"The FTC says it must every time order directly from the creditor."

You taught me something Res, thanks, and I'll hush up now.

Just to crush all doubt, the mandate for proper validation sourcing was made black-and-white in the famed "Wollman" staff opinion letter in 1993.

    http://www.ftc.gov/os/statutes/fdcpa/letters/wollman.htm
"... it is important that the verification of the identity of the consumer and the amount of the debt be obtained directly from the creditor. Mere itemization of what the debt collector already has does not accomplish this purpose."

That's a good point.  I do think it would be good to send another letter - as you said, it would put another nail in the callers' coffin.

I received a call from lit man group about a debt to chase manhatten. It was from a credit card back in 2003. Oregon law says six 6 years for littigation on past due debt. Do they have legal recourse against me?

Even if the debt is valid, it's still outwith the statute of limitations for collection in your state, so they can't sue or threaten to sue to collect.

However, if you do owe this debt, and you want to do the right thing and pay it - please demand that the caller sends you - via mail (not via email or fax) - written proof that you owe this debt and that they are legally able to claim and collect said debt in your state.

You also have the option to let them know that you do not have to pay them due to the statute of limitations for collection.  If you choose this option, you would have to send them a cease and desist letter sent certified mail/signature/return receipt requested so that they won't bother you about it any more.  Remember, that just because a debt is outwith the statute of limitations for collection, that doesn't mean that you can't be called and asked to pay it.

Be aware if you choose the last option, that they may sell on the debt to someone else.  This all supposes that the debt is indeed yours, and that they now own this debt, of course.  Read about the FDCPA and learn your rights as a consumer.

Watch out for any request to "just pay 10 bucks" to show good faith or something.   Showing intent to acknowledge and pay the debt may restart the statute of limitations.    Pay it all or don't pay anything.

This is a collection agency and they try to scare people with their company name by using 'litigation' they think people will actually think is official government related. They focus on collecting really old collection accounts. If you answer ask them for proof of debt where you signed off for the credit. They don't have it because is so old. Therefore if they cannot prove the debt is yours they can't do anything else other than move on to the next person and see if they can intimidate them to pay them on another old debt they have no proof on.

Seems that LMG gives many people the ten day overshadowing routine. I wonder if everyone gets that violation or a select category of accounts.

Errm, okay. I've not been contacted by LMG but I encourage action from those who have. Ratting out a lawbreaker to a state AG is something I advise often, but I should think plain First Class mail would suffice, unless you have a deep mistrust of that office.

What I advise more often when your FDCPA rights are violated is not to merely file reports and wait for a rescue. An Attorney General is not *your* personal attorney. If you want relief, get it yourself with your own summons and complaint. The Act gives you one measly year to file suit from the date of whatever violation being claimed.

I had the same this last week a Mr Diaz call me says I owe $34,000 to citibank from 2008 (funny thing havnt had citibank since 1988) says I am being sued in New York the next monday but he could stop it if i would settle for $2207 right now all he needs is my bank account number. Say he is an Attorney for litigation management group, told him I have always wanted to go to New York so I would see him there(he then said he was going to but a lean on my property and had just got off the phone with my bank then hung up.
yesterday a week later my sister in law gets a call from Litigation Management But this is a 781-341-7724 number instead of the 1888-258-0566 number says his name is Anthony Ryan and tells her he needs to talk to me or my Attorney by 5pm, then called my 76 year old mother tell her he has to talk to me before monday to keep me out of Jail, then called my work tell the switch board to have me call about case #226737, then called my exwife which i havnt seen in 27 years and says he has a legal matter and needs to have her tell me to call. So last night this joker calls me first thing I says is just to let you know I am recording this call he says you dont have permission so i say then hang up and dont call again he continued saying he just wanted to settle this matter so i asked for a debt validation he said ok I will email said no regular mail asked for my address I said if your really who you claim you have my address he proceeded to threaten me with jail and wage and bank levies, I thanked him and he hung up...I am sending all the information to the Attorney general with letters from all the family members they have contacted, I suggest EVERYONE these people have called get together and fight back as a group or individuals but these scammers behind bars and out of business messing with me is ok but going after family and putting fear in them is NOT OK for any reason...Thanks

I was just contacted by a Mr. Jennings with LMG for a debt that I supposedly have with Crescent Jewelers. Mind you, Crescent Jewelers has been out of business for 5 years now, and my husband financed my wedding set 11 years ago, and has had it paid off for 9 years. I know that the statute of limitations in Cali is 4 years, so this one is way over. He is threating to put a lein on my home (my landlords would love that lol) and attach my husbands wages. So I did a BBB search on this company. They have had 1 complaint filed this year. I think we should start opening up complaints so more people know about what they are doing. I am fortunate enough to have an attorney who is all over this, but I know many people can't afford one. Be careful!! Look into this company and proceed with caution.  Very fishy stuff they are trying to pull.
