Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

A few months ago I got a call while at a friends house. I stepped away and was took the call. A man named David claimed he was from the law office representing Chase bank. And he was informing me that I was in the process of being being sued by them but as a former employee he was asked to call as an extended courtesy to try to resolve the issue prior to court. Long story short. I was paying them. Every damn month on time because I have been trying to clean up my credit. I just got the bill in the mail today and noticed not a penny of what I was paying was applied. Now I have to file charges against them and sue them. Fml.
