- Lola replies to BigA| 1 replyThank you for all of this detailed info. They had been texting me and my children the exact same, Thomas Hughes, mediation message and then I stupidly answered the phone the other evening.
They told me that my husband and I owed them (via the original creditor) over $19k and that they were in the process of getting paperwork filed to freeze all bank accounts that our SSN were affiliated with. I was told that a settlement letter was mailed to us in 2019 for the amount of $5K but we missed the deadline. she graciously offered to go back to the settlement dept and ask if they would be willing to accept the 2019 settlement amount since we were voluntarily willing to pay it and it wasn't a forceful recovery. She also told me that I could negotiate the offer with them. I was so panicked and freaking out about our bank accounts being frozen that I told her $3200. She came back and told me that they would accept $3300.00 but I had to pay it that night. While she was "checking" to see if they would accept our voluntary pay, I started googling everything that I could about the company, URS, United Recovery Solutions, statute of limitations on debt, debt scavengers, etc.
When she returned I had asked her for a copy of the judgement that they received from the court against my husband and I, stating that we were found to be responsible for this debt. She told me that they didn't have that nor did they did a judgement; that a judgement was only needed if they were doing a wage garnishment. She said that there was a form that was sent out a week prior to be signed by the courts granting them access to our bank accounts and any other assets. I am not sure how a "court" could grant access to someones assets, without first declaring that they due in fact owe the debt.
They were extremely kind to me and willing to "explain" all of the steps of "their" process to me. I told them that I couldn't sign any documents or pay any money until I spoke with my husband who was at work - they let me try and call him and then called me back. I told them I was unable to get a hold of him at that time. They informed me that he didn't have to sign off on the documents, that I could in his absence since we were both named on it and it was just to "pay it off". I told her that wasn't how our marriage worked. They then informed me that if I couldn't pay tonight that I could call back the next day and see if they would accept my settlement offer but more than likely it would go back up to the $5k amount, possibly more but definitely not the $3300. I told them that I understood and that my hands were tied and I'd call the next day.
I continued my research and read that there is a 10 year statute of limitations on written contracts in IL. This means, after a certain period of time (10 years) the collector isn't permitted to seek payment from you through a lawsuit. Considering we were never served with court papers giving us the chance to appear in court to defend the validity of this debt and there was never a judgement, default or otherwise made against us, and this alleged debt is 12+ years old, this agency cannot threaten to freeze our accounts. They are using the "freeze our accounts" as a scare tatic to get us to pay something on that debt and the moment we pay even one dollar on that debt, the statute of limitations refreshes and then they are able to take you to court to file a jusdgement against you.
This company preys on people by using scare tatics and a sense of urgency and they act very nice so you think, wow they are being so kind and compassionate, clearly they are just looking out for me. Ya right, nope. What debt collector is going to tell you that you can "negotiate" with their settlement dept and drops the due amount down from $19k to $3300? A scammy one.... URS United Recovery Solutions....Be warned, Be Aware, and do your research. - Ali replies to Lolamy daughter in law had a text with my old married name from 20 years ago and they ended up calling me and wanted me to pay or they'd freeze all my accounts with my social # associated. I of course freaked out too but then have realized its a scam, but yes they have all your info and mine was for a debt that isnt on my credit report and a debt that was taken out in 2013, way past the statue of limitations! thanks for sharing your story!

- BigA replies to Advocate2Kentucky has a 15 year SOL on debt from 2014 and earlier. I have to wonder though why you stopped by to give advice to someone who posted here a year ago when you did not get a call from this number?
