- Joeblack replies to ProfOj67| 2 repliesI asked for an address and they told me 411 east Franklin st. Richmond Virginia. First of all the area code they called me from was from Austin Texas. And second of all, when I map quested the address it just came up as an empty property building waiting to be leased. Third of all, when I called a real law firm (with a real website) that neighbors the same location and asked them if they were affiliated or ever even heard of the name cooper hoffman klien and [***] (no spelling change or capitalization needed for these [***]) They said they had never heard of them and that the building had been empty for some time now. So I have one word for this type of situation, and its a long one: Scaaaaam!!!!

- Fed upI recieved many harassing calls fro this so called law firm of CHKA. They said I had an outstanding check advance with check into cash. They gave me a file number and everything. They said if I owed over a thousand dollars, but could make weekly payments of $150. These people also had my ss number, address, phone number, and said they had video footage of me. They said if I did not pay that they would take legal action, garnish my wages, and suspend my license. They were very rude. I told them right off the bat they were a scam. Do you people like Juno hear me? YOU ARE A SCAMMMMMMM. Leave us alone. I and the rest of us hard working people are not going to pay you a dime. I have never taken out a check advance, do not have a checking account, and therefore do not have checks you ********* [***]. Get a life a leave us alone scammers.

- CWG40 replies to AdamYes, but in order to be persecuted for bad check writing (which is a crime), you actually have to write a bad check. There's no way an ordinary civil debt can be magically transformed into a crime. But this is the story that the scammers are putting out. And in any case, it would be handled by law enforcement, not some scammery scummery debt collector. Debt collectors have no influence on the criminal justice system. In order for someone to be prosecuted, there would have to be a victim who would have to make a complaint to the police. The police would have to do an investigation and make a recommendation to the local public prosecutors. In point of fact, most of the time the bank will simply make an arrangement with whoever wrote the check and that's the end of it.

I paid them $269.66 as downpayment plus $230 x3 payments to settle.debt. I asked for proof on letterhead which they sent an agreement but no signature is on agreement so is it valid? I did call back both numbers and they did respond as the law firm.

I'm not saying anything that hasn't already been said by others, but, here goes!
-Private Companies cannot issue arrest warrants.
Only those in the judicial system can issue warrants. They need to be petitioned by attorneys, and signed off by a judge.
-Debt is civil. not criminal. You cannot be arrested for ordinary debt in the United States and Canada. There are no debtors prisons here.
-If there were an arrest warrant with your name on it, your local courthouse would have it. Look up the number independently, and call them.
-IF THERE WERE, however, no one will EVER call you to tell you they are coming to arrest you, or serve you papers. Process servers only get paid if they deliver your paperwork, and if you hide, they won't get paid, so, they won't tell you they're coming.
-ALSO, if there were "criminal" or "financial" proceedings against you, it's too late to pay anyone. The deed has been been done. The proverbial wheels are in motion.
-Money sent by 'untraceable means' (cash cards, western union) is money that cannot be traced. I know that sounds obvious, but by the time you figure out you've been scammed, you have no way to figure out who collected that money. It's gone forever. You can't dispute it.
-Threats of arrest, losing your drivers license, putting holds on SSN's, demanding attorney contact information and other things like that are common scare tactics used by "debt collectors" who are trying to collect on a debt they cannot legally collect on. If they COULD legally collect on the debt, they wouldn't have to resort to scare tactics.
And perhaps most importantly -
-REAL debt collectors will send you (because they are required to, by law) a 'DEBT VALIDATION'. This is sent through the mail (USPS) with a stamp on it (e-mail, fax, texts, carrier pigeon, smoke signals...none of those count) and tell you when you incurred the debt, to whom you owe the original debt, and how to proceed if you don't think you owe the amount, or if your records reflect a different amount. Remember, this is REQUIRED BY LAW to be sent to you within 5 days from initial contact (on the company behalf) DEMAND THEY SEND YOU THIS!!! This will immediately weed out the scammers.

