Number has called multiple times claiming they are Johnson Smith and Associates. I have had this before from a different number claiming they were lawyers hired to collect a debt. It was a complete scam and I had to file a police report. I also lost a lot of money in the process.

The problem is that not enough people are reporting them to the proper agencies that can get their actual address and do something about it.

JOHNSON, SMITH & ASSOCIATES AKA JS&A

Website says they are in Massachusetts:  http://jsmithassociates.com/index.htm
Website was created in March of 2017 according to Whois.
The BBB has no page on them under that name
The address is a UPS store, but another criminal debt collector by the name of Receivable Management Corporation aka RMC is listed at that address with a “suite” number
They are not registered under that name with the Massachusetts Dept. of State or registered as a debt collection agency, which legally preclude them from doing business.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

Was told their company name is Johnson and Smith. They want me to send them 700.00 plus dollars to clear up an old debt from 2007. I was actually going to send it at the end of this month until I read this page that states this is a scam.

Any time someone call claiming you owe money, demand they follow the law by mailing you proof of the debt. Refusal to do so for any reason is proof of the scam.

This is absolutely a scam company.  If they aren't registered in any state, then they cannot legally conduct business.  Also, since they are in Massachusetts, they are required to be registered as a debt collector.  They are not.

I was told by Scott Kellerman, that he was from Johnson Smith & Associates and that I owed past medical bills totalling  $7,000.  Now because I did have past medical bills I thought they were legit.   Then I was told in order to set up a payment plan I needed to speak to Ed Logan (978-513-8267).  So I was stupid enough to set up a payment plan. I recently looked at my bank statement and saw the money taken out was from Brockton Group Ca., and the phone listed was 844-230-0301.  So I called this number and it was the voice of Ed Logan, saying you had reached Brockton Capital Group.  When I did a phone reversal look up the numbers showed up in Lowell Massachusetts. These phone numbers can show up anywhere in the US. So I left a nice message for Mr. Logan, requesting a verification of debt letter, the amount I've paid and a balance, and if I do not receive this letter he can fu*** sue me!

I have read through several posts, all pointing to scammers, and I too have been contacted by Johnson, Smith & Associates. The claims they are making are BOGUS. Do NOT feed them. They try to scare people with their messages, albeit politely. One person, posted some great resources, different agency to report the harassment. I contacted a lawyer, that did not charge me, when this first happened and he was able to get it resolved, but now I'm getting calls again. These creeps are relentless, be armed with legal truth and if you answer when they call, tell them what the law says and tell them they are not allowed to contact you by phone, only through mail, and do not give them your address.
