    It appears that people are learning their rights with respect to collection agencies. Robyn definitely knows her stuff. And the cavemen collectors who try to post here with their 3rd grade education are being schooled. Good job everyone!!!! This website is working!

    "Dredit Report"  was NOT a misspelling or a typo.  I was being facetious.  Someone as intellectually challenged as you should probably look up the definition.  

    You just hate it that you've been 'outed' for being the scammers that you are don't you?

    You buy out old credit card accounts that are past the statute of limitations and add a 'mystery payment' to the file to bring the account back within the SOL (illegal reaging) and then you hound, threaten and harrass people into sending you money!  What are you doing with that money?  Drugs?  Gambling?  Are you scamming and laundering money to help fund terrorism?  I hope not, that would be terribly shameful, stealing the hard earned money from innocent Americans to fund organizations that will use that money to kill other innocent Americans.   I hope your accountants are good at 'cooking' the books, maybe it will give you a chance to book outta dodge before the Fed's can figure it all out.  

    People like you (and I use the term 'people' lightly--you hardly qualify for human status) are nothing more than vermin that prays upon people you think are weak and easily intimidated.  

    So yes, I do feel that people like me - who know what sub-humans like you are all about - are obligated to helping the people YOU prey upon.  

    Hurts, doesn't it?  Maybe if people quit 'feeding' you, you'll shrivel up and disappear.  We can always hope............

    The suit MUST be filed either in the county where the contract was initiated (where you lived when you got the credit card) or in the county that you are now residing.

    If you have papers from a REAL court it will have the state, county and district of the court along with an address and phone numbers of the court.  If these court papers do NOT have this information on them.  THEY ARE FRAUDULENT!  Call YOUR county court - civil/small claims division AND the county that you resided in when you got the credit card and ask if you are a party to any legal actions.  (Some counties have this information lisyed on their county court web-site, you can see if you're a litigant, but you can't see the document...so you'd have to request then through the court.)

    IF you find anything you have a period of time inwhich you can 'answer' the summons.  If they have tried to sue you far from where you live and the papers were served to an address that is NOT yours, you can request the action be dismissed.  It doe NOT hurt to say that you do not believe this debt is yours, that they are giving you information over the phone that this debt is past the Statue of Limitations no matter whom it might belong to....  And that they REFUSE to send you any proof of this debt that they are trying to collect from you.

    In the meantime---write them a leeter and request any PROOF they have that this is your debt, any contracts, payments or legal documents (they won't send them - but if they take you to court the judge will MAKE them bring in the proof IF YOU ASK FOR IT!), tell them they cannot contact you except by mail and only with legal proof that this is your debt.  Send it Certified, Return Receipt (about 4 bucks) save a copy of the letter and the green card with the signature of the person at their address who had to sign for it.  DO NOT SIGN YOR LETTER.  They can use that signature to make phoney documents that they will use against you if they are given the chance.

    Oh, BTW, apparently my spelling is the only thing you have to 'dis' me.  

    You're spending way too much time being grammar police.  What's wrong?  Are you losing all of your victims because they know who and what you are so you don't have anyone left to scam?  

    Go change your 'company name' and start again...  We'll wait for you.

    I would not be too concerned with what names they give you on the phone...just make sure you record the call if you can.  Write down the time and date of the call and a basic (or detailed) account of what was said.  They probably think that by using ficticious names their harrassment can't be traced back to an individual.  It can be used against the agency though.

    They of course have told me that if they don't hear from me by 5 this evening they will be taking me to court.  I have to say they started off nice as pie and once I began questioning them they got rude.  There is not listing with the Attorney Gen in New York or the BBB for them.  They say to be lawyers but there is not record of them.  I understand that it is illegal for them to say they are lawyers when they are indead a third party collection agency. Am I right about this?

    Yes. It's illegal for anyone to impersonate an attorney or any other officer of the court. It's also illegal for them to make false threats, such as threatening to sue you when they aren't going to or threatening to have you arrested (which is an authority that no debt collector or law firm has.)

