- anon replies to thanksOne more thing, pull your credit report if you feel this is not a valid debt, and if they have not provided you with a validation letter9which legally they HAVE to). it has all the info you may need about the last payment made...etc. Statute of limitations vary from state-to-state. The minute you pay them , it starts the SOL clock all over again and then, they CAN sue you. I do not condone consumers not taking resposibility for their debts, but sometimes life throws a curve and "things" happen to good people. There are very ethical debt collectors out there, but then there are those who break laws. And we are not talking about state law, we are talking FEDERAL law.

Then take a number behind all the other would-be attack dogs who cry foul every time someone's fraudulent business model is put at risk.
- Resident47 replies to CityDudeFind your state's civil court calendar. See all those actions listed? They'll say something like "Motion to attach wages", "Motion to charge garnishee", "Supplemental proceeding" ... it all means pipelines are being placed to drain assets like bank accounts and wages.
Now look at the plaintiffs. You should see a parade of medical creditors, junk debt buyers, and original creditors. Among the OCs will be familiar names: AmEx, BoA/FIA, Discover, GE Money Bank, and yes, Crap One. They're all card issuers, and they all sue to collect. Discover and Capital One are particularly trigger-happy with their lawsuits. Guess what, a lot of those junk debt cases, like Asset Acceptance, CACH, LVNV, and Portfolio Recovery, are also likely to come from card accounts.
Given the daily compound interest in those card contracts, these firms are well motivated to get a judge to make you bleed money. This is why getting wise to your rights as alleged debtors is so critical.
http://www.ftc.gov/os/statutes/fdcpajump.shtm - Lar replies to ............No problem and I will not disagree with your personal guarantee.
Unfortunately your guarantee is not sufficient to cause or should not ever be considered sufficient to cause ANYONE to pay ANY debt whatsoever.
The FTC has established the correct protocols for determining who owes whom, and it is a very narrow discription that doesnt include your guarantee. Sorry if they overlooked your valuable "personal guarantee". - aaa replies to Concernedconcerned...no IDIOT you missed the point,,if you cant get address or validation you don't have to pay the debt...FDCPA LAW..

- G H Cameron| 1 replyI got a call from a man named Mark Thompson (951-846-9194) who was looking for Immanuel Gonzales in regards to case #95839. Said it was a matter of importance because the timeline was short, only a couple of days. Left a number to call back: 888-236-7267. When I called that number, a woman named Michelle (switchboard company) answered the phone. Was very tight with her information, but told me Mark Thompson was a process server for Pacific Management Co. and was not at that number or location. I advised her that the phone number that Mark Thompson called was not valid, that I had had it for over 4 years and had received numerous calls for Manuel Gonzales, Immanuel Gonzales, and other associates. Advised her that Mark Thompson would have to find another number, as I have no idea who Immanuel Gonzales or any of his aliases and associates are.

- hooper replies to G H CameronMore or less this person(Gonzales) may have had that number years before you had it. This company calling you is a fraud, they picked up a dead debt and I am sure that was the number used (by Gonzales) when an account was created, either way, just ignore the calls.
- WATCH OUTRe: Anyone have Pacific Management Recovery collections?....06-02-2011 06:57 AM
I just pulled my Experian report and noticed that this company did an "illegal" hard pull on my Experian report. I neither have any collections that are upaid or any outstanding debt owed to any company. I have been reading plenty about this company....be careful!!
DO NOT PROVIDE ANY INFORMATION TO THEM. They are working out of a "warehouse" in California and move every other month. If they were a "legal" collection company they would be available on the phone, you call and the number is "not available".
I think this maybe another name for this company...BEWARE of them! - JKFirst of all, this place left a message for me on my brother's phone. Secondly, the person who answers the phone does not identify the "company" by name, instead he says only, "Where can I direct your call?" When I asked the name of where I called, the man on the other end evaded answering.
My best guess is that it is supposed to be a collection agency. If this was a legitimate collection agency, they would certainly identify themselves as such and would then ask for a case or client number as part of the process.- Caller: unknown
- KwCalled posing as local law enforcement..called ex-wife who lives in another state and has been divorced for 20 yrs...threatened lien, garnishment and court case...gave no info as to the debt and when I called back they got ugly when I asked for more info...told me they were A legal filing co. , Pacific Management Co. and the attorney I talked to the other day was Steven Thomas. I tried to tell them I talked to the person who answered the phone "Law enforcement" and that he never gave me his name...this guy argued with me and than when I said I was calling my lawyer he told me I should have already done that..So ...I called my chief of police and gave him the info and now he is handling it...

- Not falling for a scamI received a call from them yesterday saying he was from my Clerk of Courts! Mr. Brown was his name he said he lived in my area for over 2 yrs now and stll couldn't pronounce the name of mycounty correctly! He stated he had 2 failure to appear warrants for my arrest although I had never been served in the first place! I've never been in jail and never had a credit card and now all of a sudden I'm going to jail for one! I hope their a scam they said my total was $3115.19 but would settle right now for $300.00 paid directly bye debit card, yeah I didn't give it to them! The litigation attorney was Steven Thomas but the address when put in Google comes up in a shopping mall, and the name comes up as a rental management company buying/selling real estate from California!

- PantherI have notify Florida State Attorney Office to look into this matter.
- Sarah replies to Joe JuiceI work in the legal field and the funny thing is....I have had the lovely opportunity to work with this fraudulent company. BBB acutally has a point. I paid my debt more than 7 years ago but unfortunately I was a young college kid and didn't keep any records. This year I get a phone call from this "sleazy" company threatening to have me arrested for committing a federal fraud and stealing money from this credit card company. First of all, if they were a ligit practicing collection agency they would know they are breaking the law by making these threats, secondly, they cannot legally file a complaint against me because it is passed the statute of limitations in my state. My boss...who is actually my attorney spoke to this company when they called my cell. He told them to forward any complaints to his office and to contact him from this point on. They hung up and called me back a week later. Once you have retained an attorney the collection agency may not harrass you personally. So you may call us working class citizens scumbags, but I'm not dumb enough to pay money to a fraudulent company that I don't owe. :) Needless to say I'm reporting them to the attorney general in their state once they give in and give me their business address so I can "forward a payment" muwhaha

- Myss DixieI got a phone call from a Tony Padilla last week telling me that I owed on a default student loan and I was being sued for a little over $4,000. Then he told me they would settle for a little over $1,600, and after that, he told me that if I would get a pre-paid Wal-Mart card, he would settle for $500. He told me to get the card within the hour and I would have to have $250.00 on it by the 15th and then $250.00 more by the 1st of next month. I also had a call from someone that didn't give his name telling me to call this Tony Padilla to find out all of this, he said that he tried to serve me papers to and address that I lived at a little over 4 years ago...funny thing about that is, there is nothing at that address but grass, dirt, and trees. He also said that if he tried to serve me a third time and couldn't, then it would be a failure to appear. How could it be a failure to appear if I was never served with papers to appear? It's gotta be a scam...right?
