To see what they would say or do, i have had plenty of recordings on friends family and even coworkers answering machines stating i was in serious trouble for fraud against a financial institution and if i didnt call back they were going to sue me, I knew they wouldnt so i just called informed them they were being recorded and they hung up and havent called since. I am pretty sure you have to state you are recording a conversation in texas for it to be legit in court. either way they never came through with the threat and never called back case closed til they move it to another one of their shady companies and ill do the same. Fool me once shame on you fool me twice same on me....never again will i fall for scare tactics....NEVER

TX 1 PARTY STATE replies to record all calls

No you do not have tell them you are recording in TX.

If you live in a state that does require DISCLOSURE - and you have to tell them you are recording - IF they refuse to consent - leave recorder ON - tell them not to call back again unless they consent to being recorded and then hang up.  Do this each time they call!

Not a bad idea, and you're right about Texas being single-party.

Texas also has unusually strong collection laws, one of which I believe forbids agencies to simply walk away from a validation request.

They wont even give you an address to send it to nor will they mail you anything, basically they tell you that you can give them your email and upon agreeing to a payment plan they will send you and email. They are full of it, I just feel sooo sorry for the people that fall victim to their scam they get taken to the cleaners without knowing their rights. They need to be shut down, i do not understand why these people are still in business, oh wait they get scared change their number and name and try it all over again.

Sadly it's true that the worst debt collectors are tail draggers, erasing their own trails as they trot slightly ahead of regulatory scrutiny. A true sign of an industry lawbreaker is any desperate effort to conceal a valid mailing address. Luckily we now have resources like this site to help us lift their smokescreens.

Is that why its Hard to SUE
Why arent lawyers jumping all over these people, is it because they are hard to locate, Notified one and they said they wouldnt take the case, not sure what it is but i hope someone out there will take them to the cleaners

Did you ask them why?  Different lawyers practice in different areas.

    Try looking here: <http://www.naca.net/>

You can call the Bar Association and ask for a referral to someone practicing in the area of consumer law.

You might also find this site interesting:

And finally search for "pro se fdcpa" to find a number of DIY sites.

I received a voicemail from a person named Kara Alexander stating that I wrote a hot check so I called back after some research on the number. Come to find the forums and this is not the first time that I was supposably be sued by this "plantiff". Called my Lawyer and got him on a converince call and I stated who I was and so did my Attorney and this Trisha stated that she could not understand us and hung up. 30 minutes later a Mr. Carter Called, yes thats what he called himself and would not give a first name, stating that the plantiff is sueing me due to a hot check. The company that he told me it was I do own money to but no hot check and I just hung up. Mr. Carter called back and left a voice mail stating I had 48 hours to contact him or I would be served. Contact the FBI in Dallas and they stated that if you were being sued of anything no one would call you instead you would be served with a hand delivered paper

I recently recieved a phone call from them a couple weeks ago. I was thrown off guard because my financial situation, thank God, is good and my credit is great, yet they are telling me that I wrote a bad check. They said it was for a fax order made by some male that I do not even know, but the weird thing is that if someone would have stolen my checks without my knowledge it should have cleared because I haven't stopped payment on anything. Anyways, they left their phone number 866-782-9808 and I called and left a message firmly stating that I am inquiring regarding a message I recieved from them regarding a bad check. And I made sure to sound real bold, professional, and with same aggressiveness as the man that left me the message. I also told them I was investigating this matter closely using all of my resources since my husband is a police officer. Well, they haven't called me back, I'm still waiting for a response. I think this is a scam too. I haven't had any problems keeping up with my debt since I was real young, so this caught me off guard and did kinda scare me for a minute. Then, when I mentioned it at work, someone had said they went through the same thing and it turned out to be a scam. They went to the police station and reported it and a police officer called the number back and left a message and never again did they contact my coworker. Hmmm! Sounds like they don't like the cops. Lol. Just beware everyone, don't give these creeps your hard earned money!
