I kept them on then phone with that constant message ( This calling had been going on for days) FINALLY someone said Hello... NO Hi this is whatever company.. I said you called... They asked for a name i had never heard of .. I asked them to STOP calling!v they said OOHH oops.... Yes, that is such an important answer... GRR- Caller: Never gave a name

It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

After all, anytime someone makes a statement of fact such as yours they should be able to back it up with the proof.

- Buffy Weinerbaum replies to BigA| 3 repliesI note the previous poster didn't reply, so I'll do it for them. Companies such as this buy old debts well past the statute of limitations. You may still owe the debt, but it is no longer collectible, you can no longer be sued for it. It is not actionable. The time to do so has passed. BUT if they can get you to admit to the debt, acknowledge it's yours, make any sort of payment arrangement, etc in most states the statute of limitations starts over and they can then sue you to get the money. Not sure exactly which proof you would like. The statute of limitations varies by state, and often by the type of debt as well, so quoting all the applicable laws would be quite a task. Try Googling "debt statute of limitations (your state) and you should find all the proof you'd like.

Unless you live in Wisconsin or Mississippi, an attempt to collect the debt can still proceed past the SOL. They simply can't sue you for it anymore. Admitting or acknowledging the debt does not reset SOL. A payment does. If you make a payment then the SOL resets and then they can sue you. But not simply because you said "yes that is my debt". "The statute of limitations varies by state, and often by the type of debt as well, so quoting all the applicable laws would be quite a task. " Actually it is quite easy. But whenever someone makes a statement of fact they should know that they will be questioned and should have the source available to cite. Most people such as yourself come here and don't do that, spouting myths that they learned from somewhere and half truths.
