- Anonym| 3 repliesThis company called my parents trying to serve papers over the phone, my dad and i have the same name. My dad called me telling me to get a hold of this company, so I did....They ask for a case number then put some guy on the phone who refuses to give his name, location and just says over and over that they are a private company and do not have to disclose that information. I called the company to confirm the information he gave me and the company said to ignore them. I called back to the 800 number to tell them what the finance company told me and he kept saying over and over that he didnt care he'd just sue me in court and made rude comments to me, my brother, and my sister. He wanted me to settle out of court and pay him with my debit/credit card, I asked for the address, he couldnt provide one, I asked for his name he kept saying he already told me it, which he did NOT. He told me that he was KING and GOD and held my life in HIS hands he brought up my military career which i was honorably discharged after serving 10+ years, told me what kind of military person does this kind of thing, he threatened my sister to a "dual" said he would hit her in the face with a pair of white gloves and probably win, he insulted my brother with rude comments and continued to insult me as well...we all were just trying to get this guy to give an address so we could pay the debt off, he absolutely refused saying if I didnt pay him today with an electronic transfer he'd just take me to court, he said which is what he prefered to do.... I said I was going to report the company to the District att. office he wanted me to do a three way call, I didnt not do a three way call, but I am reporting them/him to all agencies possible. I would advise anyone else to do the same. If they cannot validate who they are, the debt you owe and how they came to be the company responsible for collecting the debt then its my opinion that they are a scam company....and have broken to many laws to list! oh and the guy I talked to both times...was the same guy trying to be two different guys...problem is he made the mistake of calling me BOSS the second time...caught in another lie.....

Was the debt yours? I bet it was. But these guys were so rude and unproffessional that Im not gonna pay them. Adda girl.... Look for any excuse you can to not pay your debt. Typical Americant!!!! Point made.
- educating replies to ConcernedThey were rude, yes and as far as running up a TON of debt not so much there buddy.....Also as far as not paying back the amount ...I tried, this company would not give me an address to do so...Which in my opinion makes this company sound like a scam, but I guess that will be for the attorney to find out, I have hired a lawyer to look into this company and also how this company broke numerous laws.
Having not payed them because they were soo rude wasnt the case, it was plain and simply this:

Make threatening comments
Show no proof of your part in the debt collection itself
Than, NO I am not going to pay you. Laws require that you state your company name, your name, the debt and the right amount, and with this company, they refused to do any..NO company name, NO caller name, and quoted three different amounts.
As to anyone else on here trying to find out what your rights are and what to do, read the list below if this company calles and does any of the following to you than you to should contact your district attorney's office. FDCPA is your best friend when researching what is acceptable and what isnt acceptable when it comes to these companies.
1.Calling you each and every day, one or more times, until the debt is paid;
2.Calling you or engaging you in telephone conversations repeatedly or continuously that are annoying, abusive, or harassing;
3.Contacting neighbors, friends, coworkers or other third parties about the debt;
4.Contacting your employer about the debt and divulging specific information about the debt itself;
5.Using threats of violence or other criminal means to harm you, your reputation or your property;
6.Calling you without making meaningful disclosure of their identity;
7.Threatening to put the debt on your credit report.
8.Representing or implying orally or in writing, that he or she is affiliated with the United States or any State;
9.Misrepresenting the character, amount, or legal status of any debt(eg lien, garnishment, etc);
10.Falsely representing or implying that he is an attorney or that any communication is from an attorney.
11.Representing that nonpayment of any debt will result in arrest, imprisonment or the seizure, garnishment, attachment, or sale of any property or wages.
12.Threatening to take any action that cannot legally be taken, or, that is not intended to be taken.
13.Representing or implying that the consumer committed any crime or other conduct in order to disgrace the consumer.
14.Communicated or threatened to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed
15.Threatening to garnish or attach your wages or property when it is illegal or not intended-whether or not your wages can be garnished and the amount or percentage are specifically covered in Federal Wage Garnishment Law or your State's Wage Garnishment Laws.
16.Threatening to throw you in jail;
17.Selling the debt to another company for the purposes of continuing collection on a debt that is considered to be outside of the statute of limitations or time barred;
18.Threatening any kind of legal action where that action is not actually intended, or threatening with humiliation; embarrassment, degradation or coercion, in order to secure payment from a debtor.
19.Contacting the Department of Homeland Security to apprise them of your alien status if you are an immigrant;
20.Threatening or invoking eviction, by an agent for a landlord; lockout, or seize personal property where such relief is limited by state law;
21.Deceptively misrepresenting that the collection agency has many employees or a dedicated investigations staff attempting to collect the debt, where this is not true;
22.Threatening or misleading a debtor by claiming they will be transferred to an attorney or separate legal department of a collection agency where no such department exists.
23.Sending letters, misrepresenting that the account has been transferred to an attorney and may include an attorney's letterhead with threats of legal action
24.Attempting to collect or file a suit for attorney's fees or collection costs and or other interest, including questionable “late fees”, not pre-agreed to in excess of that allowed by statute, unless the original agreement provides for the amount the collector is attempting to collect. For instance, the collector cannot threaten to add attorney's fees or his fees where it is not specified in the agreement you signed with the creditor.
25.Adding additional charges including attorney's fees and collection costs and demanding payment in full for these as well without disclosing that they are not part of the original debt.
26.A Debt Collector is not permitted to give legal advice unless the collector is an attorney himself, this includes correspondence with a debtor claiming that he or she is recommending litigation or advising a creditor to sue
27.An attorney cannot sue you in a state that is not your home state under the FDCPA.
28.It is a violation of the FDCPA to threaten to sue if no such action is intended, this is considered an empty threat. If the collector used an “if you don't pay by this date”, then ___ may happen” scenario, this could still be considered a violation of Fair Debt Law
29.Legal letters that are NOT reviewed by a lawyer constitute an FDCPA violation. It is a violation for such a letter to be sent unless the lawyer has reviewed it, thus you may have a claim under the FDCPA if the letter was not reviewed and you can indeed prove this.

