Debt Collection Agency To Pay $2.25 Million
The Michigan Collection Law Blog has posted an article relating to another blog post from Workathometruth.com about the Federal Trade Commission slapping Academy Collection Service, Inc. with the largest penalty fine ever in a debt collection case. Keith Dickstein, owner of the company, has agreed to pay the fine of $2.25 million.
Over 1,000 complaints have been filed against Academy Collection Service for various forms of creditor harassment, such as:
Academy’s collectors allegedly engaged in false or deceptive threats of garnishment, arrest, and legal action; communication with third parties about consumers’ debts; and calls to consumers at their workplace when the employer prohibits such calls. Other practices included frequent, harassing, threatening, and abusive calls; unfair and unauthorized withdrawals from consumers’ bank accounts; and early deposit of postdated checks consumers submitted for debt payment.
Not only does Academy have to pay a fine, but they are now prohibited from misrepresenting themselves to customers as attorneys instead of just debt collectors, and also from:
...misrepresenting to consumers that nonpayment of a debt will result in the garnishment of wages, seizure or attachment of property, or lawsuits...and are also prohibited from improperly communicating with third parties about a debt; using false, deceptive, or misleading representations in debt collection efforts; communicating with a consumer at any unusual time or place, including the workplace; or harassing, oppressing, or abusing any person in connection with debt collection. The settling defendants are also barred from making any withdrawals from consumers’ bank accounts without obtaining the consumers’ express informed consent, and they cannot deposit or threaten to deposit any postdated check or other postdated payment instrument prior to the date on the check or instrument.
After the FTC settlement, the corporation changed its name to Monarch Recovery Management, Inc.

I got pissed and did some checking. The law states if they call repeatedly day after day you are entitled to reclaim money from them.  The lawyer who I am using is not only free but so far has recovered $1000.00 for my wife and myself.  The guy I am using is Todd Friedman 877-206-4741. He is here in CA. You can always check your phone-book for a consumer law attorney who goes after these illegal and harassing calls.

These jokers called me early last month regarding a debt that I didn't acknowledge.  On the first call, I told them that I am represented by counsel, gave the attorney information, and thought that was the end of it.  About twelve days later, they call back again.  Two days later, I call them and place on their voice mail the same information as before.  This time, they called my attorney and haven't called me back since.  Now we're filing an FDCPA lawsuit against these jokers.  

Some guy has called twice today asking for Carrie. No Carrie lives here.

They called and I missed it so I called them back. If they call again I am going to give them my Majic Jack number. Feel free to use it as well if you want. 605-540-6410. I only have it to use on offers that I want to check out, I never answer it. Like when I was checking out auto ins. companies. I screen the calls and call back the ones that I like on my cell. I do not owe any debt and the first thing she wanted was my personal info. Like right!!!!!!!! She was rude and hung up.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I have no idea what they are calling about and all my bills are current. I have worked very hard to maintain an excellent credit score so this really bugs me that I am being harassed about something that is bogus. Is there a way to block this number?

Two numbers same company calling for debt collections. I don't owe anything .

so after doing research on here... this only goes back to 2011 but here we are in 2016.  thankfully I can block calls give me a effing break.

says its from moarch recovery services, i owo no one anything!!!!!!

This is the number that they repeatedly call my cell phone from. They don't say anything and don't leave a message. They call every morning at 8 am.
