The people called my mother and told her to let my husband know if he did not call back in 24 hrs he would be picked up on a warrant for malicious intent to defraud a financial institute. When I called back I was told that he would have a warrant issued if I did not agree to pay for a credit card that was paid off in 2004. The card was for $500, that was now $5275.12. He told me I could not get any proof of the debt until I paid it off. I have made arrangements to pay but, but we will go to the DA office first thing tomorrow before we pay anything.

He stated that he was calling in reference to "Docket
Number 29339 PX 4680" which related to litigation involving
a Credit Card Debt in the amount of $2,269.00 which included
late fees and interest in the amount of $1000.00. He stated
that he was with the law firm of Rubin and Yates. He said
he represented his client Household Bank, Inc. and that the
account was opened in 2004 and only one payment had been
received in 2005. I told him that the debt was not mine
and that I had never applied for credit with his client.
Bill Johnson then threatened that unless I paid him within
48 hours he would obtain a warrant to have me arrested to
have a deposition taken. I started to cry and called by
dad. When my dad called Bill Johnson, Mike Cohen and some
guy with the last name of "Irish" refused to give him their
mailing address. My dad stated that he needed it to send
them a Power of Attorney on my behalf in order to obtain
details of the claim. All three individuals refused to
convey the address. When my dad asked if they were attorneys,
all three of them said "No." My dad then found out that
this is a collection agency and their practices violate

- Four time momI received a voicemail from Bobby Tomlin of Rubin and Yates "law firm" looking for me and my ex-husband's wife. Now, she and I are not a pair. He said he hadn't heard from either of our attorneys regarding the fraud case against us. Apparently this is another one of their tactics. I don't owe on any of my credit cards or have any pending legal action. It was a bogus excuse. Since my phone number is listed and hers is not, and we live in opposite parts of the US, I guess they figure if they can reel me in, they'll get her.

- Appalled in Kansas| 2 repliesI received a phone call from a 1-716-650-2640. The caller left a voicemail, stating her name as "Kristen" only and that she was calling from "The Law Firm of Ruben & Yates," which is illegal for a collections company to say. The nature of the voicemail message was very threatening, and at one point stated that I had "48 hours to comply" by calling back or legal action would be taken. The number left for me to call back was 866-237-6191. I did some online research first, reading this and other message boards related to the highly suspect "Ruben and Yates" and so knew the questions to ask. First, I asked repeatedly whether I had reached the Law Firm of Ruben and Yates. I was literally transferred to 3 different people, eventually (and supposedly) speaking with "The Director." I told him that I had a voicemail message saved in which someone using their first name only and identified themselves as calling from the law firm of Ruben and Yates, and then told him that I not only went to law school, but studied consumer law, and am aware that representing oneself as an attorney or law firm when one is not is illegal. He got very huffy and stated that they have an attorney, to which I replied "EVERY company or business has an attorney. That DOES NOT make you a law firm. ARE YOU a law firm?" He became much more calm, if being calm involves accusing me of theft, since I stopped paying on a credit card debt MANY years ago, after becoming unemployed. After I let him yell at me for quite some time, interrupting at every chance, and being horrifically rude, I explained to him the unfair and predatory practices of the credit card industry, usually taking advantage of people with nearly usurious interest rates and that people caught in such situations have almost always paid back much more than the actual dollar value of any services or products bought with the credit cards, due to the high interest rates and excessive late charges. I told him that these practices would be eventually looked into, probably by the next administration, as surely as the mortgage companies are being looked into now for their predation of the poor. When I explained to him that I was unemployed and wanted something sent to me in the mail, he literally said "what good would that do?" and hung up on me. Wow. Don't let these jerks bully you. They are a BAD collections agency only, and they are of the type to engage in all the practices that they are simply NOT ALLOWED to engage in. Search for a Consumer Law Center near you if you have given them any money, because most likely, you now have a lawsuit of your own, AGAINST THEM, simply for the things they may have done and/or said which are violations of various consumer protection acts. There are, in some locations, substantial fines that can be imposed against these companies if more people would just come forward and point their finger in the right direction. Some law schools have consumer law clinics with sliding scales or provide altogether free services for people who have dealt with (or are dealing with) creditors or collection agencies that violate consumer legislation. Contact your state's Attorney General, seriously.

Typically a 3rd party collector will say anything over the phone to try to get you to pay the money even if you actually don't owe the money. A debt collector man not: use obscene or profane language - telephone you repeatedly with the intent to annoy or harass - place telephone calls without meaningful disclosure of their identity - make false representations implying that they are attorneys. If you believe that your right have been violated by this debt collector you may feel the need to complaint to: The New York State Attorney General's Office Consumer Fraud and Protection Bureau 120 Broadway New York, New York 10271 Telephone (800)771-7755. Also, you may want to file a complaint with the Federal Trade Commission. Their web site is: www.ftc.gov Lastly, there is a web site that has information on consumer related issues that may be of interest. That site is: www.naca.net They are the National Association of Consumer Advocates. One of the topics is debt collector abuse. Should you feel compelled to sue this debt collector for violating you rights their site has information about finding an attorney.

