- poe| 1 replythis company also collects for Sharp Healthcare yet they do not have info on the accounts refered to them, my accounts with Sharpe are in dispute yet they sent them to the collector anyway... Also note they like to "add" interest which is against the law... only deal with the hospital or company who the bill originated with, never the collectors... also they do not leave voice mail and same issues of asking me to hold then disconecting ....

I called them back and they refused to talk to me about anything because I am not my dad...???!?!? They wouldn't even tell me the name of their company. I don't know what to do at this point.

- Resident47 replies to Erin Krout| 2 repliesThe collectors won't talk to you for fear of a lawsuit. You're a "third party" to your father the alleged debtor. He could smack the company for damages if his privacy is violated. If your Dad wants you to communicate on his behalf, the agency will have to hear it straight from him. The FDCPA language requires "the prior consent of the consumer given directly to the debt collector".
If it is not convenient for your father to communicate from Baja, either one of you can give notice of that fact. The FDCPA bars contact in a place or at a time "known to be inconvenient" to the alleged debtor. A written notice sent USPS Certified is preferred for all dealings with debt collectors, who are frequently found ignoring verbal requests.

I now have the number blocked. I was in contact with Progressive Insurance regarding a claim against one of their customers, so first thought it was the Insurance company. It is not.

- Sarah| 1 replyGot a message from this and it's a debt collection agency that Sharp Medical Billing uses. I had sent in a check payment that they apparently never received. I called Sharp directly and paid the bill, and because it had only been less than 30 days in collections they said it won't show up on my credit report. If you even think you may have an unpaid bill somewhere and you get this call - I'd suggest calling whatever company you owe directly to inquire.

- Ginger replies to Resident47| 1 replyI think her dad is the third party since the debt is hers. And her privacy has already been violated since they spoke to someone else about her debt. I am assuming she is over the age of 18. If not, and they are trying to collect from him for her debt, all he has to say is he never signed anything agreeing to pay her debt and it should be deleted. Also she may have a case for a HIPPA violation if this was to collect on a medical debt.

She claimed (upon a second reading) the debt was hers, yet a Progressive agent behaved as though it was her Dad's. She sounded as confused as I am now. I'm not even sure the agency knows who to speak to. For all we know, they both supposedly owe something and the two accounts were confused.
Every person, even a minor, has a right to tell debt collectors to quit calling, and they don't need detailed reasons. Erin cannot be liable for debt if a minor, and in such case the agency should not have a privacy problem with either person. So there is something else going on which only Erin can untangle for us.
By the way, the world's most misspelled acronym you'd meant is HIPAA. - Resident47 replies to SarahMore to the point, a debtor should seek validation from the hired collector, even when the debt is tacitly acknowledged as plausible or correctly stated. The presence of a third party collector introduces the chance of error, or negligence, or deception, or unfair tactics, or some or all of the above.
