I called these people back, apparently they were looking to collect an old debt from 2012, my dad has been disabled since 2010; The guy started threatening me, saying that my dads license were going to be suspended, and that the police were going to serve him and pick him up, when he started talking like that, I knew this was scare tactics to try to make some money, my guess is that these people stole a list of old peoples debts and they are trying to scare people into paying them, so they can profit off an already closed debt. Very sketchy people! Be Careful and do not give these people any more info than they already have.

They aren’t registered with the Florida Office of Financial Regulation as a debt collector so they are operating illegally.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- Too Smart To Be Their VictimCalled threatening litigation and criminal proceedings on a 6 year old debt to a pay day loan company. When I closed my bank account to get away from a shady pay day loan, they tried to tell me that was federal bank fraud. Had the wrong middle name for me, though I wouldn't verify anything, had an address for me that I left before I ever took a pay day loan, and insisted that I had filed for bankruptcy last year, though it was denied (never filed for bankruptcy in my life). As soon as I let on that I knew their intimidation tactics were illegal and threatened a lawsuit under the FDCPA (threatening criminal proceedings, threatening civil proceedings they had no intention of filing, continuing on the call without me verifying any information) , they hung up on me and stopped answering my calls (I was bored that day and wanted to continue messing with them). That was two weeks ago, haven't heard from them since.

- AnnoyedNJ replies to Carolyn FosterExactly what I have received. I never received any mail or calls previous to this one informing me of what I supposedly have done - just this threatening message. In addition, the message says YOU - does not state the name of whom they are trying to contact in the household. Once I was speaking to a representative from a bank my daughter used for a school loan which I co-signed for - she was late with her payment - and I asked about this. He said notices are sent if there is a problem, then calls made if no response. One of my other daughters works for AT&T and is well informed about these types of calls and has given me a few hints like 866- numbers are usually scams and DON'T ANSWER THE PHONE!
