They are lazy and always calling because you were unfortuneate to get a phone number that use to belong to a dead beat. I sympathise. Also contact National Do Not Call Registry. (After you have had your number listed for 60 days. Do not bother with Tx. or Attorney general. No report Number. - Craig replies to D.T.| 1 replyRead my message at the top of column. "(If)!! they are trying to get you to pay someone else's debt because you now have their telephone number",due the following: CONTACT THE POLICE. An officer in my town of Temple,TX. did and they said they would stop. But file a report first with the F.C.C. and be on the Texas and National do not call for 60 days. If they are calling you on your business line you can not file a do not call. In this case contact the police and or find an Attorney.

They wanted the last 4 digits to my SSN. My wife refused to give them the number and became very upset with this call. I googled the number which led me here.

I have now called them 6 times and they tell me I shouldn't be on their call list and that I should not receive any more calls. Well it hasn't stopped them yet.- Caller: Franklin Collection Services

- Anthony WriffordI was told that I had an unpaid debt when I played this message. I have no idea what that might be. Can anyone, PLEASE, help me out? Who are these people? One from from Kaye, the other was from a man, (and he was the one who said I had an unpaid debt) but he didn't leave a name.
This is very unsettling and I'd like to know what is going on. If this is some sort of fraud; I am going to sue them because I don't need this sort thing in my life....Anthony L. Wrifford- Caller: unknown

Dear {insert name of collector or company},
I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.
This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:
(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.
I respectfully request that you provide me with the following information:
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state)
Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:
because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.
you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.
I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.
Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

You also need to pull your credit report from all three credit reporting agencies (Experian, Transamerica and Equifax). If they have placed any derogoratory remarks on them without providing proof that you legitimately owe this debt, it's a slam dunk. You can get them for the following FDCPA (Fair Debt Collection Practice Act) and FCRA (Fair Credit Reporting Act) Violations:
Creditors if they report your credit history inaccurately Defamation, financial injury US Court of Appeals, Ninth Circuit, No. 00-15946, Nelson vs. Chase Manhattan Extent of damages incurred by the wronged party as deemed by the courts.
Creditors, if you dispute a debt, and they fail to report it as disputed to the credit bureaus Protection under the FCRA (FCRA Section 623). $1,000.
Creditors if they pull your credit file without permissible purpose Injury to your credit report and credit score (FCRA Section 604 (A)(3)). $1,000.
If you dispute a debt, the collection agency fails to report it disputed to the credit bureaus Protection under the FDCPA (FDCPA Section 807(8)). $1,000.
Collection agencies if they do not validate your debt yet continue to pursue collection activity (file for judgments, call or write you) Consumer protection afforded by the FDCPA (FDCPA Section 809 (b), FTC opinion letter Cass from LeFevre). $1,000.
Collection agencies if you have sent them a cease and desist letter and they still call you Consumer protection afforded by the FDCPA (FDCPA

This outfit has already been sued multiple time for FDCPA violations, and another one certainly won't hurt:
A class action lawsuit has been filed in the Northern District Court of Alabama against Franklin Collection Services, Inc. for violations of the Fair Debt Collection Practices Act (FDCPA). Class members seek actual and statutory damages, attorney's fees and costs of the litigation.
Specifically, the complaint alleges that Franklin Collection Services, Inc., a Mississippi based collection agency, conspired to violate the FDCPA by mailing letters to consumers, purportedly from Jeffrey Waldo, a Mississippi attorney. The letters threatened legal action against debtors unless they contacted him to make arrangements to pay the debts when in fact the letters were written by the collection agency instead. More specifically, the complaint alleges that Attorney Waldo knew that his name was being used to threaten consumers, but allowed the practice to continue.

http://dockets.justia.com/search?query=Frankl ... 1&max-year=2008 - CMSI have been getting a call from "Kaye" for months on my voice mail at home. She only says "hi this is kaye. I am not a telemarketer. I am calling in regards to a very important business matter. Please call 866-779-8954 today." I am sick and tired of this person calling and leaving a message. The caller ID shows FCS. Even when you answer the call you still get the message and not a human. If this is a collection agency they have the wrong person. I would like them to remove me from their calling list.
- LindaKay calls daily from 662-690-2283 with important business information and says I need to contact them that day at 866-779-8954. I filed a complaint with the FCC, and I hope that others who are receiving these calls will do the same.
- Caller: Kay called & did not give company name
- aggrivatedgracieFirst call was a few days back and a man left a message stating they have been trying to reach me and I needed to call back at 18667798954 OR ELSE he had no choice... then hung up. He didnt leave a name or ask for anyone particular. Of course I was not calling back after such a pissy message like that. Then tonight I get a call from Kay stating she is not a telemarketer and I needed to contact them regarding an urgent business matter. Again, no name for who they were calling or what business they represent. I am NOT calling back! ;)The caller id said F C S I and the number is 662-690-2281
- Caller: F C S I
- FrustratedI have received approximately four calls starting with the "I am not a telemarketer" phrase. Over the last two days there have been three calls (two today) without the qualifier, just a reference to a "very urgent business matter."
I began receiving bogus calls on this number during the presidential election period. However, I have done nothing to solicit such calls. Applied for call blocking, but will take another two months to take effect. Presumably, I have to suffer this fraud until then...and then what?- Caller: n/a
- ShusonRecording that says it's an important matter and needs to be taken care of immediately. 1-866-779-8954
