- DH from Chicago| 4 repliesOddly enough, I received a call from this company as well, the Federal Legislative Department at the return number, 888-785-4479. I spoke with a Raymond Scott, who, like many of you, refused to send any documentation as to the payday loan he stated that I was in default of. I stated to him several times that I would pay, if I was truly in default, but I needed documentation of this debt; and repeatedly, he refused unless I provide my payment information. He also stated that I was being charged with 3 crimes unless I pay this debt. But again, would not provide any information. He provided me with my personal info, but would not give me any additional info in regards to which Pay Day Loan company the loan was received under. I told him that I would not give him any documentation without documentation, which he again refused to send even after he again asked the question if I was aware of this debt. After getting off the phone with him, I called the FTC and reported the call. The lady I spoke with stated that she was almost positive that this was a scam company and to document if they called anymore.

Getting call plenty of times in couple of minutes,Yes why? Because its very panicky if a person is taking a loan & not paying back moreover blaming the loan company cant even resist, if you guys are so sure that you haven't taken any loan,why you all are afraid to deal this in Legal way.

I was told that I "STOLE" money from a payday loan place and that when they tried to collect funds I didn't have the money. I was also informed that they tried to contact me via email? Who does that? If you're collecting money because I owe you, wouldn't you send me a notice in writing?
When I told the guy on the phone that I would like documentation indicating that I owe money, he got upset and started raising his voice and insisted I hire an attorney. I proceed to tell him that I want something in "Black and White" before I resolve anything. He then hung up on me.
I then called back and he immediately knew it was me. I asked why did he hang up on me and he said that there was nothing to discuss and that I needed an attorney.
I looked up this number and found this post. I'm glad that I'm not crazy and that someone else can share my pain. I also called the FTC and filed a complaint. - KM| 2 repliesHello I have recieved a call today from these same people who told me that I owe them somewhere around $700. Then I asked them to show me documentation, they said we can't send documentation to anyone but my lawyer. So I called a lwayer, the lawyer said that by law they have to send you documention when asked within 5 days. Mr. Robert You asked why want we take it to court, because you can't take someone to court who is nowhere to be found and will not give you any information. If I don't send them any money, then if they are legit they will take me to court,that is if they are legite and we will deal with it there.

- Veronica| 2 repliesI just received the same call from Peter Brown and Mr Smith...both very foreign accents stating I owe on a payday loan...they called 22 times in a row and said they would keep calling until I lost my job. Surely sounds like a scam but he gave me a number 888-785-4479. Very aggravating and will only be settled in court. They had all of my personal information. And are attempting to fill up my work voice mail with empty messages. Wat can I do?

- This Just In...Consumer Alert: Attorney General warns Kansans of debt collection scam
January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers. Consumers are warned to not submit payments to these fraudulent debt collectors.
When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid. Consumers state they have never obtained such a loan or paid off the loan years ago. The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names. It appears the phone numbers used by the scammers are “spoofed” numbers, so that the number appearing on a consumer’s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.
When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent. These scammers have been able to provide consumers with identifying information, such as the consumer’s social security number, home address, e-mail address, names of family members and the consumer’s computer IP address. Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.
If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court. Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union. The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as “We’re filing an affidavit against you” or by stating a lawsuit has been or is in the process of being filed against the consumer.
A hallmark of each scam has been calling consumers repeatedly at their place of employment. This scam hit home when an employee of the Kansas Attorney General’s Office was repeatedly called both on her cell phone and at work. Despite the employee’s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an “officer”.
“I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ‘If that’s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming’,” stated the employee.
“It is important for consumers to know their rights under the law,” Attorney General Six said. “If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.”
Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact. The notification should contain information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer’s arrest, or using the threat of violence.

this is a scam they will not identify themselves and also i kinda asked to say if the debt is more than 2000 and they said yes and hung up well i dont know about other states but the max you can get in az for a paydayloan is 500 so they are not fooling me dont let them fool you please be aware do not give them your info....- Caller: unknown

As promised in my earlier phone call, if you continue your repeated calls and threats, I can only wish you and your family luck. - IsobelI was contacted by someone, asking me by my name, from the Rosenberg law, on a matter regarding criminal/ fraud by my nephews wife. He represented himself as a federal investigator, saying he was given my number as a reference. He said he could not contact her directly, as her number was no longer
active. He said she was accused of a federal crime, and did I know how to get a hold of her.
I would assume that the things he was talking about would come from the police, or of that line.
He stated he just wanted to clear things up, and that if I could tell him what number she had or where
she was, to please contact him.
What is this? - Karen Snyder| 2 repliesI keep receiving calls at work from this person he says his name is David and he works for Morgan & Associates out of Fort Lauderdale FL he said I had 3 charges against me including fraud for a payday loan and I asked him for the number of the payday company and phone number so I could contact them myself and get proof that I owed this money I told him I had rights and he told me I had no rights and that they have sent me e-mails and letters to my home I have not received anything. Last week they called and everytime I asked for something in writing he said no and kept hanging up on me said I was not making any since that I have no rights. He told me I better get a lawyer. Everytime they hung up on me I would call back see how they like it. Not sure who they are would like to know if anyone knows who they really are I have never had a collector hang up on me.

