- CWG40 replies to Sabrina| 3 repliesDon't return the call. See the other notes. Clear possibility of some sort of debt scamming where they try to intimidate you into paying them something. Use scare tactics and the rest of it. Ignore them and block their calls.
Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a DIME until the debt is validated.
Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.
If they are bothering you,

- Office-AdminReceived a call from 864-416-3741 (local spoofed number). Didn't answer - They left a robo message with this (888 735 4983) call back number. The message said they are looking for (then no name... pause) and to call back the number. This is a business, no name, can't help them.

- Ruby BReceived a message from (?) Sean Waters (?) requesting a call-back at 888-735-4983 x 222 and to reference File #4158750. He did not leave a company name on my answering machine but said it had to do with "a civil matter" about "assets and liability" and my phone number.
Reading previous comments, it does appear to be a debt collection service which is ridiculous. My credit rating is excellent and I have never even had a late charge on any account.
Obviously, I didn't call back. BTW, don't these clowns realize that excessive ambient noise in the background is a dead giveaway that it's a boiler room operation and, almost always a scam?- Call type: Debt collector
- Ruby BA few hours later, I received a 2nd message from 888-735-4983. The caller left no name but said he was from Empire Resolutions and needed a call back today. He said there was a problem we might not be aware of and to call and straighten things out.
This guy's diction was a great improvement over that of "Sean Waters" who really sounded like a mushmouth. This guy had the smarts to keep background noise to a minimum. Again, I won't call back nor will I pick up when they call.- Caller: Empire Resolution

- MelissaAnother moronic fake debt collector that thought he was going to intimidate me until I flipped out on him. Not 2 minutes before I got one of those "windows tech support" calls so wasn't in a good mood to begin with. Managed to shut him down pretty quickly when I copped an attitude and flipped the rude routine around on him. All he said was "good luck" and hung up lol.

- Barry S replies to CWG40| 2 repliesI demanded they provided me proof of this matter and I received a letter promptly by email, they also sent me one thru the regular mail, which I received with in a few days. This company is legit as far as i can tell.
- qwerty replies to unknownRiiiggghhhttt... sure they're legit. That's why there are three pages of complaints from people who do not owe.
You get a "shill alert" for your post. - GateKeeper replies to unknownAll debt collectors are required by law to send you a DEBT VALIDATION. This is sent through the USPS ONLY (email, text, faxes, carrier pigeons, smoke signals...none of those count) and state when you incurred the debt, to whom you owe the original debt, and how to proceed should you not recognize the amount.
REAL DEBT COLLECTORS SEND THIS. Scammers do not.
A few other things to know-
-You cannot be arrested for ordinary debt in the United States.
-Process servers do not call in advance. They only get paid if they deliver you papers the court (not a private company) has ordered be delivered, and if you flee, they don't get paid. Therefore, they do not call ahead of their arrival.
-Likewise, officers do not call you to tell you they will be arresting you. Why would they?

This link contains all the rules debt collectors must follow, and includes links where you can report criminals who choose not to follow the law. - Nope replies to Barry SEmail is not acceptable - per federal law, that information must be sent via USPS snail mail. Nice try, no cigar!
- Tamianth replies to Barry SNeither phone,fax,text or email are valid proof of a debt owed!
Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall* ) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor." - Tamianth replies to unknownSo how about giving us the rest of the info on this so called great company there! Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