What nonsense. You are using protections afforded to Native People of this land and exploiting them to help hide your shark practices from Federal law intervention. Most of the time setups like yours (since you probably work for one of these trash companies) aren't legally bonded or licensed to do business in the states that you advertise, and you aren't exempt from those requirements.
While these extensions are helpful bridge funds for those that can't make ends meet, your type of companies charge 400% - 1000% for these funds, because you already know what type of borrowers and slow-pay situations most all of the borrowers will be in. Payday lenders shouldn't be permitted under Usury laws, to even charge these types of APR for short term bridge loans. You already get your money back in Fees by the time a borrower makes 2 or 3 payments. While I don't advocate defaulting on your obligations, if someone cannot pay and tries to work it out - your company can either help, or do what most of you do, break the law to try collecting on loan proceeds. Must break your soul that most online ACH transactions against DDA accounts do not process as "traditional checks", and these workarounds you try to use don't really help you anymore.
You like to post links, you should probably read some of the more recent CFPB and FTC notices that have ACTIVELY fined and charged organizations like yours with illegal collection practices and for breaking laws. You can't just magically "hide" behind an Indian/Tribal Pact so that you can skirt around the law, that is absolutely not what these protections are there for. Payday loans are dirty money, (il)legal loan sharking.

You lend money and rely on non-Tribal organizations to facilitate the processing and depositing/crediting/debiting of consumer accounts. The CFPB will make this process so painful and impossible, that most companies will refuse to do business with, or will flat out drop you as a vendor. So many of these Lenders are hiding behind "Sovereign Immunity" - which doesn't really even apply to them, since you are using a loophole to circumvent laws surrounding debt collection.... it will be so awesome to see you forced out of your foxhole and have no choice but to operate lawfully. Or better yet, just go out of business... like so many "Tribal Lending" establishments have had to do recently.

They call hundreds of people out of a list and repeat the same story to everyone. The scammers either buy database containing personal information or build such databases themselves, by collecting data over the internet or by calling potential victims impersonating banks, utilities and other trusted service providers.
They use high sounding names like "Rothstein Acquisitions Firm" to give the call a look of legitimacy. If only people who get such threatening calls could ask the caller about his whereabouts, the scam will unfold. The crooks will refuse to give office location or provide address of an office which has nothing to do with them. All that we need to do to expose scam, is to grill the caller. If the call was legit, the caller would have been happy to provide information.
Consumers should NEVER PRESUME that they are being called, in relation to any old debt that they may have. The callers make wild phishing calls to thousands of numbers hoping to scam a few. Or they might have bought old loan portfolios from original lender and trying to collect unlawfully. They may have only sketchy info, if at all they have any. In either case, you are NOT liable to pay till you get a Valid Notice by Post
IMPORTANT: You should NEVER pay any caller who refuses to send a Debt Validation Notice as per the format specified in FDCPA(Fair Debt Collection Practices Act) Don’t get alarmed by talk of, serving papers, arrest, court case, prosecution and such stuff! These are totally bogus claims made only to scare you!
Calling relatives or place of work about someone’s debt and sharing information with them is illegal and ONLY scammers who want to extort money would do that. No legally registered, legitimate company, will ever do that! Hence never pay a penny to anyone who calls your relatives.
REMEMBER: If you pay money to the callers, to “settle” any old debt, you would be making a terrible mistake. Paying these scammers do not make your debt, if any, go away! The scammers will comeback with a different name, scare you con you again.
DON’T share your address or any other personal info with callers.
If any one calls and threatens, ask them to send Debt Validation Notice and tell them that you are AWARE of fraud and have been advised to act ONLY of you receive a VALID Debt Validation Notice.
NEVER call back in response to any threatening Voice Message or any message informing you of serving papers, legal action, arrest etc. IGNORE such messages.

Scamming the Americans have become an organized business in Asian countries, with a network of illegal call centers manned by low paid workers.
Their sole intention is to scam Americans out of their hard earned money, by pretending to be Law Firms, Investigators, Federal Agencies and Debt Collectors which they are NOT. They usually have foreign accent. And may turn aggressive when you question them!
We should not get taken by CALLER ID which may display a local number. Scammers call using VOIP and they are able to change the caller ID, to any number that they wish to display.

- Mr JOur business line has had this company call a few times in the last couple of days, and last year as I recall with very threatening messages. So I called back, and started the conversation with "who was I talking to" I also informed them that the call is been noted, the day said "oh ok" which it was. I drove questioning before they even started, and to be honest found the lady very polite who promised to remove our number. The few details they had where not incorrect. So my advice is do not be afraid to call but have your questions and you drive the conversation. Be polite and firm...worked for me.
