- BrendaHave received daily calls from this number this week, hubby answered the phone today, he got all upset by this female on the other end saying he owed over three hundred dollars on a Capitol One card, I hollered at him it was a scam and to hang up , he kept going off on this lady, she threatedend to sue him, he never let up, she finally told him she was going to hang up on him because he wouldn't shut up, I wont tell you what his last comment was but I am sure it embarrassed her.

The story is that I am admin that works at a building where I get at least 20 or more numbers that roll over to me if no one answers they number that this place is actually calling. So unfortunately, blocking this place is not even an option. So after 2 years of telling them that whoever they are looking for does not work here, now I just go along with it. :) I say I am that person. They start w/their spiel about what I owe and ask if I would like to set up a payment. I always say No, that I don't want to pay my outstanding bill, and that I don't care what they do. It's hilarious because the caller gets all angry and accuses me of charging up credit cards w/no intention of paying. And I Just agree w/them and tell them, Yes that's what I did, what are you gonna do about it. It's actually very entertaining and brings me some laughter to my otherwise dull day. :) Keep 'em coming guys.

- Robert replies to smel630Just talking to them doesn't reopen the debt. Admitting you owe it is another story or making payment arrangements will reopen the debt. Learn your states statute of limits and stick too it. Never ever admit the debt. Ask for a debt validation letter with all the supposed business contact info and contact the original business. 99.9% of the time they cannot produce everything that's needed.
- TammyThis is about the 3rd time in as many years that I got a call from these people for my now long-deceased father. He had a very common name and I think they just have the wrong John Smith (not his real name but just as common). A woman with a very soft voice (hardly could hear) said, "may I speak to John Smith and I said "no" he's not available. Then she asked what my relationship is to him and I said "he's my father." This woman launched into a series of questions about how I'd like to set up payment etc. I said "you need to talk to my father, not to me." I gave her his plot number in the veterans cemetery, wished her luck and hung up. I blocked the number but I see she's called back twice already.

- Kel| 2 repliesI was stupid last year and had a debt I owed, they used scare tactics etc, etc,. Called everyday starting at 8am til 9pm. Every hour on the hour and then every half hour. I got so sick of it I took my phone and unplugged it and put damn phone in the closet. Most mornings I am just falling asleep at 8am. Not to get personal but my 16yr daughter committed suicide 3yrs ago so sleep is something that doesn't come easily. Anyway I agreed to pay 66.00 a month for a year. I got a letter stating it was paid in full and they informed all the credit reporting agencies that I paid the debt. My last payment was in May and all of a sudden they are calling again!?? I haven't answered and don't plan on it. What sucks is they are still calling the house phone and now my cell phone. I guess they assume since I paid off that one debt I can afford to pay another. Not this time, I fell for the scare tactics before and can't afford to pay them again. Believe me, I've always paid my bills but now I'm on a fixed income. I'm on disability, which I never thought I would be on at this age. (45). I've always worked. I had 3 children to raise. Now they are grown up but it still not easy on what I get a month. I agreed to one company to pay 1 dollar a month just to make the calls stop. Bankruptcy is an option but how can you pay an attorney when you are broke to begin with. Anyway, sorry for venting. I'm just in shock that they are calling again after I paid that one bill off. One more thing, if anyone knows, how many times are these debt collectors allowed to call?? I'm not kidding when I said they start at 8am til 9pm everyday. Sometimes every half hour. To anyone that read this whole post I appreciate it. Oh, one more question if anyone may know. Can they garnish my disability check? That was one of the things they told me when I agreed to pay that 66.00 a month for a year. I receive 745.00 a month. Period. I don't receive any other benefits. Just Medicare. I don't get food stamps or anything else. So I have to watch every penny I spend. If I had known I would have become disabled I would have never gotten a credit card from anyone. PFR are about the cruelest, non emotional people I have ever had the displeasure of having to deal with. Their tactics unfortunately worked on me in the past, but not this time. Anyway, sorry for going on and on, I'm just so frustrated that this crap is starting up again. My cell phone was the 1 number they never had and now they do and I can't block every number they call from. Thanks again for anyone that was able to put up with my venting. Any advice would be appreciated. All I can do is ignore their calls or answer it and flat out tell them there is no way I can make anymore payments. I've got enough medical bills I'm trying to work out. Like I said I've always been responsible and paid my bills but never thought I would have to stop working due to disabilities. If I known the future I would have never accepted any credit card from anyone. Ok, I'll stop venting now, thanks again for listening. This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]
* Debt collectors may NOT
- repeatedly use the phone to annoy someone.
- falsely claim that they are attorneys or government representatives
- falsely claim that you have committed a crime
- falsely represent that they operate or work for a credit reporting company
- say you will be arrested if you don’t pay your debt
- say they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
- communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
- say that legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action
- use a false company name
- take or threaten to take your property unless it can be done legally;
The debt collector may not garnish your wages unless there is a court order to do so.
+ Many Federal benefits (including Social Security Benefits) are exempt from garnishment
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,
Report any problems you have with a debt collector to your state Attorney General’s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

I suffer from OCD and anxiety and when the phone calls started up again from PFR it raised the bar quite high on the anxiety and panic to where I worry myself sick. But after reading your reply and information you gave me it helped calm me down. Everything you said made sense. If I knew then what I know now I would have never agreed to a payment plan or even spoke to them and believed their threats when they started calling the first time around. I won't fall for it again. Thank you again for the time you spent posting the information and advice for me. I'm sure it will also help others that are going through the same thing. Take care.