- stereotyped| 5 repliesThis is actually somewhat funny to read. I will admit there are scumbag collection practices, this is with each and every collection company. This does not make all collectors scumbags. I will say this, if you owe the debt, you owe the debt, quit trying to weasle your way out of it. A good collector will work with you and help you resolve it, they make money and you save money. People dodging debt is part of the cause of our economy being where it is. It does not matter, by law, if the debt is owned by the original creditor or a third party, it is still a valid debt by law. It amazes me that the same people that post here trying to help people "know their rights" don't seem to think that the creditor or owner of the debt has rights too.
Yes, I am a collector, and I don't think anyone could put anything negative about my collections efforts. For those who owe a debt and read this, realize this, you do owe the debt, don't blame a collector for doing their job. I can see being upset if laws are broken, but other than that they are doing a job that is vital to our economy.
Want to stereotype? How many cases have you seen about Priests' sexually assaulting young boys? Do you still go to church even though they "work for god"? NO, they are seen as bad individuals.
If you want to know your rights, know them, don't use a board like this for legal advice. The biggest ones all say "this site is for entertainment purposes only" on their disclaimer.
Posters on this site should post factual laws, not what they read on bud hibbs' site or some other "entertainment only" site.
Next time you go to work at the convenience store, or the bank, or wherever, stop and think of getting laid off cause your employer can't make payroll due to accounts recievables not getting paid. Should these people have some unforeseen expense it throws their entire financial state into the dumpster. Then, you have debt collectors praying on people like a bunch of vultures when these people have simply gotten over their heads (thanks to the banks) and can't afford to pay anything. Debt collectors are scumbags looking to make an easy buck. It amazes me that debt collectors are posting here. That is proof that the collector is all ready trying to intimidate you. If your credit is messed up then: why pay a alleged debt when you can dodge it? Yes, it does matter if the debt is owed to the original creditor or a third party creditor. It matters because what you have to do to weasel your way out of paying is substantially different. I agree creditors have rights too. However, when a debt collector is attempting to collect an alleged debt the somehow manage to forget the FDCPA. Finally, the job of a debt collector is not vital to the nations economy. It seems that you are putting that job in the category of farmers, ranchers, utility workers, doctors, nurses and so forth who are vital to the nation as a whole. The job of debt collector belongs in the scumbag category.

He told me that the person he was looking for was wanted for MURDER. (ha) I told him that I could not help him and asked him NOT TO CALL ME BACK. Well, two days later, he calls again. It was something i avoided for years. I personally just think all of you are more upset, and that rather than looking into the mirror at who really is at fault, you people get angry at this place. i looked up my bill and found it had been placed with them, and they gave me a settlement that was less than what i owed, they were reasonable and helped me out. but anyway good luck with blaming other people about your problems, i'm sure people around you are proud!

Debt collectors say and use any means to intimidate their victim, to scare them to pay. How about the person who has been ill and unable to work or looses their job because of cutbacks. Be honest your are a debt collector because you can't do anything else, so you can bully people, and feel tough, how do you sleep at night when the little old lady you just threatened is now worried you are going to take her pension.
- Debt FreeMy wife received a call from Bonnie at "Reuben & Yates" regarding a civil complaint filed against her and was being formalized in her county and would be required to appear and either my wife or her attorney must contact them.....They left a message that anyone could have heard, including our young daughter. My wife called them back and was asked to provide the last 4 digits of her SSN...she told them they were crazy (in not so nice words). THEY HAD THE WRONG PERSON.... they are just phishing.....I filed a complaint with the Federal Trade Commission immediately. These losers need to be taken down. Stupid Flockers!!
And for the record "hey kansas" and "michael campbell" I don't owe a thing...I'm not trying to "get out" of anything....I have a real job making more than you probably make in 5 years, I pay my bills and should not be subjected to harrassing communnications from loser collectors who are too stupid to do their homework before making phone calls. - gonzafive replies to Yvette HillMy husband has been receiving mail in regards to a credit card or loan from "Household" also. The letters have never had anything other than a collection agency's name on them. Today we received a phone call from "The Law Offices of Rubin and Yates" in regards to a civil suit and contact to their office must be made within 24 hours. Since niether of us have any type of suites against us I immediately looked up their phone number and name online, I am very glad I did. My husband just sent in a disputed a couple of weeks ago with one of the credit reporting agencies because we have never heard of a company called "Household" nor have we ever opened any type of credit or loan account with them. The first time we ever heard of this supposed debt was when the stimulus payments we being issued, they ever suggested that we pay off this debt at a discounted rate with our stimulus payment "which we should be receiving at any time now". It sounds like a scam to me I will deffinately be reporting this to the proper agency. I am so thankfull that there are pages like this one!
