i got the same deal for the Acai Berry.  The company representitive swears that the auto shipment terms were outlined in the free sample pitch, but I looked for it and never found it.  The credit card company fraud division cannot do anything and the company will not accept a return of the product.  The free sample consisted of a three day supply!
And I am on the hook for a $74.95 bottle of crap

I just went on line to the pureacaiberries.com to unsubcribe my membership.
I put in my e-mail address  and hit unsubsribe and it came up and said there was no acct for the e-mail address. So if there is no membership, how come I received another bottle the acai berries in the mail today? Something is very wrong here! I was told last week that they would credit my acct for amt they charged but so far they have not done that.  I wish someone could stop these people. The toll free number 1-888-289-8740 usually says there is a 45 minute wait and to contact them at www:gohealthnow.com No luck there either.  They need to be stopped.  Turn them into the BBB!

I did not get a call, but fell for some "pay only shipping and handling" scam for Acai Berry samples.  They got my bank card # from the $1.87 shipping charge, and today..... I have a new charge for $79.76!!!!  It is currently pending at my bank, bank will not do anything until it has been processed and then I can submit a Fraud Claim through the bank.  They will reimburse my $79.76 in my account and then THEY will go after the scammers.  Honestly, why do you have to be sooooo careful of the innocent things - never thought I'd be caught in something like this!!

I contacted this phone #on a sample products I order online for $3.87 each.  the next thing I know my checking account has been debited $74.76 without my permission.  customer rep told me to send the product back within 30days by 9/14/08 and they will credit my account, well in good faith I returned product on 8/27/08 to find out that was only a sample bottle, the bottle they told me to returned by 9/14/08 was just mailed out to me and I received it on 9/12/08,  what a scam!  I sent an email to them and they responded saying there is no record of them receiving product so there can not be a credit to me on my account if they do not get product by 9/14/08.  I sent the bottle back certified on 9/12/08 with a ugly email to them about contacting my lawyer and have not heard any more from them. I ordered this product online.

what can I do about this?  do we have any rights?

I also fell for this scam. I ordered a trial sample from this same company with the same phone number, with no avail. No one will answer the call. They are also charging my Visa card with this 74.95 monthly charge. The sad part about it is that I can't stop them from during it. So if any of you have found a way out of this situation, please share it with the rest of us. Hurting in Florida.

Many people find it hard to cancel from this company. It was not hard for me. This is to help you. If you go to PureAcaiBerries.com the links that you are looking for is on the bottom of the page.  You can Unsubscribe, by clicking on Unsubscribe. You can unsubscribe from the newsletter by clicking on Unsubscribe Newsletter.  You can also click on Terms and Conditions at the bottom of the page where it was agreed to send you the product.  I would suggest anyone ordering a free sample to read the terms and conditions.  Also as I understand it, there is a 30 day return policy. There is also a Contact link to send your message to cancel at the bottom of the page. In terms and conditions there is even a telephone # to call.  Reduce your frustration and just use the links at the bottom of the page.  As you can see, there is information if you can get to the website.

My name is John. Some of you may know me I used to work at this company I was fired. I was fired because I was issuing credits to people just like you.
This company is so corrupt that it steals from the elderly, the blind, crippled, and from children. This company must be stopped.
I know how to get your money back!!!!!!
There is a way that you "the customer" can receive a refund!!!! No matter how long ago this happened to you!!!
Have you ever asked to speak with Sue? She is the supervisor. No only that she is also a part owner in this multimillion dollar business. Would you like to know what all the employees, including Sue's real names are?
    I know....
How about the owners? Or the location of the company?
But most all I'm sure you want to know what you can do to get your money back!!!!
Send me an email, I will tell you what you need to know.

I ordered the free sample of Acai Berry for $4.87. The day after I received it, I was also charged $74.76 even though I called to cancel any other autoship stuff. I was given a cancel # and told I would not be charged. They lied because I had been charged. They told me to send product back by certain date to receive a refund. I had to wait a few more days before I actually got product to return! I sent it delivery confirmation so I know they received my return. Now they say my credit is being processed, but could take 45 days! I guess they are swimming in returns since they have scammed so many people! Their customer service is crap too - they tell you to go to www.gohelp.com but there is no such website. I had to call several times to get this far and I will not give up till I get my full money back. After all this, I see today on my bank account they have authorized another $5.87 - under a different company name (green Co products?) but same phone #. I guess I'll have to hound them about this!

no call was made, just a charge of $74.76 on my account on 09/16/2008. I didn't have clue who or what this was, I was given the number, called and a voice on line said there was a 45 minute wait for the next avaible rep.
My bank also said that if dispute this charge, here are the steps you take. I am in process of this dispute as i am tryping the information. The charge came under Henderson Perfomrance and then the number listed.

I also became part of this scam by ordering a "sample" for shipping charges.  They then charged my credit card $74.76. Go to http//acai.secure9.com   Click on contact & cancellation links at the bottom of the page and enter your email address. I received an immediate response by email with a cancellation #.  I also notified my credit card company not to accept any charges from nvperformancehealth.  Let me know if this works for you.
