Here is the latest scare tactic from this idiot.

Good afternoon,

We are writing to advise you that on Friday the 3rd of September 2010 a
member of our risk team spoke to a member of your bank/credit card's
security department.  Specifically, we dealt with Richard who has been made
aware of your actions, past gambling history, and that we are aware and can
prove you filed and signed a false claim.  He advised us of the following:

1) They will not refund us since the the time of dispute is past 90 days.
Payline had 90 days to send a formal dispute and did not do so thus
preventing them from obtaining money in that form.

2) That while they consider online gaming and processing of online gaming a
realm they do not wish to be a part of, he does agree both in principal and
in legal viewpoints that signing any false claim is both a breach of their
protocols and of State law.

I refer you to the following points easily confirmable through your State's
AG office:

Penalty for filing false document:

(a) A person commits a felony punishable by imprisonment for not more than
two (2) years, a fine of not more than two thousand dollars ($2,000.00), or
both, if he files with the secretary of state and willfully or knowingly:

(i) Falsifies, conceals or covers up by any trick, scheme or device a
material fact;

(ii) Makes any materially false, fictitious or fraudulent statement or
representation; or

(iii) Makes or uses any false writing or document knowing the same to
contain any materially false, fictitious or fraudulent statement or entry.

False swearing in nonjudicial or nonadministrative proceeding; false
claims or vouchers; penalties.

(a) A person commits a felony punishable by imprisonment for not more than
two (2) years, a fine of not more than two thousand dollars ($2,000.00), or
both, if, while under a lawfully administered oath or affirmation in a
matter where an oath is authorized by law, he knowingly makes a false
certificate, affidavit, acknowledgment, declaration or statement other than
in a judicial or administrative proceeding.

(b) A person is guilty of a felony punishable by imprisonment for not more
than two (2) years, a fine of not more than two thousand dollars
($2,000.00), or both, if he knowingly submits a false claim or voucher with
intent to defraud.

These are State laws, not us making up information as you like to claim.

Your bank will follow the lead as instructed by the State authorities
although we have been asked to specifically follow up and submit proof that
you did indeed file a false fraud claim.  Since you are not prepared at
this time or at any point in the future to become responsible for your
actions, we will be acting on behalf of what is morally right and you will
be reported tomorrow.  I should also make you aware that at this time we
have a sworn affidavit of our own from someone who knows of and has visual
confirmation of your receiving and gambling our funds.

This individual is prepared to submit his/her proof of claim along with
ours.

You can respond to argue your point, but the end result is because you have
taken what is not yours, you have forced Payline to act in the only way it
can to protect itself.  This will be the final email from our office.  It
has been determined that continuing to attempt to collect a debt you will
not pay is not worth the cost.

The hope is that when the State authority sees proof of your deposits,
somehow you will then be forced to pay restitution.  Though that may be far
from coming to be and unlikely to happen, at the very least you will
finally, after all these years,  be held truly responsible at least legally
under the laws of your State for your actions and your transgressions
against Payline.

Many months ago you or someone within your household used Payline to fund a
casino.  Had you simply paid for what was given to you, this would never
have escalated to this point.  Had this matter been dealt with honorably
and honestly, this issue would not be filed.

Your bank is now aware of what has happened.  As of tomorrow your State
will be too.  Make no mistake, this is no bluff or collection tactic.  You
have been reported to your bank and we will report to the AG tomorrow.  We
are not proceeding legally, but we are ensuring you are held legally
responsible.  

We suggest you advise your attorney at once.

"Richard" at my bank apparently spoke with them, too.  What a bunch of scammers.  I received the same email, word for word.

Wow, they spoke with Richarrd at my bank too.  Who knew that all the banks in the US have the same Richard working for them....LOL.. thank you all so much for this site and your words of wisdom....

This clown is too funny.  There must be some kind of toxic waste dump in Buffalo, or maybe it's the vibrations from the Falls.  There must be some explanation that accounts for why these [***] are all from Western New York..

This "Michael" guy has a bunch of automated email responses. They're all something like "First Warning", "Second Warning", "Third/Final Warning", etc. He essentially copies and pastes these emails and chain sends them out in hopes someone will bite down on his threats. Has anyone actually been sued or anything of that matter?

Has anyone else noticed that since people were making comments on here that there has not been one more post about how they "got me" and I had to pay a billion dollars back.??? Hilarious..  The first few posts stated that the "bloody Casino" got me after three years and I was tagged for 6500.00.  They are such bogus posts.  They know that we are on to them and they are getting pissed. They know they can't do anything.  That is why the newest email about talking to Richard from the bank is the best one yet.  We all got the same email.  Notice now it states that we are no longer pursuing legal action because it cost too much.!!!   But now we are all going to jail for a maximum of 2 years and we have to pay a 2000.00 fine.  I guess all the states have the same exact fine and prision term!!!!   The funniest thing is my bank really would love to hear from them.  I have begged this Michael Smith to call my bank I even called and left him a message with the telephone number, and person to speak with and the chicken [***] did not call. I begged him to take it to court and again no response or judgement yet.  Again chicken [***].  He threatened to go the authorities in my state, I again emailed him and I called and left him a message with a phone number and contact name.  Well hum!!! the chicken [***] did not call. Go figure. !!!  It's getting funnier and funnier reading all these posts because he is getting so mad because we are exposing him and hopefully most of the suckers he tries to bully out of money will read these first.  HE"S GETTING MAD I LOVE IT.