I have entered all of them yahoo search and the same forums come up time and time again, this company is a scam. Everything you have read on here from real people you will read almost the same claims on the other sites as well. DO NOT give these people your financial information! Its a scam!!

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren’t; or
indicate that papers they send to you aren’t legal forms if they are.
Debt collectors also are prohibited from saying that:
you will be arrested if you don’t pay your debt;
they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action.
Debt collectors may not:
give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn’t; or
use a false company name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can’t prove that you suffered actual damages. You also can be reimbursed for your attorney’s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector’s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.
Report any problems you have with a debt collector to your state Attorney General’s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General’s office can help you determine your rights under your state’s law

Attorney General Sues Agency for Debt Collection Abuses
TALLAHASSEE - Attorney General Charlie Crist today filed suit against a Jacksonville-based collections agency and its owner over allegations they repeatedly threatened consumers and imposed illegal fees for owed debts. Ellis Crosby & Associates, Inc., and Ted Ellis Crosby are charged with victimizing more than 120 consumers through multiple violations of the federal Fair Debt Collection Practices Act and Florida's Consumer Collections Practices Act.
The investigation was initiated when the Attorney General's Economic Crimes Division received numerous complaints about the collections agency from the Better Business Bureau. The complaints alleged that the company was using aggressive and illegal tactics to collect on its accounts, including posing as law enforcement officers or attorneys, threatening arrest by military police and collecting illegal fees greater than the original amount owed. Several complaints even alleged that individuals with the company represented themselves as lawyers with the Attorney General's Office.
"Few words could adequately describe the appalling nature of the tactics used against these citizens," said Crist. "People facing the pressure of paying a debt should not also endure fabricated threats and intimidation. The predatory nature of these actions demands our immediate attention, and the victims deserve immediate relief from these attacks."
Further investigation by the Attorney General's Office revealed that Crosby, 27, of Ponte Vedra, specifically trained and instructed his employees to use the malicious tactics. Among the victims was Anna Massey of Jacksonville, who was contacted by an employee of Ellis Crosby claiming to have a videotape of her husband cashing a bad check. The company told Mrs. Massey that the police were on their way to her home to arrest her husband Billy. Although Mr. Massey tried to explain to the company that he was not the individual with the debt, the company continued to harass him and his wife, demanding personal identification information and immediate payment of the debt. The intimidation tactics stopped only when Mr. Massey threatened to contact authorities.
The Florida-based company also targeted victims in other states. Chris Williams of Ohio was contacted by the company regarding a payday loan of $200, demanding immediate payment of $989.42. The company threatened arrest if the payment was not received, informing Ms. Williams - who was eight months pregnant at the time - that she should know "they don't give very good prenatal care in jail." Unable to confirm that the payment she sent had been received, Ms. Williams was afraid to go home for fear of being arrested. Eventually she spoke with local police and determined that there was no warrant for her arrest.
To date, the Attorney General's Office has received more than 120 complaints about the company, and more complaints continue to come in on a regular basis. Because the company is continuing its improper practices, the Attorney General's Office is seeking an expedited hearing to impose an immediate temporary injunction to halt the unlawful activity.

Not realizing that this family member has been practicing consumer law for over 25 years, but even dumber, they left a message on her voicemail disclosing 3rd party info about a bogus lawsuit! ON HER VOICEMAIL!!! PROOF. When we called back and confronted the agent with this information, the person who took the call denied the company did such things as reveal lawsuit/subpoena information..we replayed the vmail. Needless to say, he was speechless. Then I asked if they were recording this call. He said no. Any legitimate debt collector will record every single call they make for THEIR protection. we advised them that we were recording the call and asked my sister/lawyer(while he was still on the phone) just how many laws they had broken so far, and she said too many to even count. We let him know, not only have they divulge the lawsuit/subpoena informatin to a third party, they never sent a validation of the debt, they NEVER contacted me first in anyway., and the debt WAS NOT VALID. It was a debt that had been PAID. It once went to collections about 3 years ago and was PAID in FULL!!! This is a tactic to embarrass and scare consumers who do not know their rights according to the FDCPA(Fair Debt Collection Practice ACT). I was lucky enough to know someone who can protect me, but I know not everyone has that luxury,. All I can say is that these people break many laws. Make sure to know your rights(i.e. statue of limitations in your state). While they do have the right to call you or a family member and try to collect on a VALID debt, they can only ask that family member certain information or leave their number and have you call back. These guys are going far beyond ethical collection practices. And be aware, the comments made on these sites about "Just pay your bills and you wan't have to worry about it" are from these companies themselves, they have people monitor their 800#s online to make such condescending comments.
