How does Commonwealth Financial Systems get away with the illegal activity and I do not owe them one single penny. They are nasty, rude, use fictitious names, etc. The State does not do enough to shut them down as they have been using these techniques for years. The fictitious names are Seth Shapiro and Joel Rothstein, same voice each time they call.

Really? The FCC will protect you? Their jurisdiction is quite limited here.
What you want is the FTC and its set of laws in the FDCPA, which grant private right of action. That means you don't just file complaints and wait all year for a rescue. You compile your evidence of abuse of your rights and then sue the offending collection agency into submission. If your case is strong enough, a good consumer lawyer will be able and pleased to extract his fees from the loser's hide.
State and federal laws also give you the simple means to shut up collectors who by their training refuse to believe you are not an alleged debtor and cannot help them. Start your homework and be safe.

They call third parties to alleged debtors all the time for permitted skip tracing purposes, or often pretending it's a trace to annoy and shame an intended target whose location is already known.
If you're not their intended target, you must tell them in writing. It's called a ''cease-comm'' for short, and it is best sent USPS Certified with a return card. Under federal law they must comply with your written notice. You may already be due some payback if you can prove abusive tactics or foul language was used in an effort to collect debt. You might get some legal traction from a harassing or annoying call pattern as well ... which you don't quite have unless you'd answered and had a discussion in late January.

Some have actually lost their jobs through layoffs and are having a difficult time finding another one in this economy! And there certainly is a statute of limitations on credit debt, the length of time depending on the state. Do some research before passing judgment, you brain-dead idiot. In my state, the statute of limitations is 4 years. There most certainly is a time limit for collections, especially to protect consumers from scum of the earth zombie debt collectors like yourself.

I did this and told the person who answered I was not Carol Smith told them to stop calling me. this has not resolved the problem. - brokesam replies to Frustrated PersonHave had hang up calls, recorded calls and abusive collectors. They even called my parents. Husband lost work due to health and have had a hard time even paying simplest of bills( car, insurance, elect, phone, child support, even buying food). They start in the morning and don't quit till night. At least 20 times a day. Sometimes 3 times in a row. I feel harassed.
