    ok so this lovely company is my mortgage company!!!!  you get behind 2 days and they want to know your life history!!

    they called me today at work and my boss is aware of my problems and remember my payment was just due Friday, anyway, when they call me it is my acct manager which is Josh and he is completely rude wanting to know why I am behind and all this and startes getting really ugly, well my boss transfered them to Human resources with my company and my HR manager told him not to call and he said he would call when and where he wanted to and hung up on her, she proceeded to call them back and get very ugly with them.  Since that time this morning she has written a letter and the attorney for our company has contacted them as well!!!  Anyway he started asking me how much I made per pay check, and what I owed and who I owed it to.  he also demanded that I fax him copies of my bills and who and what I owe!  I proceeded to ask him for his supervisor and they both got on the phone and started bullying me!  I don't think it is any of there business for them to know what other bills I owe.  They proceeded to tell me that I have to call in every month when I get my bills and let them know how much they are and then let them know that I was faxing them the copies of them.  Does anybody know if there is anything that I can do about this?  I think this is wrong!  I am looking for different finance companies!

    and also they are calling my neighbors and giving out personal information.  telling them that we need to call them asap that we owe them money on our mortgage!

    I'm not even WITH these people and they call me at 8AM trying to get hold of my NEIGHBOR they claim. They've called me countless times over the last six months. I even click "answer" and then hang up, or let the machine get it. It doesn't matter. They just call back the next day or two.

    If you're NOT a "customer"/member of this mortgage company, you have civil and legal recourse. They call me, looking for "neighbors" of mine, though I'm not a member/customer and have nothing to do with it or any neighbors and even if I do know these neighbors, I have no obligation to this company.

    1 - when they call, tell them, don't ask, to be placed on their DO NOT CALL list. Tell them you will not repeat yourself and for them not to call you again, and you are noting it and have recorded your call, whether you are or not, but do make a note for your own purposes, and ask for the caller's name and any other information like ID or caller number etc. If you feel it necessary, demand to speak to a Supervisor at 21st Mortgage - Sandy was the one available at this time in my situation. Do not let the caller give you the run around, they're just working the phones for a paycheck and are not who you are concerned with.

    2 - File a report with the Better Business Bureau, whether or not they have removed you, if they called you more than twice, and you are otherwise unrelated to their issues. If possible make sure to let them call a couple of times and let your answering machine pick up so you have a vocal recording of their call and schpiel about looking for neighbors.

    3 - If they call you again more than seven days after you have told them to remove your number from their call lists, call and/or email the Knoxville Teleserv Division of the Knoxville Police Department/Chief of Police, which deals with 'telecrimes" including phone and computer issues such as this, and explain your situation, that you have told them the company to remove your number and they have refused to do so, since you have gotten more calls over a week since you gave them their chance, and ask the police to contact the company, and since you have the time period already established, you CAN possibly file a police report for harassment if you want.

    4 - You can also file a consumer complaint for the company's behavior with the Knoxville Financial Commission, which controls licensing for companies that deal with finance, including banks and mortgage companies, and tell them you've files reports on the company with the BBB and Police Department. If this company gets enough of this kind of backlash, they may decide it is time to rethink their strategies.

    Note: The police cannot get involved in conflicts between 21st Mortgage and actual "customers" unless the treatment is obviously abusive, harassing, threatening or otherwise beyond the scope of what you find in most debt-collectors, because it is a civil legal and financial matter, BUT if they are calling any of your neighbors or relatives to find you, you can have THEM file reports about this behavior, similar to the above, especially if the company is giving out any information about you.

    The Knoxville police sergeant said they told her they use "skip tracing", which is, unfortunately, legal, even though it can involve direct deception and misrepresenting who you are and why you're looking for someone. And it's just like it seems - they call the other people around the person's last known address, as well as their family members, if they can find them.

    If they own the home, ie you took a loan out through them or they acquired your loan from your original lender, then it is not trespassing.  Until your home loan is paid off, they own it and have every right to visit their property.  It sucks, but if you pay your bill on time then they wont have to come visit.

    This 865 number is for 21st Mortgage the #1 full service lender for Modular homes in the nation.  If you are getting calls from this number it means your phone number has been associated with an account for a mortgage they have.  21st is a fortune 500, Berkshire-Hathaway company owned by Warren Buffet.  21st Mortgage has strict policies for calling the people they have accounts for.  If you are a friend, neighbor or family member being called about a person, it most likely means they are way beyond their due date for their mortgage payment.  Loans are given 10 days beyond the due date to have the payment in before calls are made, and calls to people other than the loan holder are not made until the loan is extremely late.

