- Resident47 replies to WillisThe federal Do-Not-Call registry exists to help enforce the Telemarketing Sales Rule. Please note the operative term ''marketing''. A debt collector is not a sales person and is therefore not covered. The few remaining state lists share this limitation. Here are the DNCR service terms you were supposed to review at registration time:

You do have a FDCPA cause of action and I would guess until the end of this summer to file suit. - Resident47 replies to Dorothy from brooklyn nyYou already have FDCPA violations for idle threats and cussing, no need to wait for your AG. Lack of a required dunning letter adds another violation.

The address at 3195 South Park, Buffalo, NY appears to be a shopping center, so they must be working out of a UPS store.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

File a complaint at the NY State AG's Office here: http://www.ag.ny.gov/http://www.ag.ny.gov/ - Resident47 replies to smkYou or your father can demand an end to the calls. The FDCPA gives him a right to a quieter phone. Sitting and wishing will not invoke that right. Given the thuggish business practices described thus far, USPS Certified with return card is recommended.
- Resident47 replies to C.Q.| 2 repliesIt's your job to "please stop" unwanted calls, not mine, and not that of other readers.
- BigA replies to Resident47| 1 replyI just posted a report on these crooks on page 2 in answer to the shill posts. They were sued several times and never showed up resulting in default judgements. I doubt the plaintiffs will ever see a penny of that money.
- Resident47 replies to Scam Beware} debt collectors do not call you; they will often send letters
Really now. My call logs from the past fifteen years say otherwise, and so do my civil complaints, which have won me thousands of dollars for improper phone contact from debt collectors. If anything, the worst of the bunch will avoid US Mail and rely on the phone as their chief weapon.
} it will be on your credit report is it is real.
A "real" debt need not be listed on credit reports, which per FCRA can only retain derogatory tradelines for seven years. State Statutes of Limitations can run up to fifteen years, and debts never die until they are paid, a judge discharges them, or they age (in two states only) past a Statute of Repose.
You should concentrate on the empty threats and misrepresented debt claim and any other FDCPA violations, once you learn what the law says and forget your wayward suppositions.

http://www.consumerfinance.gov/askcfpb/search ... debt-collection - Resident47 replies to BigANo-show business defendants can be vexing for sure, but then that's what domesticated judgments and writs of execution are for. Maybe in lieu of money the victors can win the attention of WebRecon and build a street rep.
- Resident47 replies to Know what your talking about"Clients they collect for" may easily be debt buyers. Lack of AG complaints does not equal lack of lawbreaking. It's time to shop around if your attorney cannot compare the FDCPA to the behavior exhibited by collectors.
- Tygerkat replies to Know what your talking aboutIf your attorney looked into them he/she found their legal name & business address so please share that with us.
- Tygerkat replies to ConcernedSo you just pay random people who call you and claim you owe them money? You don't wait until they MAIL you proof of the debt? Great! What's your phone number? You owe me money and I want to collect.
- M Areceived a call today at a business phone number looking for an 8 year old boy who apparently has a debt according to their automated message. This company is absolute BS. No company name given on the message just a threatening "this is an attempt to collect a debt" and if you have retained legal counsel have them contact us.

- Linda F. TuckerReceiving a call from this number several times a week...I do not answer but it is getting to be annoying.
- Resident47 replies to Carol TerryYes, Denise and Carol, I'm sure you would like the calls to end. By now you must have noticed that idle complaints on this board did not get the job done. You have a right to confront debt collectors yourselves and make them validate claims, limit how they make contact, or quit calling altogether, and also sue them if you are not shown the proper respect.
