telecoms and government to find a way to shut you down.

P.S. the next thing this company will do is start spoofing their caller ID to look like it is some random stranger calling you. As MANY of their sister companies are already doing. Contact your representatives NOW and demand number blocking on all phone service and outlawing of caller ID spoofing. If we are going to have spam on our phones we all must have access to spam filters as well.

Note I am starting to post the above message every time one of these idiots calls my house. I will find the number on here and add this message till all are hunted down and tossed in jail where they belong. I encourage anyone else reading this to do the same. We gave these guys a chance to do the right thing with the do-not-call list. It worked for awhile. This year  ID thieves and scammers discovered spoofing and others just ignore the list figuring the fines are just the cost of business. So now we need to start tossing EVERY employee of these companies in jail when they are caught. And catch them we will if spoofing is not an option. Spread the word.  If we can send someone to jail and confiscate their house for possessing 1 joint I think we should be able to pass a law to give these guys a few years behind bars.
