    I work with vulnerable people and an individual I work with was a victim of this for $447.35. This person thought she was talking to someone from the Social Security Admin. When I brought her to the bank she had no money left in her account. Thankfully the bank wrote up an Affidavit of Fraud and refunded her her money. I plan on contacting the Attorney General's office about this. Seems like this group is making alot of money from vulnerable people. As I've read most are not getting their money back.

    This needs to be stopped!  My mom closed her checking account about a year ago because of unauthorized electronic withdrawals from her account.  A few days ago her new bank account showed an electronic check withdrawal of $387 by SMG with phone number 866-304-2401 for customer service and refund.  When I called they said the money would be returned in 21 days.  My mom said she had received a phone call from someone she thought was her bank and gave her bank account information.  It was probably Lena--employee#342 from "3rd party customer service company".  I guess D Ben has an accomplice now.  Her bank refuses to block these 3rd party electronic check withdrawals even though they are easy to spot and there is no other electronic withdrawals from her account!  They locked her account and are opening a new one, again.

    We are dealing with the same situation! On April 26, 2011 my mothers account had a charge of $459.25. I call the number and it is just rings and Then goes to a busy signal. My mothers bank said they have no idea how they would have gotten he account information. My sister was able to get someone to answer on 6/3/2011 but they said they were only the answering service, yet when she told him to leave a message about getting a refund, he told her that they would send one out in 5-7 buisness days..... While at the bank inquiring what the charge was for, the teller suggested my mom to open a new count, leaving just a few $ to keep the other account open in case there was an actual refund sent. I am shocked that there are so many reports of this going back all the way to 2008 with the same situation. What can we do?

    These despicable scammers are nothing but garbage that try to prey on the elderly.  As the rest of you, my husband & I pay my Mother's bills for her.  The first time they called they said it was a Lora Davis from Nationwide Security.  They gained my mother's trust...she gave them her acct. number.  We closed her acct. before the $399.00 check  tried to debit.  Second call they used intimidation, said they were from Freedom Security, was rude (she was convinced the man, Brian Williams was from her bank.  After she gave out the new acct. # then he said he was from the security co.  The 2nd checking acct. had to be closed!  My mother is 88.  Also had a stroke last year & has memory problems.  This time she will not have access to her bank acct.   She can not give information she does not have.  I have no doubt they will call again when they see that the second check they tried to debit was stopped as well.  I googled how to prosecute phone scammers and there was some good info as to who you can contact to help stop these evil people.  In the mean time continue to do your best to protect your loved ones financial accts.

    This happened to my mom 6-1-11 I don't know how long has been going on.  I just took over doing her banking with her may statement.  This electronic payment came in as insufficient funds and we went to bank and closed acct. My mom does not have internet, so they must have told her discount medical benefits for her Medicare and SS benefits.  A scam and my mom cannot hear very well over the phone.  Her bank refunded the money to her account immediately and now she has no acct number to give out.  It is really sad the scams they put out there to scare the elderly.  I really appreciate finding this on the internet.  the name that came up was FAMMED.

    My father-in-law was charged $419.  Was supposed to receive reimbursement by June 12, 2011 -- still have not received.

    Also spoke to Trevor -- who informed me I was ignorant and refused to let me speak with a supervisor as I was not a customer.

    Our bank said they would reimburse, then said no.  The reason:  they were told there was a voice recording authorizing.  My father-in-law says he did not authorize anyone to make a purchase for $419 for his account.  We are not even sure what the supposed purchase was for as we received nothing in the mail.  The charge showed up on the May 2011 statement (saying authorized in April 2011).  If you have any more information about this company, I would appreciate hearing as I would like to file a complaint with someone who can help us help the elderly.  This also happened last year with a similar outcome.  This is the 2nd year in a row we have had to close out accounts and begin again.

    Very similar story for us in helping my father-in-law.  Who did you find to contact?  This is criminal to prey on the elderly in such a way and I would like to see this brought to an end.  This has happened to us 2 times in the last two years.  We just closed out the account again and have opened a new one.

    Our bank would only deal with the monies from 3 months.  We also had to close out account and open a new one.  Problem it's now 2011 and it happened again -- in the same month... Our bank basically says they can not be held responsible if someone is giving out the account number.

    It becomes very difficult in how to help your parent, safeguard them from preditors, and still allow them dignity to handle their finances with assistance.  

    We are considering changing the phone number and keeping it unlisted so they cannot be called.  Has anyone else tried this?

    Also looking for information on who to contact to report this information.  This is difficult as we have very limited information about who the company is that made this withdrawal:  Myben  3rd Party Collections in our case.

    Have been assisting my father-in-law with his banking since we discovered an unauthorized electronic check in 2010.  The bank advised us to close out our account etc.  We did this (rec'd reimbursement also).  It is now 2011 and guess what?  Same scenario -- in both cases the money was withdrawn for supposed medical discount program.  Had to close out account again.

    My father-in-law says HE DID NOT give out new account information.  Bank will not reimburse as they say there is proof.  Bank officer asked for the proof and 3rd Party said they would reimburse the account.  Requested the proof anyway (so we could see if this was actually father-in-law authorizing without understanding etc.) and they refused to give the recording.  Hung up on bank officer.

    I called again as the monies were not refunded and spoke with Trevor -- who said he will submit a request to the company for reimbursement.  I asked to contact company direct and he would not give me information for them.  I asked to speak to his supervisor and he refused.  I am leaving out a lot of details, but you get the jest.   866-304-2401 Myben   --- Trevor @ 3rd Party

    This process began in April with the withdrawal -- now 7-7-11 and still no refund.

    I sent a copy of these notes to the District Attorney's office in California and am asking how to proceed.

    A company call Consumer Advocate Protection (CAP) issued an electronic check against my 93 yr.old mom's bank acct for $398. When I called the number 866-304-2401 (3rd party desk) they in turn gave me the number to CAP. It is 1-888-408-4753.

    The exact same scenario happened to my mother. Same company (CAP). However, the person at "3rd Party Customer Service" (which IS NOT a valid company name) became very indignent when I asked to know the name of her company. Also cannot find any info on CAP.

    My mother (86) balanced her bank statement on Friday - and found a $399 item listed that she did not write a check for and had no idea what it was for.  She went to her bank (beloved PNC) to inquire.  They gave her a copy of an unsigned document showing SASPLO as the payee of this "preapproved check."  My mother insisted it was an error... and the bank gave her the phone number to call (866-304-2401) to get it reconciled.

    It was after hours and a weekend but calling the number the answering machine says they are a "third party customer service company" - of course the question is "third party" of whom???  It is just an insulation game.

    I hope to press this matter - both against banks who pay these items - and those scams who generate the payment scheme... I want to get Attorney General's investigations going in every State where these scum bags play this game against the elderly.  I have a hunch a health alert alarm company she recently dealt with has sold her name and possibly her information to another telemarketing company... but my mother never received a call from this company or gave anyone her checking account number.
