    I had taken out a loan with Cash call and had made my payments as I agreed till I got sick and was not able to for several months. By this time I had already paid well more then I borrowed and never avoided the calls and would tell them my situation and asked if they would work with me but could they please call me after work so I could talk. They continued to call before 8a.m. all during the day even after I spoke with them. And their help they offered was no help they simple said stop paying your other bills and pay us like you agreed. The call got more and more abusive and rude calling my work and asking my co worker if the dead beat that is not paying his bills is in. I then had to go speak to a lawyer who sent them a Cease and desist letter that they claimed they did not receive the first four times it was sent. They also claimed they don't deal with any third parties as they are an Indian company and do not have to follow the laws of the US. The call continued at my home, Cell and work. The work calls stopped once they were routed to the legal department at my office and the Cell calls stopped once I changed my number. The house calls didn't and each time they would act as if they didn't know how my number was called since they have the letter but since they had me on the phone how would I like to pay them. I would tell them it is not legal for you to call and the agent (same guy every time) simply said I didn't call your cell so you really can't prove we called at all. I informed him that my phone is digital and gets a log on my computer so I do have the proof he requested I send him this proof along with the money I owe them. It has been two weeks since the last call and now this Delbert services corporation calls me 8 times before 10:00 am. When I was free I called them back and asked who they are and why were they calling me?  They replied we are the collection company for Cash Call. I informed them my lawyer has sent them a Cease and desist letter and that we were already filing for FDCPA violations and that ...She cut me off and said we don't have no letter and she didn't know what I was talking about so how would I like to set up payment today I hung up. The next call the women was a little nicer and claimed no partnership with cash call at all but she would talk to her manager to have the calls stop but they haven't.

    This call is for my ex-husband's daughter, he is deceased and we were divorced so I have no connection to her whatsoever. I don't know how to make them stop calling. I just told the caller they had the wrong number. Next time I am going to tell them she is deceased, is it legal to do that?

    You are asking a specific legal question that concerns the application of law to your particular situation.  The answer to that isn't going to come from free anonymous advice given by a blogger or participant in an Internet discussion board.  It is going to have to come from an attorney licensed to practice law in your jurisdiction.

    Contact your local state bar association for a referral, or if there is a college legal clinic available in your area, you may be able to get the help of a law student supervised by a licensed attorney.

    Hello........they can't take you to jail.  A judgment means they can garnish you wages. If a letter comes to you or if on the phone they threaten you with Jail, call your states attorney general or the FTC because this is totally false and illegal. The worst that can happen is you get served with papers and have to go to court if you want to fight the judgment.

    Falsely claiming your estranged daughter is dead is both inadvisable and a rather foolish way to approach a nuisance caller. Given the caliber of debt collection agency under scrutiny here, this is the scenario I project:

    - Delbert knows perfectly well how to reach this girl but has chosen to skip trace everyone she ever breathed upon, hoping to create shame and disgrace which will prompt payment. (This ruse distorts an FDCPA provision and is something I consider illegal.)
    - Your merely claiming "wrong number" is not the same as demanding "stop calling". The rogue collector hears "not me" and assumes you are a liar, making it barely legal to keep calling you until you give up either money or an answer which leads to payment.
    - It will not be hard for the agency to confirm or deny your claim that "she's dead", and you already know what happens when you're caught lying.

    My long advice for "not me" cases is linked below. You must dump this problem on Delbert's stoop, and you don't need to tell lies or hire a lawyer to hold your hand as you take steps to silence your phones.

    You should clean up nicely on that pile of FDCPA violations these goons handed you. Not sure why you needed four cease-comms when one sent USPS Certified with return card would do. Well, it only makes them look worse for ignoring those and your various prior instructions and what behavior the law restricts them to by default.

    Oh, and there should not have been a "next call" to you the moment Delbert was informed you have legal counsel. I could go on, but the laws and related discussion are right there on the CFPB and FTC sites for your review.

    I too had a western sky/cash call loan.  I will not pay them more than the $1000 they put into my account.  I ignored their calls for 6 months and now was "transferred" to Delbert Services.  I told the lady that called me that their recording system is the same, they call from 1000s of different numbers like Cash Call, and if you look at their mailing address its both being sent to Anaheim, Ca.  Also, they had detailed notes as to whom I talked to before and etc.

    Cash Call is the thief here... the astronomical interest rates they charge should be illegal.  I had one loan with them for $500 and paid back over $2000.  So they are the real criminals here you sanctimonious [***].

    I 'm reply to this information regarding the above # that show up on my bank account as a debit.  I did not know who they were and I called the #888-400-7750 to verify who it was and found out that the account was being handle by Dilbert a collection agency. Since I reply to these mob criminals my mom car was hit a car came from out of know where and hit her car.  How strange! Life is short if you are legal you have nothing to worry about. 500% on 2500.00 I taking care of the have nots.  If I spending this kind of money I can write any comment I want about your company.

    Please contact a lawyer they might be able to investigate maybe they will find some illegal anti-trusted violations within this organization. It seems to me that the percentage ratio on lending is not for the everyday borrower knowing that the risk of payment and loan being paid-off 1 in 99.

    the problem is you signed a contract with the 99% interest rate that is what you are held liable for. IF you didnt want the loan then you shouldnt of agreed to the high interest rate, and with loans like this the 7 years doesnt apply, they can now file against anything you own, take from your paychecks and hold any federal income returns.

    And there are laws in place to protect people against predatory loans.  If the loans are above board, then they could easily sue in a state court and not need to make illegal threats.  People are required to pay only the principle on these loans.  

    People have all kinds of protections, much like any business.  

    The fact is, these loans are illegal and unenforceable.  Nobody should pay them.  End of story.

    I forgot, the statute of limitations does indeed apply to these loans, like any other.  In addition, they can't file against anyone as the terms of the loans are illegal in every state - if they could file they would.  And if they were to file, and somehow win, they MAY be able to garnish your wages depending on state laws and they certainly cannot hold your federal tax returns or take unsecured property - and an individual could always declare bankruptcy and then Western Sky, Cash Call and Delbert would be out the money plus whatever they put into the suit.  

    But none of that is going to happen because they can't file against anyone.

    They can't arrest you but they can sue you for account balance,court costs ,attorney fee's and interest of 10%. So you should set an arrangement with them. Its ALOT CHEAPER.

    Not Western Sky.  They are Indians whose loans are even illegal on their own reservation.  It's great to hear all the Cash Call employees lash out on this board because you are just a few steps away from receiving collection call yourself, as soon as you get fired.  The only thing, unfortunately, is that you won't be getting your own medicine because any legit company does not talk to their customers the way all the CashCall employee scum bags talk to theirs.

    If the loan was from Western Sky, nothing can happen to the customer. I don't think people had problems with the loans but it just sort of popped into their heads as soon as they were treated by the likes of the Cash employees such as Miss Ong. I hope she got breast cancer or is dead by now!
