- JakeReceived call 11/12/2011 asking for my mother who passed away in March of this year. I told the caller not here and they said they would call back later. I told him good luck with getting in touch with her. Did not ask who he was, anytime I get a call "Not identified" I know it's probably some scam or telemarketer, even though I am supposed to be on a "do not call list".

!THERE IS AN ALERT FOR THIS BUSINESS!
Government Actions
On February 26, 2010, HomeServe USA Corp. and HomeServe USA Repair Management Corp. entered into an Assurance of Voluntary Compliance with Jack Conway, Attorney General of the State of Kentucky.
The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of law.
The Assurance settles charges that the business allegedly violated Kentucky consumer protection law by designing and mailing, or directing the design and mailing of direct marketing material containing false, misleading or deceptvie representations to approximately 230,000 Kentucky consumers in or around January 2010.
Under the terms of the Assurance, HomeServe USA Corp. and HomeServe USA Repair Management Corp. agreed to: 1) prepare a corrective letter clearly and conspicuously disclosing the 'water line service coverage' is an optional service that is not affiliated with the consumer's water utility company, and mail the corrective letter to all Kentucky consumers who received the initial letter and have contracted in any way, by any method with the business for 'water line service coverage' between January 1, 2010 and April 1, 2010; 2) business shall affirmatively disclose in all solicitations that its services are optional, and business shall not otherwise represent, either expressly or by implication, that they are affiliated with the utility company unless such repersenation is truthful; 3) business shall comply with the terms of the corrective letter regarding consumer cancellations, if any; and 4) business must pay $7,500 to the State of Kentucky for civil penalties and the cost of the State's investigation.
On April 15, 2010, HomeServe USA Corp. and HomeServe USA Repair Management Corp. entered into an Assurance of Voluntary Compliance with Richard Cordray, Attorney General of the State of Ohio.
The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of law.
The Assurance settles charges that the business designed and mailed multiple solicitations containing unfair or deceptive representations to hundreds of thousands of consumers in the State of Ohio. In the Assurance, the Attorney General claimed the solicitation's appearance may: 1) lead a consumer to believe the communication is from the consumer's local water untility service, when in fact the communication is from a private entity; and, 2) may lead a consumer to believe that the consumer is required to purchase "water line service coverage" when in fact the purchase is optional in nature.
Under the terms of the Assurance, HomeServe USA Corp. and HomeServe USA Repair Management Corp. agreed to: 1) refrain from using unfair or misleading advertisements violating Ohio consumer protection laws; 2) prepare and mail corrective letters to all consumers in Ohio who received previous solicitations, and comply with the terms of the corrective letter regarding consumer cancellations; 3) clearly disclose in all solicitations that its service is optional and not required by the local utility company or governmental body; 4) not represent, either expressly or by implication, that it is affiliated with the utility company unless such representation is truthful; and, 5) pay Fifteen Thousand Dollars ($15,000.00) to the Office of the Ohio Attorney General for fees and investigative costs.

BBB® C- Rating
On a scale of A+ to F
Description:
The company provides service contracts and after-market extended warranties on automotive and consumer products in the United States and internationally. According to information supplied by the company to the BBB, Warrantech is “a third party administrator and contract agent for private label companies and administers their service contracts." These service contracts include, but are not limited to, home, automobiles, recreational vehicles, home appliances, home and entertainment products, computers and office equipment. Claims covered by Warrantech contracts are paid by insurance companies that underwrite the warranty-extension and product-replacement contracts it sells.
Complaint Information:
The majority of complaints allege the company denied valid claims, failed to make needed repairs, had lengthy delays to repair or replace covered items, and provided poor customer service. Due to the size of the company and the nature of its business, complaint numbers alone do not cause alarm. The mere number of complaints lodged against a warranty company is not nearly as important as the company’s response and the manner in which it resolved its consumer’s issue.
After thorough examination of complaints received by the BBB, a pattern was identified based on the category of claim filed.
Home Warranty
The vast majority of complaints regarding Warrantech home warranties center on lengthy delays from the claim date until the repair date.
Appliance Warranty
The major complaints regarding Warrantech appliance warranties center on lengthy delays. Specifically, customers reported after placing a claim call, weeks and months passed before appliances were repaired.
Television Warranties
Although several complaint issues have been made about Warrantech television warranties, consumers repeatedly reiterate problems with lengthy delays, poor customer service, long telephone wait times, and failure by Warrantech representatives and supervisors to return calls promised to the customer.
In addition to the lengthy repair delays, customers report excessive telephone hold times for Warrantech, having to place numerous and repeated calls to Warrantech to get a service provider to repair the television, failure to return promised calls by both representatives and supervisors, refusal by representatives to transfer calls to supervisors, and rude and abusive representatives.
Automobile Warranty
The majority of Warrantech automobile warranty complaints center on deceptive and ambiguous language in the contract and refusal to pay valid claims. With regard to complaints concerning the contract, customers complain the contract fails to address which vehicle replacement parts will be replaced with “New” parts versus “Remanufactured or Replacement parts of like kind and quality.”
At the time of purchase, customers ordinarily are not presented with the actual extended warranty contract. Rather, consumers are typically provided with advertising information and/or brochures about the extended warranty plan but the actual document and what it covers is not available for review. In fact, the consumer receives the actual extended warranty contract in the mail days or weeks after entering into the contract.

Under the Federal Trade Commission's Disclosure Rule, there are five basic aspects of coverage that a warranty must describe. It is useful to think of these as five questions which a warranty must answer:
1. What does the warranty cover/not cover?
2. What is the period of coverage?
3. What will the warranty company do to correct problems?
4. How can I get warranty service?
5. How will my state's law affect my rights under the warranty?- Caller: HomeServe USA Corp

- LynnI am really getting tired of these idiots calling me from different out of state phone numbers, 800 phone numbers and unavailable phone numbers. I refuse to answer my home phone and cell phone to those people. And also, yes I am fully aware you can report them but let's be realistic here, do you really honestly believe it will stop them 100%? If the do not call registery can't help these calls what makes you so sure FTC and BBB can help? There are so many of them out there right now that it will not stop and there are a lot of bill collection agency out there who are really not bill collection agency as well. I say just don't answer the phone, they will go away eventually on their own. I'm not going to spend my time reporting over and over to anyone when we all know good and well it will keep on with another different phone number. They need to get a life and leave us alone...in my opinion they are losers and have no life.

- Zac replies to LouA| 1 replyThis is just another scam that is designed to enhance the revenue of AQUA. Letters are sent out in envelopes bearing the AQUA logo, postage paid by AQUA) urging customers to buy insurance (from HomeServe) covering rupture of water pipes. However, a perusal of the small print reveals that if at all the pipes rupture, HomeServe can conveniently avoid any payment at all. This is a scam which the Utilities Commission should investigate.
