    SHADOW CREEK CAPITAL ----- This place is a chop shop! They are collecting on Payday loans - tell u they are going to serve u and and have u call them right back - these people are no process servers - the are scams - OK, u probably do owe the money .. but u will not be severed or arrested. they can do nothing to u- NOTHING!!! they tack on additional fees that DO NOT belong to u! They are located in Angola NY, sub of Buffalo. there phone # is 716-934-0058 - they run an illegal cigg shop too. The owner of this company it PAUL ERICKSON - better known as "THE DUDE"! Complete TRASH! Him and his partners should be hung - they - Charlie Lockwood, Shawn Bury (last name spelled wrong) and Chris Collins, along with some other shady people, are living a great life. Vacations in Florida, summer homes on the beach - all this from money they are stealing from you!!!!! When the heat is on - all the do is change their phone numbers and/or the name of the company - It's that easy!

    I have been approached by shadow creek capital at work. They called my work and then said that a process server was on the way to serve me and then supposedly a process server called my work to get directions. When my boss gave me the message, i called shadow creek capital and was told they if i set up 2 payments that they would hold off on serving me. I was scared so i did, but now i need to get ahold of them before 2 days are up so i can stop it from happening because i have been hearing the same thing about them.

    To stop the payments contsct your bank.  I don't think Shadow Creek will answer calls from you.

    What "not Michael" said, but hurry.  They will not wait the two days if the money is there.  Expect them to potentially empty your account, no matter what your agreement was.

    Thank you. I did contact my bank and they are going to put a stop payment but it takes about 3 days, so i am out of luck. They told me once it post that i can dispute it and then they will investigate it but who knows how long that will take

    It is hard to give you good advice without knowing a lot of details.  Is the debt valid (I'm guessing it isn't?).  If by some outside chance it is valid, how much is it?  Is this account all the money you have to live on? (I'm guessing it may be.)  If so, you need to be aggressive and bold about all this.

    At the moment, I'm assuming this is a payday loan scam?  

    I have no idea what you may have outstanding against your account, but I would withdraw as much cash as I safely could without bouncing checks, (bouncing checks would make your life a lot worse). Although if these guys clean your account, checks will bounce anyway.  

    Of course, if you don't have anything outstanding against your bank account to worry about, you could take almost all of the money out.  Or you could open a new account.   I would open the new account before I considered closing the old one - if you are in a mess financially at the moment you might have trouble opening an account, so you would want to be sure of getting a new one before closing the old one.

    Also, you need to review whether you have overdraft protection on your account, and if so, whether that is in your best interest at the moment.  If something legitimate does get bounced because of something these clowns do, it is important to be aggressive and proactive in contacting the merchant and getting things resolved.  Just remember that overdraft protection can be very costly if it kicks in.

    it looks like they may in fact be able to require a three day lead time on stop payments for electronic transfers.  That seems excessive.  Anyway, you might want to look over those two sites.  Forewarned is forearmed, and these are the rules they are playing by.

    As far as how long it takes for a dispute, a couple of years ago I had someone place some charges against an account using a card they created with my account info.  I believe it took a little over a week to get it all straight.  I had to do an affidavit that the charges were not mine.  Not a big deal unless you are short of cash, which I gather you may be.  However, I can't promise that your experience will be the same.

    By the way, process servers don't call up and say, "I'm a process server, and I need directions to where you are."  Even if they were calling for directions they would say, "I have a delivery for you, and I am having trouble finding your address."  But in today's world, who wouldn't be using a GPS and the Internet in that line of work.  My point is, there was no process server, it was just a ruse to scare you.

    You should know that these guys are violating the law left and right.  Take a look at: <http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm> If you can document what these creeps have done, you could potentially recover damages by taking them to court.

    A decent lawyer would probably give you a free initial consult, and would likely be willing to give these jerks a call.  That is all it is likely to take to send them running unless you have some sort of legitimate and COLLECTIBLE debt.  Even then, they are violating the law so badly, I think that they would be fools to get in front of a judge with you.  Legal Aid may also be able to help you, see: <http://www.lawhelp.org/> , search the Internet for "Legal Aid" and the name of your state, or look in the phone book.  

    Worst case, 1/2 an hour to an hour should be enough billable time for a lawyer to get you straight.  Call around and see what you can find that is within your reach.  I have had many $25 legal consults when I just wanted someone to review a letter I had written.  I've also had some that were free, and one where I "paid" by sending some nice frozen steaks!  Of course, I've also had litigation where the cost was breathtaking, but you aren't in that situation.

    I would love for your next post to be that you have talked to a lawyer, or at least that someone at the bank is actively helping you to protect your money.

    this company called me saying they were going to serve me w papers and used scare tactics to get my attention.  i did owe a debt to the company they refered to so i thought it was on the up and up. my mom and me started to do some research on the company and found this godsend of a website.  all they got was $20 out of me thank goodness!!!! i cancelled the card so they cant get anything from me.  i also made a phone call to the state attorny generals office as should everybody else.  these people need stopped!!!!!!!!!!!!!!!!

    I love when these idiots call and catch them off guard...please serve me...oh wait its a scare tactic..my favorite thing is when they call and tell you that you are going to be served for hot checks what ever i never wrote a check and a debt does not consitute for a hot check law. I love that i tell you to serve me weeks go by and you call again with the same threat come on be more creative. I will not buy into your scam and i feel bad for those who do, if you were a legitimate company you would have an address you are willing to give out or even a website with information on your company. You do not scare me and never will....keep calling i love to chat again with you sometime!!

    be careful of other companies these fools own like: Santa fe Mangement, orbit international, titan, xerox management....they are some shady fools....Dont fall for their scams they keep getting caught and have to keep changing their name and numbers new number to look for is 855-229-7424

    Just got a call from this company saying the same thing you all have posted.  Where do you report people like this?  I do owe money to people given today's economy and jobs hard to find, but I did not write "hot checks".  They also are not to leave that kind of information on a voice mail that someone else may hear.  That is against the privacy law!  Anyway, they are still at it.  Anyone have any other advice?

    Do not take their threats seriously they are trying to scare you, you can tell them to cease all communication with you and even tell them to serve you, they will not. They are out of New York and have a bunch of shady sister companies that use the same tactics. I have told them to serve me they claimed the same thing on an account i never had no one ever came with paper work to serve me its a lie lie lie. do not give them any information nor any money. Do everything in writing and an email with a payment plan is not sufficent enough

    When you talk to these people first thing out of your mouth should be that you are recording this conversation for legal purposes, they will start talking then act like they cannot hear you then hang up, they know what they are doing is false and they dont want to incriminate themselves anymore so they act like this hang up and then when you try to call them back it goes to some voice mail and they dont call you anymore.

    Becareful they love to harrass your family and friends saying you are going to be served which is highly illegal...they can not disclose any information to any party but you and your lawyer!!!!!!!!

    With a debt collector of this caliber, phone contact is likely to yield the most and worst legal violations, which can be turned around and used as spears against them in court. I'm sure the described call would have proceeded much differently if the commentor had kept quiet and recorded anyway. This would be perfectly legal in just over three-quarters of the States, and federal case precedent from August 2010 favors single party consent so long as the recording purpose has no malicious intent.
