I get calls at 8:10 at night which is over the time limit - I am sure this is done as a plausible deniableity hooks so they cannot get sued.

Another ploy they use is ask for the wrong person so you will them call back.

I may be wrong but I thought is was against the law to use robots to harasses people. mmmm

Got a call from this # today.  Answering machine message must have cut off the begining of the automated message.  All my message said was "...Thank you, This is John Shapiro, I have been trying to reach you for some time, please press 9 to settle this matter immediatly.  If you fail to settle this further action may be taken"  I have never received a call from this # before so I'm not sure why they said they have been trying to reach me for some time.  Next time they call hopefully I'll be home to aswer it.  I hope they are not as dificult as everyone else says.

Before anyone gets tiffed, read my entire post.

Some debt collectors (Tier 1) are nice and willing to work with the consumer.  After all, everyone needs help at some point.  Usually, these collectors work for the original company that the consumer owes.  If they reached your number in error, they usually apologize and place you on the "Do Not Call" list.

Moving up, the next level of collectors (Tier 2) are generally working on contract from the original company.  They don't have the ability to give you options like the companies collection dept does, however they will refer you back to the company if you are sincere about payment.  These will generally stop calling if asked to be place on their "DNC" list, but at times they will continue until an official notification is filed with their company.

Further up, as I like to refer as the friggin' "drones of hell" (Tier 3) are usually on commission based calls with quotas and every collection account counts.. or they get fired.  These collectors don't care if you are the wrong person, they are assuming you are lying (regardless if you may be or not) and will collect one way or another.  At this level, at times, they don't have the debtors complete information due to the fragmentation of records after so many company transference (like making a copy of a photocopy..after so many times its harder to make out the information.  So, what information they can collect, they will use to rebuilt their fragmented file.  Even if it is the wrong information! A lot of these companies have a network of numbers in the US, but they aren't usually located within the states.  I have tracked one number to a Las Vegas hub, transferring out going calls from India.

So knowing your right usually won't work with these companies.  I suggest recording the number, collecting as much information as possible from the person calling (company, address, name of caller, etc.) and filing a complaint with the FCC.  ALL Companies contacting US based land lines are REQUIRED to follow FCC regulations.  I say land lines because debit collectors are not allowed to contact mobile phones or post office boxes.  All legitimate companies will give you their information if you ask for it.

So, finishing up, the debt collectors posting on this site are not entirely wrong.  Their company may have told them to collect at all costs, however legally that can't be accomplished.  The original company that the debit is owed to should file with the local court within the debtors county (or whatever is based in the contract) if they wish to collect anything.  After they contract or sell the debt to another agency, chances are greater than 98% that they debit will never be settled due to the companies lack of information about the client.

If a company called me, telling me I owed them money but they don't know the original crediting source, the original amount and have a copy of the original contract approved by me... it is considered fraud, and is enforced by law if the proper channels are taken.

Thier lawyer, Edwin Abrahamson and Associates, took me to court and lost. I had no attorney, they have to produse thee application and if they say online application - then they must produce that. They could only produce a print off of the credit card agreement - not signed or anything, a page made up saying I made payments, and  2 pages where 2 companies sold the lists of 5000 names. The judge wouldn't even let him question me and lecture the lawyer that if they want to proceed with these kinds of cases then they had better have the info they need. The thing is the card was supposely citibank , which very rarely gives women a card, and they tried telling me Citibank gave me a card by myself with no income and handicap with no job!! They wouold never listen. Both the attorneys and NCC would cuss, threaten, and calll neighbors until I told them all calls are being recorded and I would have neighbors notarized letters to FTC and would sue them. Then they waited 2 years (!) to sue. I won and I couldnt afford a lawyer. However if they take me back -I'll have a lawyer and countersuit for  $5000. plus attorneys fees. I'm done..

okay well these scumbags (and I use that description accurately) are now calling
my cell phone?  Who the hell ever gave them my cell phone number in the first place..
secondly, they are calling me by my maiden name.. I have been married over 8
years and havent used my maiden name in that length of time with out my
married name hyphenated...this, to me, tells me that these schmucks, if they
are calling to collect a debt are way past the statute of limitations.  I had someone
try collecting a debt that I knew I long paid off and they were still insisting money
was owed to them.  Looks like they purchased a bogus list of debt collecting
that is not accurate in any way shape or form.  I'm not answering this BS
and I will report their sorry [***].  Great thing to have moved, with an unlisted
number and it's really great that I can just shut the cell phone off.. cccccccyaaaaa
wouldnt want to be yaaaaaaaaaaaaaaaaa. ha ha ha,.. so stick your debt
collecting BS lies and scams up your sorry [***].  click... you're done.