- Jennifer weislerI received a call from the above stated number while i was proctoring an exam. An admisitrated said it was an emergency and she would take over while I returned the call. Not recognizing the number i said i didnt know who it was. I am in a debt consolidation program paying back the loans. They would not identify themselves, threatened me saying I needed a lawyer to call as soon as possible and said they wouldnt stop and not be responsilble if i lost my job.

- Another Person Being HarassedI just received a voicemail from a woman who I could NOT understand her accent was so heavy. She told me that I better call her back or she would contact my relatives and my job. I could not understand anything she said and quite frankly if I don't get verification of it or what they say I owe I am going to report them to the FTC.

- joann replies to SICK OF THISdo like I did. call them and tell them the next time they call, you are gonna call the sheriff's dept. who has the ability to trace phone number and they will be at their doorstep with a warrant. it is illegal to call your place of employment. they did it with me, apparently for weeks they've been calling. I just found out last night. called sheriff's dept. immediately. they said to file a complaint online which I will do tonight. was trying to get more info before I did. by the way "jason" as he called himself also got very angry when my co-worker said I wasn't there and that she was not at liberty to give my schedule out. he said are you sure she's not there and hung up. called about 12x last night. funny, I never received any letters from this guy or attempts to call me at home. by the way it is also illegal for them to call you after 8pm. legit places know this.

I did call the sheriff's dept. and have filed a complaint. it is also being submitted in writing tonight when I get to work. somehow, I get the impression you either work with them or for them or you'd know all this

IT IS FREE OF CHARGE. I don't see anybody's supervisor not willing to go for it.

I have recieved over 26 calls today , and 2 vm regarding a crime I committed and that if I didn't respond in a timely fashion that they had the rights provided by me to contact my family and employer and give them the full details of my case. Also they said they would be proceedeing with filing an affidavit in my states courthouse. I called back and spoke with a Henry and asked what this pertained to he asked my name which I gave to him he asked for other information which i refused to provide until he could tell me what this was in regards to or least which company they represent. He refused so I asked for them to issue a verbal cease and desist and provide me with and address to send a written C& D. He said "why don't you want to pay are you ashamed?". I told him that I refuse to pay anything until I know what this is about. I asked if it was in regards to a debt to send written validation notice if it was. He stated he could not do so and hung up. I called again and spoke to the same person and asked for thier address he hung up on me again. I called a 3rd time and asked to speak to a manager the Guy named henry anwsered again and said he was one, I asked for thier correspondance address and that I wanted to the file a cease and desist he said he didn't know how and I asked if he even knew what I was talking about and he said no. Less than an hour later they called again I was at parent teacher conferance and told my son to pick up my cell it was them again, my son said I wasn't available and the lady named veronica told my 11 yr old son I was a coward.
I am a collector for Citi Card services I know my rights, and asa collector don't employ those practices. It is illegal for a debt collector to contact an individual more than 6 times per day and it has to be in the hours of 8-pm local time. If contact is made by either party iniating contact than the collector can not call more than every 2 days. A message left for a debtor via messages or 3rd partys other than the spouse can not have any personal information. If a message is left this counts towards the amount of times contact can be made. By law they can not leave more than 1 vm per week.
If a debtor request a do not call a verbal indicator must be placed on the account and recognized for 24 hrs a cease and desist must be sent in and has to be honored within thirty days. if the debot request validation of the debt it must be provdied by the creditor or collector within 5 days of the request.
It is also illegal for any collection agency to say they represent a goverment agency or are an attorney. It is illegal to state that you will have your credit destroyed, or indicate you commited a crime or threaten legal action.
After I recieved my 8th call today day I explained to Veronica that she was in violation of more than several of the Fair Dect Act policys she hung up. She called over 15 more times and left a message that she had an officer on the line and had filed chages against me in court.
I called all of the court house her in my state and verified that I have absolutely no charges nor cases pending against me.
I called my police department to report harrassment. An officer came out and I explained what had been goping on he then called the company back and asked for thier legal department and was hung up on even thou he said he represented a law enforcement agency. he made several more calls until he spoke with robert who said they represent a payday loan agency, and I called him back they could help resolve the matter. I called him back with the officer in my home.
he told me who they were but not thier client said I had a debt but would not give the amount owed. Asked for pm I asked him to send me verification of this so called ebt as I had been a victum of ID theft, he said he was unable to and why I couldn't pay. I told him I wanted to make sure that the debt was mine. I asked again for proof and he said he would send an affidavit only to my attorney. I told him that they were harrasing me and I would report them to the FTc he said he wasnt a collecter and hung up.
The officer said I cant press charges but have authority to proceed in a cival suit, also he provded me with an report number. I contacted the FTC and made a report. I will indeed contact an attorney as they have continued to harass my employer and family.- Caller: unknown
