I too was contacted but Avery legal services 866-379-0587 telling me that a process server had attempted to serve me today. They also called my father. They also had my social security number date of birth and where I live and somehow pulled up my credit report and told me I had excellent credit and how much my mortgage it.  This scary!  PLEASE CHECK YOUR CREDIT OFTEN AND MAKE SURE NO ONE STILLS YOUR IDENTITY.

They said that I was being sued by a bank. That I owe them $2000, but with penalties legal interest in attorneys fees it is now $11,000 plus but that they are willing to settle for the $2000. I then informed them that I was an attorney and that I knew what they were doing was a scam. I I asked him for the suit number evidencing that I have been sued and the process server was unable to serve me and he refused to give it to me. (THERE IS NO LAWSUIT pending against me that is why he could not give me a suit number). He told me that I could look it up in the county (I live in a Parish- LA) And I asked him once again please give me the suit number so I can have it. Of course he could not do that because it is nothing but a scam. Everyone beware do not pay these people a penny. It could be some old debt that you may or may not owe, regardless, this is just not how you are served with a lawsuit. There is a process if the sheriffs office cannot serve you.

Once again this is a scam and please be aware and do not pay them.

Family members got called and was given this number for me to call, they were given a case # and was told if I didn’t call they would proceed with legal action without my consent. I have no open legal lawsuits and I have paid any debts from my credit reports so I have no clue what they want from me and I just wish they didn’t call family members like my mom and my daughter, they don’t have better things to do with their time

Received a call from Anthony with Process Services at 866-429-0093 who claims that my number was listed as "an alternate contact number."  There was some additional information he gave immediately after mentioning his company, however spoke quickly and mumbled it to make it unintelligible.  He was trying to notify Greg Craddock (no idea who this person is) in regards to a pending legal matter & mis-delivery attempt.  He said that his notification "required immediate attention,"  that it was "very important that the firm speak with him"  and "if they fail to proceed, the firm will move forward without his participation nor his consent."  Also received a follow-up call from a woman at 866-379-0587  who was also trying to locate Greg.  She neither identified herself nor her organization.  She was trying to contact him to send him a letter of notification.  I noticed that when mentioning the complaint, she spoke quickly and unclearly in such a way to make the details of her message unintelligible.  However, when she gave the "refence" no. and her contact number, she spoke clearly and slowly enough to make the info. easy to hear.

I just got a call from them and I’m sure it’s a scam because I’ve never had a visa credit card.

That’s a complete lie.  It doesn’t come off your credit when a law firm takes it.

Also claimed to be Avery law firm but calling from the tiny town of Alvin, Texas. Supposedly my senior Mom (78 yo) had an American Express card from MD nat'l bank and MD nat'l bank sold it to Bank of America of MD nat'l bank and she stopped paying on it in 2016. They, of course, have permission to sue her through 2025. Few key things here: Bank of America and American Express are their own banks. How MD Nat'l got chucked into this I don't know. Honestly don't know if there IS a MD Nat'l bank. American Express comes from American Express and she never had an American Express anyways. This chick was young, american-sounding, likely white. Threatened the end of my Mom's pension if she got sued. Fortunately, I got involved in the call before she got anymore infor mation out of my mother. Scary though, they had the last 4 of her social.

OMG just had the same exact call from Stephanie today with the same threat.  They had my SSI # and info from an old account I paid off over 7 years ago and have all the paperwork. I pushed back and and things got nasty.  I Hung up and immediately contacted the credit bureau's because someone other than me has access to my SSI #.

I got a call from a woman telling me that I have a complaint and pending lawsuit, gave me a reference number, and that to call her back at 1-866-840-0383. I called the number and spoke with a Daniel Sanchez, telling me that I have a credit card debt from back on 2016 that hasn’t been paid—which I know is false—, and that supposedly they have sent a letter back on July 2021 and that I didn’t respond, and now the credit card company is pursuing legal action. He told me to call him directly at 909-740-2010. Scammers. Although, interestingly he has my Social Security and other personal information.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.

Got a call from a 404 number first stating that I had a civil suit against me and they needed to deliver documents - I said about what they gave me a # 866-840-0383 and a ref # when I called I spoke to Stephanie who stated I owed some credit card Bill from 2009 - and now they are threatening to sue for $9000. I said I know not of what u are talking about and I need more info - but the only way to get more info was to accept the debt - I told her no - not gonna happen. It’s 13years old if that’s the case who is suing me - it went from Confidential finance to their investors cause apparently when I signed the terms and agreement it stated that’s I gave them permission to sue after the time frame to sue had passed…. I can’t find these people anywhere I tried googling their # and their name which is now Avery & Associates and even tried calling back the 404 number no answer…. These people.
