- KT| 1 replyI checked my court record and found that back in 2007 they supposedly took me to court. I never appeared because I didn't know about it. They placed a judgement in my name for $702.50. They won because I didn't appear. How could I appear if I didn't know? Anyways this has never turned into a garnishment, why not? How can I find out who the original creditor was. I don't believe I owed anybody anything. Who are they a debt collector for?

- BigA replies to KTWell you would have to contact them to find out who the original creditor was, but in doing that you might wake up a sleeping dog. You need to find out first if that judgement needs to be renewed and if so within what time frame. Some states have rules for that, but I don't know which state you live in so it would be best for you to do the research. If the judgement is still good, and you truly did not get served properly, you would have a case against them but you would need to find a lawyer in your area to discuss it. This is a pretty common occurrence where the debt collector fails to properly serve the defendant so that they do not show up and a default judgement is entered. If the judgement has expired, it is up to you whether you want to pursue it. It might not be worth the time and effort unless it is affecting you credit rating or your ability to obtain employment. These are questions a local attorney who specialized in consumer law can answer. Many times the initial consultation is free. There may be other organizations in your are that can help also, so I would start looking right away.

- MG replies to Brenda ParedesI can't find any working numbers for them. I have tried several. I have a judgement on my credit report that has been there since 2009. I am trying to negotiate but the Lawyer that sued me on their behalf told me he thinks they are out of business. They too gave me the same number that I have already tried. I have done a lot of research. Many states shows their licence is revoked, expired, or cancel. I'm at a deadend and my only option is to hire a lawyer.

All correspondence with them should be via US mail, certified, return receipt, just as Alfalfa said. You cannot prove that they received an e mail, and it can be deleted just as easily as Hillary's and the IRS missing e mails. But they will have a very hard time saying they signed for something delivered by the post office.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
