    this collection agency works exclusively with payday loans. got a call from them today but wont answer. Some payday lenders charge you twice the amount you borrow in interest alone. i paid my debt back to them in three months but the said i still owe them 900 dollars. i dont owe them a cent. keep your bank statements if possible showing them how much you paid them

    I recieved a call from this number (1-866-504-7548) not only did the man accuse me of writing bad checks (By saying that they are not in the business of collecting bad checks) but he also threatened to garnish my check. Can they do that? Does anyone know?

    No, they CANNOT! They are in violation of the FDCPA, which states:

    § 807.  False or misleading representations  [15 USC 1692e]

    A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

    (1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.

    (2) The false representation of --

    (A) the character, amount, or legal status of any debt; or

    (B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.

    (3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.

    (4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.

    (5) The threat to take any action that cannot legally be taken or that is not intended to be taken.

    (6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --

    (A) lose any claim or defense to payment of the debt; or

    (B) become subject to any practice prohibited by this title.

    (7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

    (8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.

    (9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.

    (10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

    (11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

    (12) The false representation or implication that accounts have been turned over to innocent purchasers for value.

    (13) The false representation or implication that documents are legal process.

    (14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.

    (15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.

    (16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f)
    of this Act.

    I got a call from Mr. Ross who told me he was going to garnish my wages if I didn't pay. I asked him to not call my work anymore and was willing to give him my home number and he refused. What can I do? He told me that he was going to call my supervisor and garnish my wages, can they do this?

    They threatened to garnish my wages as well and I paid them back in full, I am considering litigation.  Also when you call the number back or when they leave a message they do not identify themselves, that is mighty sketchy to me.

    Called me at work and left me a message- she did leave her name and said that I was under a 24hr investigation and that if I did not call her back she was going to be "turning her informaton over to my hr department." I have not called them back but I don't want them contacting my hr department?

    Do they have the ability to garnish wages? Can they really contact HR and collect payment from them? I have paid them in full, but they are still calling me. Could someone please let me know. Thanks.

    They called several times today. I never answer.
    I don't play their games.
    I just report them to my attorney general do not call list
    because I Never had a relationship with them
    and never gave them permission to call.
    I don't care about their threats.
    Put up or shut up.
    You can't get wages without going to court
    and getting a Judge to rule in their favor First,
    which requires Proof, time and money on their part first
    before anything else can be done.
    You can also countersue them for Harassment and False representation
    among other things as well.
    If they do manage to garnish your wages,
    you could always quit your job and work somewhere else.
    What then? Then they would have to find you again,
    which requires more Time and money on their part.
    It could take them a year or more to find you
    If they ever find you, most wont go through the trouble.

    Hey...how about everyone stop coming up w/ excuses for their actions, and pay back legal obligations as promised.  Every one of you agreed to pay these loans back on your next pay day.  These lenders gave you money when no one else trusted you...at least do the right thing by paying back the people you owe.  Complaining and coming up w/ excuses for not doing so is not only unappreciative, but illegal.  Every one of you took out these loans promising to pay them back on your next pay day...you have no right then to complain about interest or the way you are being treated.  You also need to look up you state laws because well over half the info you all have posted is incorrect.  You can be garnished depending on the state.  I know this because I work for a payday loan company.  Pay your loans back as promised or don't take them out at all.

    to hmmmmm........your missing the point. Myself, like others have paid back these loans in full but are being harrassed by a collection agency for more money. THIS is ILLEGAL!  The fact that this company has been reported repeatedly to the attorney generals office should say something in itself.  Just b/c you work for a Pay day loan company doesnt mean you know all the in and outs of a collection agency.  I have been told by the Attorney General's office and by the State finance office that these "scare" tactics are very much against the law and that several complaints have been filed.

    Hey how about you learn debt collection and bankruptcy laws. Most payday loans are predatory loans that prey on low income people. Many states are passing laws to stop your predatory practices. Even so, there is nothing illegal about not repaying a payday loan especially when one files bankruptcy. Many payday loans violate laws of both state and federal level
    and especially when it comes to repayment and interest. Further, any entity trying to collect must sue you first before they can attempt a garnishment. I know because I am an attorney. Dont tell people what to do
    when you dont know the law. It may take some time but eventually all of you scam artists (dont claim you are legal, you are still a scam) will be put out of business. NO ONE should take out a payday loan as these are worse than running up credit card debt.

    I really don't know anything about the pay day places or their policies, but several years ago I used to work for a small collection agency.  Trust me, we did everything by the book.  Now I'm sure laws differ from state to state, but I know in WI, if you tell a collection agency you do not want to be contacted anymore, they CANNOT contact you.  If you tell them this and they still contact you, report them immediately.  You also cannot get your wages garnished until you have been sued first in small claims court.  My best advice, if you really do owe the money yet, at least make payment arrangements to pay it back.  If you can't come up with it all at once, pay what you can, whether it is $10 or $100 a month.  Every bit helps and collection agencies, if they're getting regular payments, are not going to harass you (well, the honest ones won't anyway).  And if you are certain you paid the bill already, make sure you keep the paperwork and if the collection agency wants to see it, send it to them as verification.

    I received several calls from them, but never answered because of comments like these. I also never answer them if I don't recognize the number.
    A few times they left messages and when I called back there was no answer as well. No shock there.
    Well now I've just found that 180 dollars has been taken from my account and I have no idea why. The only reason I know this was them is because there was a number on my statement.
    I called them as soon as I saw because this definitely has affected me majorly. No answer, but I actually got to a voice mail and left a message. Now what?
