- john| 2 repliesbeen receiving calls from these [***] for a yr now. im flat broke and can barely pay for a roof over my head, and these [***] want payment from me? im not giving them half a penny. bunch of bottom feeders. they keep sending me threatening messages such as contacting my employer and sending me to court. they didn't, it was another empty threat. even if they tried to send me to court, theres nothing they can collect from me. im dead broke. no house, no mortgage, no car, barely anything in my bank account, i have NOTHING. so they are not stupid, they wont take you to court unless they know they could get something from you. if you have nothing, you have nothing to lose, and nothing to fear from these [***]
- Caller: FDR

- sosothese people can't do anything to you in court or anywhere else. if a company wanted to sue you for what you may owe them they would have done so.These agencies buy these dead collection notes and try to collect on a recovery fee basis. I have had this fdr co. calling me for two years or better. I just ignore them.

- Caller: Unknown(couldn't understand it)
- Tamianth replies to LizaThere's lots of extortion scams going on right now, tread carefully and know your rights. Demand a address from them, and demand they send you proof via US mail. A phone company, email or fax is not proof!

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

Bills.com FDCPA FAQ
Below are questions Bills.com readers ask frequently:
Can a Collection Agent Call My Cell Phone?
Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.
I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.
A Collector Says I Will Be Arrested if I Do Not Pay
This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt. - ilco| 1 replythese are debt collectors who have purchased your debt from the original party and have doubled if not tripled the amount owing. Do not be intimidated by them, after 3 to 4 months negotiations they will accept an offer, start at ten cents on the dollar, while in negotiations it is illegal for any creditor to commence any legal action, these people are the scum of the earth...do not provide social insurance numbers, or any personal info, the purchased a debt and cannot make any negotiations or repair to your credit, they are just looking for the most money because they are on commission
- Call type: Debt collector
- Sir Bedevere replies to ilcoDO NOT negotiate with them. Do not admit any debt at all. Get WRITTEN validation of the debt (as required by law) before anything else. They have to prove not only that you owe the money but that THEY are the ones you owe it to. Only at that point – provided the debt is within the statute of limitations for where you live – do you consider paying anything.
- LeeThis number has been calling my house once a day and today they left a message stating that I had to call them back Friday morning by 9:55 a.m or they will take legal action. I know I have no outstanding debts so I wanted to see if anyone else was having this happen to them and I'm glad I checked. They are rude and I will not be calling them back!
- Call type: Debt collector
- Dave from TorontoBeen getting these calls for a few weeks now. Same call every day, approx the same time. Start by claiming it's not a sales call, telling me "I have options" but need to call them by 9:55am tomorrow. They identify themselves in a pre-recorded message (always pre-recorded even if I answer or the machine does) as "FDR", with this callback number and a "file number" to quote when I call back. They don't ask for me by name.
All my debt is current, so I'm thinking of calling them to yell. Will follow up here if I do.- Caller: fdr

- Smarter than the average bearSame call looking for my son who does not live with us. They said they had a job opportunity for him. Knew it was bogus immediately because no particulars left and he moved 7 years ago.

- Steve GummoBe careful about making even the smallest payment on something you think is an old debt because it will open up a whole new can of worms and you'll be very sorry you did.These companies resort to these tactics of threatening because they do not have a leg to stand on. Don't take the bait!! A payment is somehow an admission of owing and the ability to pay that they will use against you to overcome the "statute of limitations". You may have owed someone in the past, but this is a scam to get you to admit that.
- SherryThey just tried calling me too. FYI: If the debt they bought was/is over 7 years old, and it's not been collected on yet, they can not collect it either, UNLESS YOU ACKNOWLEDGE HAVING OWED THE DEBT. If you just ignore them, and tell them you know nothing of the debt, they will go away. Oftentimes, the debts that are being collected on by these bottom feeding companies, are debts that you in fact have already paid. However, like one poster said, you don't keep records from 10 years ago. So if you say you THINK you remember something about it, BANG they got you. You'll end up paying these debts twofold.
They tried that with my son, till I wrote them a scathing letter telling them that the supposed debt they were aggressively attacking him for, based on THEIR information, was incurred while he was in a coma from a brain injury. They make stuff up as they go along.
So ignore the calls. They are crooks and scammers.- Caller: Financial Debt Recovery

- Pissed offThey have called me 3-4 times a day leaving threatening messages. I talked to them three years ago and they told me it was regarding a bad debt from 2000 !!!! They said Wells Fargo bought Trans Canada Credit. I told them to get lost years ago and they still call multiple times a day even though they can't do a thing as it is wayyyyy past limitation. They have two years to sue you from the date the debt is registered. If anyone is worried about being sued I work at a law firm and sue people every day. If you are being sued a process server will show up at your door to personal give you ANY legal documents. If that doesn't happen don't worry about it. This is just highly annoying......
