All you are doing is asking them to provide you with proof from the original creditor that you do indeed owe the debt and (this is the important part) that they have the legal right to collect it. You have the added benefit that they must stop all communications with you until that provide that proof. This is why it is important to send it certified, return receipt so that you can prove they received it in case they continue to call your afterwards.
Unless you actually make a payment which is then considered recent activity, or you enter into a new contract to pay the debt, then the SOL will not be reset. - DCSThey do not care that they are breaking the laws. They will find people to pay them and make it worth their while, these scumbags always do. There is always someone willing to pay, or that doesn't know the laws. I am flooding the FCC with their Unwanted Caller Complaint Forms every time I get an unwanted call. We all should do this, however this administration cares not for protecting the consumers. Finding a consumer attorney is even harder it seems. Don't answer calls you don't know people, and use this site to look the numbers up. You can try sending the C & D letters, it may work, it may not. With all the data breaches, I think they are calling people they shouldn't be but they do not care. I block them then file complaints and keep the FCC emails I get in return for every complaint.

- BigA replies to Jh550| 4 repliesI never said that I sued Portfolio (I wish they would call me, because I would file in an instant). I accumulated all that information to help others. I assisted in finding a lawyer for my neighbor who sued a debt collector. He went and talked to the lawyer for about an hour. The lawyer filed the case. I took less than a year, before it settled out of court, maybe 6 or 7 months if I remember correctly. I think he got around $10,000 after the lawyer took his cut (he had maybe 2 to 3 hours of his time invested, so that was a pretty good per hour paycheck). Resident47 has sued several DC's as a pro se litigant and says he usually gets between $4,000 and $7,000 if I remember correctly.

- BigA replies to AnonymousDebt collectors are allowed to call per Federal Law (FDCPA) from 8 am to 9 pm your time any day of the week. Mother's Day is not even a Federal Holiday, just a day the merchants made up to cash in on sales, like Valentine's Day, Father's Day, etc. They have thousands of numbers, so I guess you should maybe get a bigger call blocker? Or you can read the other posts and learn how easy it is to not only stop them from calling but to make them pay you as well. Or you can do what you are doing and hope for the best. Your choice.
- Beth replies to JerJer512Also being harrassed by this "company" received a call Monday at 9:30 pm and when I informed the gentleman of what time it was his response was "I shouldn't be calling you this late". These people know they are in direct violation of laws so question is why are they still allowed to be in business? I have not received any written communication (which according to Big A I should have received within 5 days of first contact), have not been given any information on where debt originated and can not find anything on my credit report. Could you give me some guidance in terms of what your letter stated?
- Beth replies to BigA| 2 repliesI will reiterate...thank you for all your advice and guidance. It blows my mind that this company is still permitted to stay in operation. Without going into the same detail which is very similar to the other posts here I do need your expertise. I did not receive anything 5 days following the initial contact and continue to be called 2,3, sometimes 4 x a day including weekends and sometimes after 9:30. I am going to draft the validation letter but could use your help on what to say. Also, if Portfolio does not respond and continue to call, do I then send the cease and desist? If after that is done I still receive calls am I able to take it to an attorney and what if I do owe the debt but they can not or do not prove I do will an attorney still take my case?

I would definitely take out last sentence about a settlement offer though. Or you can draft your own letter. Simply tell them that you want them to validate the debt as per the FDCPA (15 U.S.C 1692g). Tell them that you expect the calls to stop until they do so and that you will not communicate with them in any fashion until they have gone back to the original creditor and provided the proof that you actually owe the debt. You can tell them to only communicate with you in writing, or you can specify what times they are allowed to call you. Resident47 does that a lot to catch them calling outside of those "convenient hours".
Once that letter is sent (the key is to send it certified, return receipt so that you can prove they got it), the calls have to stop. No other letters are required at that point. If they continue to harass you, then you simply sue them. An attorney will take your case because this is not about whether you owe or don't owe. This is about breaking the law.

Is your crappy organization at all familiar with the FDCPA laws and regulations?? No wonder you are getting sued.

- Kitterz replies to BigABTW, the court case in MI the plaintiffs lost that case. Michigan is primarily a pro debt-collector state. If you have debt, they have a right to pursue you within 8A-9PM every day (including holidays apparently).
- JillThis Number called me at all hours every single day. Calling 10 to 2o times, One right after the other, My call blocker says it is potentilal Fraud! Sick of them calling me.

I wish I could speak for everyone that visits this site, but great job for all this research and information. Sadly, I would bet that most of the people that can benefit from this info are probably too lethargic to act upon it. For those of us who will, my sincerest thanks. So Googled the number and listed different ways as "ping warning" and name prisccilla Williams ,Florence, S.C. and stated No searches yet, 0 .( 843) 773-7543.... (Was typed in different ways each time)!! NOTICED SYMBOL AT TOP OF MY CELLPHONE SCREEN.....2 UNKNOWN, Devices (w/out permission) was already connected my Hot Spot/Data. Blocked them,they got back in, Earlier that day had message show telling me I had too many devices connected,to remove to make room. Finally changed my device names and password.!! Then today something kept trying to download on a loop, quicker I'd delete, the faster it kept adding. I pay for unlimited Data each mth and am loosing phone call service, no service, apps stop running keep asking me to open again.
I disabled, uninstalled, deleted any history and what ever symbols I had seen..I tried!- Caller: +1 843 773- 7543 PINGED WARNING.
