- thebodysnatcher replies to lametI have had this number call me, from several different places.
please keep in mind, i owe no one anything, or have any connection to NY state in any way. neither does my family. i hold a state investigators license and work as a surety/fugitive agent here. i have 5 years of this under my belt, and my mother who investigated for the feds, did so for nearly 30.

- they are out of New York, and I live in NC. they had no way to serve anything on anyone.
- I called Erie County Sheriffs Office, and they are investigating , as well as the Attny Gen Office.
- I have checked with NYSBA(state bar assoc.) and they are not listed.
- I had my agents up in NY go to the address listed, and its a UPS store. they are a scam and will soon shut down.
- They seemed to be looking for my mother, who is a federal investigator, and has in no way any connection to NY either. she and the rest of the family live down south, about 12-18 hours away.most never having left where they were born, they have called all of my immediate family members, dad, brother, mother, myself, sister in-law, ect.
you need to call the Attny Gen office at 716-853-8400 and ask for the consumer division. have them send you a complaint form, and mail it back to them with your issue. they are investigating them. - thebodysnatcherI have had this number call me, from several different places.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not…
Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:
Misrepresent Him or Herself
A debt collector may not misrepresent himself as an attorney or law enforcement officer.

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.
Threaten Arrest or Lawsuit
A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.
Use Abusive or Threatening Language
A debt collector may no use abusive or profane language in the course of communication related to the debt.
Publish a Bad Debt List
Publishing the consumer’s name or address on a "bad debt" list is prohibited.

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Bills.com FDCPA FAQ
Below are questions Bills.com readers ask frequently:
Can a Collection Agent Call My Cell Phone?
Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.
I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.
A Collector Says I Will Be Arrested if I Do Not Pay
This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt. - Andrea LynnI have received several calls from a ms Wright. I have repeatedly told them not to call me at work. However they do not listen. I am in danger of loosing my job because of them. They told my employer that I was a no good criminal and write bad checks. Funny thing is I don't even have checks just a atm card.

- CWG40 replies to rcTotal scam. You can't be arrested for ordinary civil debt. We don't have debtors prisons in the US. There is no case number, there is no case. This is just an example of what these debt scammers are capable of.

- too smart for scamsOle Cynthia wright left a message on a voice mail with details about my FRAUD ATTEMPT in my county.... lol first off....voice mail was left on a number that is no longer my number giving information to someone that is not me. ...violation. secondly. ..I truly doubt if MY county was filling suit against me. ... they would hire a local firm. ...or at least one within 3000 miles of me. I'm California based but NY is the attorney they hire. ... please give us some credit. Thirdly. ...I have never misrepresented myself to secure funds. ... that fishing tactic had me and still has me laughing.
A few years back I was not smart enough and WAS bullied by a company who used the same tactic... as soon as I hung up I realized something was wrong. I hired a lawyer. .. closed my bank account THAT day. .. and in the end the scammers lost I won. ... and the original debt was cleared off my credit report. I felt bad because I DID owe money. ... but this was the 3rd or 4th company that had their hands on my account and they broke every law. I will be going back to the lawyer with this voice mail. .. and yet another delinquent account will be cleared. Sad that as I'm slowly paying back my debts from the 07 hard hit recession there are a few who will never get their money because they allow these bottom feeders to take our accounts. I don't play well with threats. Any legitimate company does NOT threaten you with suit and jail. Funny the last company I took down was from NY too....hmmmm- Caller: Cynthia wright- for litigation firm