    If you are receiving calls from 21st, it means someone you know put you as a contact on their loan application.  Or the calls are due to poor payment history and your delinquency to pay the account on time.   If you would like the calls to stop, ask them not to call and they will remove your number, or be responsible and pay your bills on time or ahead of time, and the lender won't find it necessary to call you everyday wondering if you plan to pay this month.  Also, if you are having trouble and can't make a payment for some reason, call the company before your payment is late.  21st Mortgage pays on average of $125,000-170,000 each month toward peoples mortgage payments for them. They are willing to work with you, if you first willing to help yourself.

    They have the mortgage, they do not own the home. Title belongs to the homeowner, not the lender, unless the lender goes through a foreclosure process to take possession. Holding the mortgage DOES NOT GIVE THEM THE RIGHT TO ENTER THE PROPERTY!

    You obviously don't know what you're talking about, so just go away until you learn.

    Actually, the title to the home does not belong to the home owner until they complete the payment of the loan.  If a person does not pay for their loan and the home goes into foreclosure, then the lender can repossess the home because they hold the title.  

    If the loan company takes the time and spends the money to visit a home it is because they are checking up on their investment.  They would not need to make a visit if the loan holder were keeping contact when unable to make payments on time.

    I agree!  I am so tired of people not wanting to take responsibility for their OWN faults.  If you are late, even just two days YOU ARE AT FAULT!  Do the right thing and take responsibility, and instead of threatening to sue the company for something that is your fault, why don't you try complying with them. If you do, they probably won't treat you like a child anymore.

    Put yourself in their shoes: how would you like to be a business owner and have several customers pay you late, and then they threaten to sue you because they are not responsible enough to pay their bills ON TIME?  As a business owner you have bills to pay as well, and if your customers don't pay their bills to you on time, then you will have pay for them. All you can do is either take action and pursue the customer for payment, or sit around and try to guess when and if they are going to pay you. Most Businesses don't have esp. and know that your ONLY going to be two days late.  From reading these emails it appears that several people are late on a regular basis.

    I have been with this company for awhile, and have NEVER had any problems with them, nor have they ever contacted me for anything. I am on the auto pay plan where they electronically take out my payment each month from my checking account. I would recommend this benefit to all you people who have trouble paying your bills on time.

    Being an elderly person I feel like I am scolding children, although I know that you all are suppose to be adults. If you are honest and always tell the truth, and take responsibility for your own actions, you might just grow and mature into adults.

    It may be more appropriate to reply to the specific post to which you are referring.  The point of this thread is to assist people who receive phone calls from this phone number when they shouldn't, or when the contents of these calls have bordered on illegal.  I have never had any dealings with this company and I continue to receive calls for an individual I've never heard of.

    I came here to avoid being the victim of identity theft or another scam.  

    That being said, creating an analogy to this company as a simple business owner is misleading.  This is a modern profit-driven corporation.  Some of these scenarios are serious enough that legal action is the only responsible thing to do, as legal action may be the only action that the company will respond to.  The idea that YOU'VE never had trouble and thus this company has good business practices is nothing more than a logical fallacy.  As is the idea that age begets wisdom, as you have proven.

    OMG!  I get calls from 21st Mortgage once a week or 10 times a week depending if I answer my telephone or call back.  I am one month late in payments and even though I give them a date of when I will make a payment, they will call me each week before that date and interrogate me each week.  They ask me if I did my taxes, when will I do my taxes, how much of taxes do I intend on getting, how much of taxes will I give them, when will you get your school loan, how much will you get etc... I told the girl, Geez stop interrogating me and I will get caught up when I get the money.  Please let me figure that out myself, I do not need anyone to figure out where I am going to get the money to pay you!  I will manage my own finances, I know what bills I have to pay and pay them in the order to hang on to what I got.  I prioritize everything and believe me, my mortgage is on my high priority list!

    this is the worst company anyone could imagine. THEY ARE RUDE, OBNOXIOUS AND HARASS anyone they can - they start to call before your payment is even due, and call several times a day, including your job, family and neighbors. They had the nerve to ask me what other bills I pay with my salary - I continually argue with them and they don't care - I would venture to guess that I make more money than the idiot clerk on the other side of the phone that does the harassing. My next step is to contact the BBB in Knoxville - If I owed them back payments, which I don't, this behavior would still be uncalled for..If anyone has any ideas how to stop their nonsense please respond thx.

    I am reporting them on the Federal Trade Commission website ftccomplaintassistant.gov and the Do Not Call Registry website donotcall.gov/register/reg.aspx every time I get one of these calls. It takes all of 5 minutes and just maybe if we all did this we can shut them down.
