- FedupI live on Social Security. I have a car payment and one credit card. I live within my means even if it means going without. The credit card was for tires for the car. Why do these people call constantly? Nothing I owe has anything to do with them.

In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antimeridian (AM) and before 9 o'clock postmeridian (PM), local time at the consumer's location."
Section 806-5 talks about "causing a telephone to ring....repeatedly....with intent to annoy, abuse, or harass any person at the called number".
Google Fair Debt Collection Practices Act. It's interesting reading. The consumer has many rights which he debt collectors ignore. I haven't submitted any claims against them because I have never answered the phone when they call, but if you have spoken with someone there, you have legal recourse against them. - Mrs HThey called twice this AM, 8 and again at 9. - GrumpaTwo calls today, one at 8:30 AM and one at 3:30 PM. I looked here and saw that the call had indeed come from "Midland Credit Management". I called the number back and indeed they answered as Midland Credit Management. The woman answering (sounded either Hispanic or Pilipino) asked for a "case number"; I said I had no debts and therefore no case number and asked why they were calling. She said (after I gave my phone number and name) that they were looking for XXX. I informed them that XXX did not live here, never lived here. said she would "put it down as a wrong number" and we would have "no more calls after 24 hours". I said I didn't want any more calls period, as in never. A few years ago I went through this (other collection agencies) because a person YYY fraudulently claimed our home phone number (she never lived here); I have found that if I'm civil to these folks they don't call back. Just like you an me, these folks can do a reverse lookup from the caller ID and find your name, so if you call them there's no sense in pretending you're someone else. We'll see how it goes.

- MelissafromClevelandMidland Credit has called our house from several different 888 numbers, trying to collect debts for people who don't even live here. They consistently call at around 8:30am every day, so they get as close to that legal boundary of 8:00am as humanly possible. We blocked each 888 number they've used, as our provider allows us to block up to 60 (I think) numbers.
