- T.J.I also received a phone call from this company sometime last week. I don't check my housephone voicemails often so when I did I called them back to see what was going on. The voicemail stated that "A claim had been filed against my social security number and that I needed to respond immediately". When I called the person who answered the phone only said hello and did not even state the name of the company that he was working for. That was the first thing that alarmed me. After giving them my claim number I was told that I had a debt with Verizon for $9475.10 and that it would be in my best interest to settle this out of court for $2150.00 with the first payment being made on today. I told the man that I recently got a cell phone with Verizon 3 weeks ago and I know they would not have approved me for anything if I owed them any money. He stated that was true. When I asked for information on the original debtor and what the debt was for he claimed it was a calling card and I told him that I've never had one. He asked my if I used one when I was in college and I told him that I called directly through my parents calling cards through Sprint. He then eluded that maybe one of my parents or close relatives stole my social security number and purchased something in my name. I told him that I did not have those types of parents and that they would never do anything like that to me. He then proceeded to tell me to never say "never". I asked for something in writing in reference to the debt and he told me that would only delay things and that he would e-mail me. I checked my e-mail and the only thing he sent was what he wanted me to pay and the dates he wanted the payments to arrive in his office. I called back and asked to speak with his supervisor to get information on the original debt. His supervisor stated that the debt was from a CitiFinancial Card. I advised him that I've never had a credit card over the limit of $500.00 and did not understand if this was from CitiFinancial how they could calculate over $9000.00. The caller said he was checking my Experian credit report and that if I paid the money the item would be removed off of my report and my score would go. Well I have access to all 3 of my credit reports and I checked them and advised him that I did not see anything. I researched this company Rubin and Yates online and found several blogs on them with nothing but negative information. One of the blogs indicated to contact the Attorney's General Office in which I did and I'm glad that I did. The credit card that Rubin and Yates was referring to was paid out in full and closed in 2003. They stated that the card was opened in 2002 and payments were being made on it until 2005, which was a lie. Once I told them that they went back to it being a calling card. I was really worried about this because I believe in paying my debts but I learned this time that everyone is not honest although I wish that they were. Please take your time and research things before you make an agreement to pay or before you pay for something that you're not sure of whether or not it belongs to you. The attorney general told me not to call them back and stated that if they call me back to continue to request that they send me written information in the mail verifying this is my bill. They said if they can't do that then do not worry about anything because a real collection agency will be more than willing to send you information on an alleged bill that you owe. Rubin and Yates wanted me to settle the account even after I told them that it did not belong to me. That was a scam and they're not trying to help anyone out. There is something really "wishy-washy" about this company and I don't trust them at all. What happens is once you make arrangements to pay or provide them with payment information (check by phone, credit card, etc.) the statute of limitations opens back up and they can take you to court. The attorney general did tell me that there are not any statute of limitations on the amount of time that they can call you about the money you owe but there are statute of limitations on the amount of time they can take you to court and this time spans 3 to 10 years depending on the contract that you signed. - DiI just received a call from 1-86-237-6191 looking for a tax service company. They said that they were from Rubin & Yates and to call back MR. Hubble. I called the number back with the case number they left. After they started talking they were looking for the same people that gave my number to another collection agency 6 months ago. The people they were looking for are on the east coast not san diego, ca.

- Super SB replies to deleted postI received a call on March 10, 2010 (TO BE EXACT) from these POOR EXCUSES FOR HUMAN BEINGS... And somehow they caught me off guard because I answered another phone in the home... If I would have been at my own phone - I would have had my Original Info to dispute what they had... Once I agreed to a payment plan - I realized that after asking for something in writing or via my email - I NEVER RECEIVED IT - So I then went to my Bank (LOVE THEM) and PLACED A STOP ON THOSE PAYMENTS... They only got $350. AND WILL GET NO MORE... I will report them to the BBB..
And I can not wait for a phone call from THEM - once they find out there are NO MORE PAYMENTS...

- My job replies to David GoldbergJust to clarify, I am a debt collector and not all legit companies r like this. Legit companies r only allowed to state the facts and they r required by law to provide verification of debt within 30 days of the request. Unfortunately there r bad seeds that make us all look bad. As for this "company" l have been getting calls from them for another person and they r indeed leaving personal information on my voicemail that would definitely be a 3rd party violation of the FDCPA. I have called and asked them to remove my number and after 4 times the last person informed me that there is a note on the file to DO NOT remove my number under any circumstances. I have filed a formal complaint with the CFPB in regards to them, which I think everyone should do. Also it doesn't hurt to know ur rights as a consumer that r awarded to u under the FDCPA (Fair Debt Collection Practices Act) This is what the legit collection companies r following and there r attorneys out there just waiting to sue an agency that doesn't follow these rules.

- Tamianth replies to kathyNo, it is not ok for them to do this. And yes, they are breaking the law. The FDCPA is pretty clear about these kind of things. You just report them to different agency's as a ROT. NY has strict laws there also. First, payday loans being illegal there period if you live in that state. Second the BBB requires verification of the agency's there. According to the BBB, there is alert on them where they failed to prove who they are as required. NY is a hotbed for this kind of thing - from the kitchen table DC scam operations to legit DC's ala Buffalo Bully's. Having read through some of the BBB complaints, they tend to either ignore and not respond to them, or they drop it with the usual ad nauseum reply's of we didn't do anything wrong. (This is why you want to record everything).
Debt is a civil matter and not criminal btw, also neither phone, fax or email are legal proof of debt. They must send it in the USPS mail. And don't buy into any story's on this. They also must be licensed in the state they are trying to collect in as well as the one they are in.
Play it according to hoyle though regardless, and follow the steps in what you need to know here. Document everything, keep any and all messages on answering machine and record everything every time they call according to your states phone laws, some states require they be told they are being recorded while others do not, link for this below also. Take pictures of your caller id to provide proof of the date and times the calls occurred, which you can also transfer over to a recording device for evidence and keep a notepad with dates, time, what it was about etc. Also check your states SOL(statue of limitations) and know your rights under the FDCPA regardless as this will help you fight them along with your other information:

Consider getting a call blocking device or phone.. You can google them and many are around $50.00 or so. If its a cell phone, some already have call blocking, if not, there are free apps on the web that will work for some. You can google this. If you have a smart phone, there is a free app called call control. Iphones appear to have apps also. Another one is called Mr. Number.

years. In an effort to keep consumers informed about which collection
agencies are operating in accordance with Federal Law,

:Proof Of Licensing, bonding and or registration by the

Misrepresent Him or Herself
A debt collector may not misrepresent himself as an attorney or law enforcement officer.
Use the Telephone to Annoy or Harass
A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.
Threaten Arrest or Lawsuit
A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.
Use Abusive or Threatening Language
A debt collector may no use abusive or profane language in the course of communication related to the debt.
Publish a Bad Debt List
Publishing the consumer’s name or address on a "bad debt" list is prohibited.
Contact By Embarrassing Media
A debt collector may not communicate with a consumer by post card. I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated

If they continue to bother you, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
