PACER waives he first I think it is $5 per month in charges that you accrue. I think the PACER fee is 10 cents per page. A document that just says a case was settled would be one page. So you should not accrue $5 in PACER fees for one short document, and if that was your only PACER download that month, even that small a fee should be waived. PACER does show you how many pages and the cost for it before you download.

Does anyone care to share what they may have uncovered regarding any association/affiliation of A1 Solar to American Pro Energy?

This is a fairly old post. Do you have any more recent information concerning this collection of scum bags?

Solar is all a big farce to begin with. It takes 20 or 30 years for you to save enough money to pay for those panels.

That has nothing to do with the unwanted calls.
Installation of solar panels is a major construction project, and any construction business that uses telemarketers cold-calling residences is a business to be avoided.
As for the ROI, so what? People spend money because they want to.

Sure. I've collected from this collection of scumbags (A1; American Pro Energy is the fake name used by their call center). So have other people. You just have to know the law, how they are violating it, get your evidence together, and know how to file a case in small claims.

I lost my case in small claims court, the judge told me I was in the wrong court.

Judges are a crapshoot. Some don't know the law and are unwilling to learn. Even when confronted with the applicable sections of Federal and State code, their minds are made up.

On the positive side of the ledger, I seldom get a judge that bad. Happens occasionally. When I have a strong case, I almost always win.

I have lost cases, only to have the idiots call me again, and then I made up for it the second time around.

So... even if you lose one, don't ever quit.

I had the same problem in southern Cali. The judge told me that I should be in federal court. He said that since this is a case involving federal law, that is where it belongs. I talked to an attorney afterwards and he agreed with the judge, so we are going to file in federal court. It will probably be a while, but I'll try to come back and let you know how it turns out. My attorney isn't worried about winning the case, just collecting on it.

    Smile, Dial, then Trial
The American Pro Energy plaintiff filed for class certification. If plaintiff can get that motion ruled upon favorably I sure hope it will slow down the calls because they are still rampant.
