One minute later my daughter-in-law let me know they had called her and said they had a court summons and they were going to serve papers at my house. Good luck since they were talking about an old address. I'm really getting tired of these scam calls!

They also called my brother looking for next , so obviously they are researching my family. This is harassment.

- losthighway| 2 repliesGot a call from these guys a month ago saying I was being sued my a creditor my a Best Buy card I stopped paying on in 2009. Before reaching me, they had called my sister, parents, and even my aunt and had us all worried.
I was given a case number and spoke to someone named Curtis Evans, who said the collection agency had attempted to serve me a summons to appear in court twice, and I needed to settle this with them by paying a discounted balance in full or setting up monthly payments, otherwise the matter would go to court. Scared, I agreed to the monthly payments and (stupidly) set them up via my debit card. They sent me an electronic form via email to sign electronically that basically said they were authorized to charge my debit card on the 28th of each month until December 2016, and as a result all legal actions against me would be dropped.
It wasn't until I got another call from a similar company saying there was ANOTHER pending action taken against me that I needed to call about immediately that my suspicions got aroused. I find it hard to believe two creditors are suing me a month apart.
I was then told by a lawyer friend that they never tell you you're being sued, you just receive a summons. This got me thinking, and I realized my sister, who works FROM HOME, never mentioned anyone attempting to serve me a summons, much less twice.
I Googled the name of the company on the payment document I signed (First Financial Partners in Riverside, CA) and nothing even comes up. The first search result is First Financial Credit Union.
Then I Googled the number they called from and found this site.
I think I've been the victim of a scam. Either that, or this is a legit collection agency and they lied to me about a pending legal action to scare me into making payments. I've also been told that contacting family members is illegal, and they sure did work their way through mine.
I am now contacting my bank on Monday and asking them to put a stop payment on this company and seeing if they can give me a new debit card, or whatever the procedure is, because I don't want these people having access to my account any more. I feel stupid for falling for this, but they mentioned my original debtor (Best Buy) and when I last made a payment, so I assumed this was legit and the idea of going to court scared me.
If if IS legit, the document I signed said failure to pay even one payment would make the contract null and void and they would pursue legal action again, but I guess if that is the case, I will find out once they stop receiving my payments.
I think by falling for this once, now that other company is using the same scam or scare tactic by telling me I have another pending legal action against me and I need to call them. I feel like I opened myself up to a huge mess.
I plan to change my banking information and ignore them. If they serve me papers for real next time, at least I'll know they were legit, but for now I am assuming this is nothing but a scam.- Caller: First Financial Partners

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - BigA replies to losthighwayYou have learned the hard way that paying them without asking for debt validation makes them put you on the "easy marks" list that they then sell to all their other criminal buddies.
Always, always, always make them follow the letter of the law:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
