Says they have "very serious" matter at hand and said the number they tried me at (where I haven't lived in 4 years) wouldn't take a message and "that was not a good thing."  They called on Christmas Eve!

They called me and a lady said, "This is Alyssa from Everest Receivables Services.  It is very important that you or your attorney contact me regarding File #9647482.  I can be reached at 877-752-0150.  It is in your best interest to call me back as soon as possible."

So, they did not give the required language of "This is an attempt to collect a debt and any information obtained will be used for that purpose."  They did not identify who they were collecting for or the amount of the alleged debt.  Also, I have never received anything from this company in writing.  So, apparently, this call was totally illegal.

    What nerve.

They called my brother's mother-in-law's home number which has no connection or relation to me whatsoever.  A person by the name of Mr. Artel left a message and stated that I need to call back at this number for an urgent matter.  He wasn't clear in the message and I thought it was the IRS and had my brother and I sitting on edge.  I called the number and a guy answered.  I asked to speak to Mr. Artel and the guy told me he stepped away from his desk.  I asked the following questions:
    1. What kind of company are you?
    2. Why are you calling my brother's mother-in-law who has no connection to me whatsoever?
    3. How did you get her number?
    4. Are you a collection agency?
The guy asked for a file # that Mr. Artel never left in his "message" and couldn't answer any of the above mentioned questions.  I'm reporting this to the better business bureau as they are very flaky and I believe it's an illegal company!

ERS is a licensed business. However, verifying this was a major task as it seems that no one at this company was certain themselves, since they were unable to provide me any information to help me verify their validity as a business. When I asked for a licensing number or tax ID # the representative as well as the "manager" became very hostile and condescending and started playing these long holding games on the phone. This behavior discredits them and leads one to be more leery of their professionalism, than helpful. By the way, this town has approximately 17,000 people/ 7,000 households/ 5,000 families and is 98% "non-minority", that means there are probably plenty "daddy-uncles" and most likely there is a headquarter to an anti-someone group located in the VILLAGE OF DEPEW in Erie County, NY. With that being said, I highly doubt Depew, NY is producing very many people who are in a position to be condescending to anyone. In a time where fraud runs rampant, I would expect a company that really wants to solve any financial debt to be more than happy to provide any information to prove its validity, so that the consumer may feel comfortable giving them any information requested. After contacting many state and governments agencies, I finally spoke to someone from the Minnesota Dept. of Commerce who verified that Everest Receivable Services were indeed a licensed collection agency.

Yes, ERS, you are welcome. You actually are a licensed collections agency.... since it seemed like you weren't sure yourself. You can go tell Maw and Paw you learned something new today.

Everest Receivable Services -- Received a call from a man on 10/1/13 telling me I owed $63 to a bank I used about 5 years ago. (This was an account closed in good standing, I was moving out of state and their bank was not in Florida at the time). I told the representative to email me something so that I have it in writing for my records and so that I could contact the bank and find out what the fee was for since he couldn't tell me anything more then that I owed $63. On 10/4/13 the same man called back trying to collect. I advised I hadn't received anything in writing and I wasn't going to give my credit card to them until I received some sort of bill or invoice. He proceeded to tell me "if you paid your bills, you wouldn't have to talk to me". I understand collection companies probably get the run around and talk to unfriendly people but I was nothing but respectful to him. Bottom line, shady company who are completely unprofessional!!

My husband has been receiving calls on his cell phone from this number. They were asking him to verify my address. He refused to tell them anything and finally told them to stop calling that number. I called the number myself and spoke with a man who asked for my SS number, birthdate, and other info. I don't give my SS number to anyone, especially not over the phone. When I shared this information with the representative and told him that until he answered some of my questions I would give him nothing. He hung up on me. My sister is an Assistant Attorney General. If ERS continues to harass my husband or me they will be reported.

About two days ago I received a call from everest revivable management. Still E.R.S no matter how they butter up their name its still the same b.s company. Claiming I owed a debt that has been legally removed from my credit profile by Lexington law. They wanted me to settle the debt for $ 335.91 it seems fishy to me that no actual communication was ever sent by their company other than a phone call no letters and no validation of debt. Explicitly for a debt that's 9+ years old I believe that this company is in clear violation of federal laws set forth by the F.T.C

Your first problem is dealing with Lexington law and paying them money.  They cannot legally get anything removed from your credit record.  That has to be done by the creditor.  So they probably sold your name to this criminal enterprise.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Sorry about that wolfman I called one of the credit reporting Bureau's and they told me that it dropped off due to the age. and they could track that account to see if it was sold or transferred according to equfax the account was not transferred or no record of it. I also called the attorney general of West Virginia and he told me to close my bank account immediately due to my debit card they pushed for he also told me it sounds to him like a scam or a company operating out side the law. and he told me that the debt was beyond the statutes of limitations and it is illegal to collect that debt in west Virginia I really don't know if that's true or not because I can't find any laws when it is beyond the statutes. On before I forget the debt they are trying to collect the credit card program was shut down years ago due to the company misleading consumers.

For you and anyone else that might need it the SOL by state:  http://www.nolo.com/legal-encyclopedia/statut ... hart-29941.html   the SOL in West Virginia is 10 years written contract which is what a credit card would be.  The SOL generally only applies to their right to sue you not to collect.  A quick exam of WV law says no action may be taken.  Not sure what they mean by that., but if the AG told you that they are not allowed to collect, then I would go with what he said because they are supposed to know the law in your state.  So if the account dropped off due to age, then the money you paid Lexington was for nothing.
