    Shadow Creek Capital Just called me today. They were very rude and unprofessional so they didn't get far with me I said ill take my chances with a judge. Reading all the comments I'm happy with my choice in not making a payment..

    Chapter 392, Finance Code, provides for both civil remedies and criminal penalties. Tex. Fin. Code §§ 392.402–.404. A consumer may take private legal action against a third-party debt collector or credit bureau for a violation of Chapter 392. In addition, a consumer may file a complaint with the attorney general if the consumer feels that the third-party debt collector or credit bureau has violated Chapter 392 by engaging in a false, misleading, or deceptive act or practice.

    Engaging in debt collection without filing a bond with the secretary of state is a violation of Chapter 392 and may also be a criminal offense. Tex. Fin. Code § 392.402. The attorney general or a district or county attorney may investigate an alleged violation of Chapter 392. If you notify the secretary of state, this office will notify the third-party debt collector or credit bureau of the bond filing requirement and, if necessary, refer the matter to the attorney general for investigation. Please report the names of any third-party debt collectors and credit bureaus that do not have bonds on file to:

    The secretary of state is a filing officer for third-party debt collector and credit bureau bonds and does not have authority to regulate the business practices of third-party debt collectors or credit bureaus.     You may also report any problems that you have with a third-party debt collector or credit bureau to the Federal Trade Commission. The FTC is authorized to take action against a third-party debt collector or credit bureau who violates the federal Fair Debt Collection Practices Act. Complaints with the FTC may be filed online or by calling 1-877-382-4357.

    It's pretty funny that you would put someone down for being successful. The people that are getting phone calls  from any agency STOLE MONEY and should pay their bills.  I used to work for the company you are talking about before I started my own business and there is NOTHING illegal or shady about the operation.
    The reason companies change number is because uneducated people like yourself that do real illegal things like borrow money and not pay it back spread useless "knowledge" such as your post.
    The fact is if u can read, look at the laws, an agency has every legal right to serve ( not severed as you spelled it lol ) and legally pursue "DEBTERS or Criminals take your pick on the wording " and take them to court for their actions.
    You should get off the 1994 laptop in your moms basement, pick up another shift at McDonalds and take care of your obligations.
    Collections is a viable business that is one of the only right spots in this horrible economy holing people accountable for driving the economy into the ground and blaming others for their carless decisions and sterling money from lenders with no intentions on paying it back, not to mention employing THOUSANDS of people and providing for THOUSANDS OF FAMILIES. So instead of speeding lies give a smart business man credit for working hard, taking chances, and making a difference in a small community. If you want to post about something post about the people sterling millions from lending companies and then dodging them for months on end just to avoid payin their debt.

    It's pretty funny that you would put someone down for a single spelling error, versus about twenty sloppy mistakes in your collector's songbook diatribe. You tell "speeding lies" to justify your punishment of already distressed victims and funnel "sterling millions" straight to your bosses. They're not driving an economy, they're driving Bimmers and Hummers to their McMansions. They're not "Job Creators" but Wealth Hoarders. I would agree you're all "taking chances" against being sued into oblivion, if not jailed, for illegal practices.

    I want to help you make your case, so please bear with me, and read carefully.

    I gather from the reports here that people feel you are collecting money which is not actually owed. But assuming that you are correct about the debts, if the remaining content of the reports has any truth to it, it still seems clear that you are likely to be a gross violator of the FDCPA.

    And I have seen so many shills using the tired "former employee" line. Admit it, you are a principal character in this little operation, aren't you?

    As I said, as a fellow businessman (although probably not as smart and ethical as you) I really want to be fair. Please help me to do that. If you are legitimate, then why not prove it by providing us with a little information?

    What is your business address? In what state(s) are you licensed/incorporated? Who is your chief executive? What is your main phone number so I could call with questions? Who is your registered agent? What is your DUNS number?

    These are very ordinary business questions, and something no legitimate company hesitates to provide. If you provide this information, then I think that people will be much more comfortable working with you to pay any legitimate debts they owe. Openness is something "smart businessmen" know to be in their best interest if they want to establish trust.

    Furthermore, if you do check out as legitimate, I will post to that effect. After all, I like successful business people if they are honest. I particularly like a business which is "one of the only right[sic] spots"..."holing[sic] people accountable". My yes, you sound like a real Horatio Alger. And I hate "speeding[sic] lies".

    As an added incentive, if you will provide your verifiable name and address in your next post, I promise to send you a free copy of a remedial grammar book, as well as a "word-a-day" calendar, in order to help you improve your written communications. If you are married, I will also happily send your spouse a copy of "How to Deal With the Jerks in Your Life".

    In fact, I will go even further. If you convince me that you are the stand-up champions of the economy that you claim to be, I will send you a brand new alternative replacement for YOUR mom's laptop, since using it seems to be causing you to make so many horrific typing errors.

    Now please cover up, you know how damp and chilly it gets in the basement. I'd hate for you to die of pneumonia BEFORE I get the information from you.

    The truth of the matter is, if you owe a debt pay it/ you had your fun with spending it and enjoying your purchases but you do not want to make good by it. Who is the real criminal here? You are, you sign a contract with a company whether a credit card a loan or any type of borrowing stating you will repay what you used  but when the time comes to repay it you fault and then cry "harassment and bloody murder" . Maybe if you actually took responsibility for your financial actions then you would not have calls coming in to collect money for something you do legally owe, if you actually paid your bills then these would not be in a collections office. Lesson to be learned....PAY YOUR BILLS...you made them Take responsibility and pay. You reap what you sew..

    Nice work of fiction.  Many of these people who get calls either owe no bills or the bills have been paid off.  The crooked collectors use outdated or invented data.  Yes, pay your bills to the original creditor, by all means, but NOT to a scam artist who threatens without ironclad proof.

    This is a fraud company.  They are stealing money from everyone by scaring them with "legal documents" that they do not have!  Turn them in online at ftc.gov...we've got to get this stopped!

    Yes.  They are criminals, and impossible to locate.  Without a badge, it is nearly impossible to get any relief from these companies.  They don't respond to lawsuits, and instead will simply fold or change names after a lawyer gets a judgement, has it registered, and tries to collect.

    A family member got a call from this company at which they were told i wrote a "bad Check", i dont even have checks on my bank account, they then called my grandmother's home where they found me and refused to tell me what it was about, when i questioned why they disclosed info to my other family member and they wont give it to me, the guy "shawn turner" said he told her cuz she said she was my mother...thats a lie!! and still refused to tell me what it was about, just that it was a sealed envelope that he could not open but a binding legal agreement,  he then gave me a number to Shadow creek capital and advised me to call...Instead i called my lawyer, he advised me of the scam and told me to do nothing....i later returned home today to find a message left on my grandmother's machine, which shawn turner says he has documents to serve me with and wants to take them to my residence or employer if i dont call and setup a time to "meet up" needless to say i still do not know what this is about and have no intentions of calling anyone other then my lawyer, i hope no one else believes these people, my grandmother was so worried after hearing this message, it was very disturbing. the new contact number they are giving is.....855-790-0093.

    Ladies and Gentlemen, Shadowcreek capital is a collection agency dealing with payday loans you took out between 1-3 years ago mainly from Ace Cash Express. It's alegitmate company. I know b/c I had an account with them. After I paid it out in full, I received a Paid-In-Full letter from Ace as well as a letter from Shadowcreek explaining my arrangement that I Paid-In-Full.
     
      If you people would pay your bills on time (unlike me, haha), you wouldn't be getting these calls. Again these are payday loans you took out. Just pay them back to get these people off you back.
