- BarryGot a call from this # and believe it to be a scam. They mentioned a court document but not much else.
- Bob replies to staceyStacy, I would suggest that you check the Statute of Limitations for your state on credit cards.
In most states, it is from 5 to 10 years. I'd be willing to bet that even if the debt did exist, it is out of SOL and is legally uncollectable. This guy is probably a 3rd party trying to collect on a Time barred debt that has been written off by the bank. Definately demand written and verifiable validation of this debt, from the original owner, and his legal right to claim and collect. Also, you are entitle to proof of any signed contract that may not exist, as well as a record of the dates of payments or transactions, and the date of the last and final payment or transaction on the alleged debt, and the Total amount of the CC as last held by the original owner.. (date of the last payment or transaction sets the clock on when the statute of limitation began)
What my guess is, is that he is a 3rd party zombie debt buyer who buys written off debt for pennies on the dollar and attempts to collect. It's legal to try to collect, as long as he doesn't violate ever law in the FDCPA, which his is doing. Dispute the debt and any claim that he makes to you in writing, by writing a certified/signature requested letter........ If it proves to be a debt that is Time Barred by your states SOL, he already will know that, but be sure and tell him that you dispute his claim and further more, regardless of any and all allegations, it is barred in your state by the SOL, and will be regarded and defended as such should a need aris. This tells them that you mean business and will immediately turn him away because he knows that his chance of collecting are minimized......Good luck... - should have paid them| 2 repliesi got a call read these comments did not pay them and they showed up to my mothers house with courts papers.....people pay your bill or they will send you to court
- Joan replies to should have paid themThis has been researched by many government agency's and this is a SCAM!!!!! if they show up at you Mothers house you need to go to court because they can't do anything to you. If you owe the bill and in most cases from what I read most of us do not owe these bills, if the original creditor takes you to court YES they can put a judgement on your credit however a third party can't, they use these as scare tactics and end up with a judgement that will last for about 10 years because your to afraid to show up in court. as stated in previous post most of these individuals are ex con's trying to make a dollar. When a credit card company or loan company files you as a P&L they take a write off on their taxes. I'm not saying that this is acceptable for someone to walk on their debt but there are times that a person needs a second chance and just has NO option. I hate to admit that I had to do this many years ago due to loss of emplyment, it was either save my house or pay a credit card, by time I could start paying agian my lawyer told me NO they are charged as P&L and if you pay one pennie the clock starts all over again. So if you did have a debt from years ago and its charged off it will fall off your credit in about 7 years but if in the 7th year you pay 1.00 the 7 years starts all over again. I felt so bad about what I had to do that I did some research on this and did you know that when someone comes to our country and opens a business they are tax free for 5 years, well in about the 3 - 4 year they will flip the business to a family member to avoid taxes. Again I'm not saying that this is acceptable to walk on you bills but sometimes you just can't avoid it. Funny in my case the bill that they chose is NOT one that I had to walk on it was paid in full, I even contacted the company to verify. Please read the previous posts form people trying to let you know what to do. The older the debt the ruder the collection agency becomes they are referred to as Junk Debt collectors you might try looking them up on line.
- MaggyI received a msg from a lady today that said I was going to be served a summons for court for monday. She gave me a number and a case #. I always look up numbers to check them out. Evidentally this is a scam. I am not dumb and know how things are handled and you are served by local agency for the court you live in if it is against you. Guess I need to check my credit and make sure no one is trying to do something. I am not calling, the other number because they might get you to say something that will give them the go ahead to do something in your name.

- BernadetteThese people keep calling me on my cell phone day and night as early as 7:00 a.m. and as late as 9:30 p.m. with threatening phone calls. They go under 2 different numbers 855-811-8259 and 213-260-9483. Today I had a message to be home on Monday 11/5 that they will be at my house to serve me a summons. I have no idea who these people are and they won't give out any more information. To me this is telephone harassment at its worst.