    It's a good bet that there will be no lawsuit filed against you after 5pm today. If I were you, I'd file complaints against them with federal and state law enforcement and I'd retain a consumer law professional and sue 'em for fun and profit:

    Report this attempt to extort money from you with the following agencies:

    1) The FBI at http://tips.fbi.gov or call the local FBI field office

    2) Your state's attorney general, the contact information for whom is at www.naag.org

    3) The Federal Trade Commission at https://rn.ftc.gov/pls/dod/wsolcq$.startup?Z_ORG_CODE=PU01

    I did file a complaint with the Att. Gen's Office in New York, when I told them they were claiming to be lawyers and they had sent my SS# over the internet they started the complaint for me right then and there.  Thanks for the info.

    It is not illegal for them to tell you they will take you to court if they actually have the intentions of doing so.  The only way it is illegal is if they never intend on doing it.  I used to do collections about 5 years ago when I was in college.  I wouldn't say its a good job but it paid the bills.

    I was contacted by a "Senior Legal Assistant" Jason Taylor from this "law firm" the beginning of March. He left a message on my answering machine that he had received a affidavit in regards to a possible law suit and he wanted me to contact him for a settlement. When I called back Mr. Taylor with my "case docket number" he asked me if I had received a summons from the Sheriff Dept. without telling me any other information. So of course I was skeptical about what he may be referring to. When I asked him what he was referring to he begin to tell me about a settlement that I needed to agree to with an account that never belonged to me. I asked him to send information regarding this account, which I know that once requested they are required by law to send within five days. I never received any information whatsoever. I contacted an attorney after this phone call and of course nothing was registered in any court in my county. The second conversation that I had with this "Senior Legal Assistant" he still would not give me any information and when I explained calmly that this account was not mine, he begin to call me a liar etc. If this "law firm" was a valid debt collecting agency they would of course send the information requested. I believe this agency uses old accounts, that may or may not be valid and uses scare tactics to try to collect any kind of money they can. After reading the forums it is great to know people will not and should not tolerate this kind of behavior. Hopefully they will get shut down. Of course I did order my 3 free credit reports and there were no adverse accounts on any of them which further proves this "law firm" is not a reputable establishment. I will also be checking into all the links that have been posted to report these people to as many agencies as possible and encourage everyone else to do the same.

    If anyone would like some interesting information about this kind of "law firm", do a Google search of "zombie debt collectors". Sounds exactly like what this "firm" is doing.

    When I reported them to the FTC that is what they told me also. They go after "zombie" debt and threaten and harass people to try and pay. The person who called us was Michael Taylor-he must be using a different first name now. Anyway, he is very nasty and abusive. He is to afraid to call us anymore because he knows we are on to his game and going to record his phone calls. There is nothing on our credit reports either. The debt he is trying to collect is from my husband and his ex wife from 1997. Funny, he tried to tell me the amount due is over $5k but that he would settle for $800. Michael tried to tell me this debt was just charged off in 2007-yeah right. It doesnt take 10 years to charge off a debt. I asked for the phone # to the original creditor and was told they dont have that information. He was very nice to me at first until he realized he was not getting any money from us then thats when the abuse started.
    He has also posted nasty things on here about my husband and myself, which I have printed and submitted to the Attorney General's office & US Marshal.

    Unfortunately, I would ahve to diagree. If you see my post from jan 14th, (my name is Kristin) they sent me the same letter and I thought i was doing the right thing by getting it "in writing" but then months alter their partner company, Marshall and Ziolkowski, started harrassing me again for the rest of the amount. When I told them about the letter they sent me saying all had been resolved, they simply said that I resolved the debt with THEM (being Maleno and Woods) but that the original debtor (which in my case was a gas company) was still entitled to collect the full amount... its sounded a like bunch of mess, and it IS! so i wouldn't trust the whole "written proof thing" at all.... thats just me. the other guy seems to know what he is talking about though.

    OMG!!! I have had the same thing happen to me. They have contacted everyone in my family trying to collect a debt that I supposely had since 2003 with Merchants Bank. They have even gone as far as to calling my ex husband telling him that he was secondary card holder and that he was responsible for the debt as well - mind you we were divorced for 3 years when this card was "supposely" opened.

    The gentleman calling me was Shane Healy at ext 103. I called him today and let him have it. I told him he was running a scam business and that he was nothing but a bully, etc... needless to say he HUNG UP on me... Some BIG SHOT ATTORNEY he is... LOL!!!!!

    Needless to say he wanted me to pay by check (over the phone) $800... These people are unbelievable....

    I have contacted my attorney and the next step is the FBI......

    How do these people get away with this?!!!!!!
